HomeMy WebLinkAbout98-3154SANITATION CHARGES - Scrap Tires ORDINANCE NO. 98-3154 AN ORDINANCE OF THE CITY OF PLAINVIEW, HALE COUNTY, TEXAS, ADDING CHARGES FOR THE ACCEPTANCE OF SCRAP TIRES AT ~ CITY OF PLAINVIEW LANDFILL; CUMULATIVENESS CLAUSE; SEVERABILITY CLAUSE; CONFLICTS CLAUSE; AND EFFECTIVE DATE. WHEREAS, the proposed addition of a special disposal rate for scrap tires is necessary due to changes in state law; WHEREAS, it is necessary to collect sufficient funds to cover all costs associated with the handling and disposal of scrap tires; THE CITY OF PLAINVIEW HEREBY ORDAINS, that: SECTION I. A new paragraph (c) shall be added to Section 22-35 of the City of Plainview Code of Ordinances and shall read as follows: (c) Whole tires brought to the landfill for disposal shall be charged at a rate of $0.11 per pound. This rate applies to all types and sizes of whole fires. Tires which have been quartered, split, shredded or otherwise cut in accordance with state guidelines shall be charged at a rate of $41.00 per ton. SECTION II. Section 22-42 shall be amended to read as follows: It shall be unlawful for any person to set out for collection or place within any city owned refuse container any quantity of used or scrap tires or portions thereof R shall be unlawful for any person to transport to the City sanitary landfill for disposal, dispose of in the City sanitary landfill, or otherwise dispose of any quantity of used or scrap tires unless the tires are first shredded, split or quartered in accordance with state guidelines. The rate for disposal of tires shall be in accordance with Section 22-35. paragraph (c). Page 1 of 2 SECTION III. If any section, subsection, sentence, Clause, phrase or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining provisions thereof. SECTION IV. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulation or governing the subject matter herein. SECTION V. All ordinances or portion of any ordinance of the City of Plainview, Texas in conflict herewith are hereby amended to conform with the provisions hereof. SECTION VI.
