W. 4 Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at
11:00 a.m. on December 16, 2013. Mayor Wendell Dunlap presided. Councilmembers
present were: Charles Starnes - District 1, Cathy Waggoner- District 2, David Garcia -
District 3, V. O. Ortega- District 4 and Lionel Garcia - District 6. Councilmember Eric
Hastey- District 7 were absent.
Staff members present were: Greg Ingham -City Manager, Sarianne Beversdorf-
Director of Finance, Jeffrey Snyder- Assistant City Manager, Isauro Gutierrez -
Information Technology Specialist, Mike Gilliland- Director of Public Works, William Mull -
Police Chief and Belinda Hinojosa -City Secretary.

Mayor Wendell Dunlap led in the Invocation.
Greg Ingham, City Manager presented for consideration on second reading Ordinance
No. 13 -3603, an Amendment to the Ordinance Granting to Southwestern Public Service
Company, Its Successors and Assigns, the Non - Exclusive Right to Use and Occupy
Rights -of -Way within the City of Plainview for the Construction and Operation of an
Electric Transmission and Distribution System; Prescribing Conditions Governing the
use of the Public Rights -of -Way; Providing for Compensation; Designation an Effective
Date and a Term of Said Franchise; Providing for Written Acceptance of this Franchise;
Finding that the Meeting at which this Ordinance is Passed is Open to the Public; and
Providing for Severability.
This amendment to the City's franchise Ordinance to Southwestern Public Service
(Xcel) expands the definition of Gross Receipts to include additional miscellaneous
revenues. These miscellaneous revenues are focused on customer related services
and include returned check charges; reconnections charges after a disconnection for
nonpayment; restoring service after a tampering or unsafe situation disconnection; and
charges related to metering tampering. The result of this change is a slight increase in
franchise fees collected by the City in the range of $400 a month.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember Ortega moved to adopt Ordinance No. 13 -3603 on second reading.
The motion was duly seconded by Councilmember David Garcia. The motion carried by
unanimous vote.
Jeffrey Snyder, Assistant City Manager presented for consideration on second reading
Ordinance No. 13 -3604, an Ordinance Amending the Zoning Map of the City of Plainview,
Texas by Issuance of a Specific Use Permit to Operate an Arcade in a Commercial Retail
(C -2) Zoning District Said Parcel Being Unit 2, Lot 2 of the Hartley Subdivision, City of
Plainview, Hale County, Texas, Same Being 1001 West 5 Street; Cumulativeness
Clause; Conflicts Clause; Severability Clause; and Effective Date. This is the request of
Danny Davidson to operate an arcade at 1001 W. 5 Street. This is zoned C -2
Commercial Retail. This has been presented to the Planning and Zoning Commission and
it was determined that all of the requirements of a specific use permit have been met. The
Planning and Zoning Commission recommends approval.

Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro
Tem Waggoner moved to adopt Ordinance No. 13 -3604 on second reading. The
motion was duly seconded by Councilmember Starnes and carried by unanimous vote.
There being no further business, Mayor Dunlap adjourned the meeting at 11:49 a.m.
