Specific Use Permit
ORDINANCE NO. 98-3153
AN ORDINANCE AUTHORIZING THE ISSUANCE OF A
SPECIFIC USE PERMIT TO OPERATE AN ARCADE IN A
C-2 (COMMERCIAL RETAH, ) DISTRICT, GENERALLY
KNOWN AS 2002 QUINCY; CUMULATIVENESS CLAUSE;
CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND
EFFECTIVE DATE.
WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance,
sets forth in Section 33 the requirements for obtaining a specific use permit; and
WHEREAS, Donald Mansel has requested that he be granted a Specific Use Permit to
operate an arcade in a C-2 (Commercial Retail) Zoning District and being 2002 Quincy Street;
and
WHEREAS, notice of a public hearing to discuss the issuance of said permit was
published in the Plainview Daily Herald before the 15th day prior to the hearing date; and
WHEREAS, said hearing was held in the Council Chambers of the City Hall, Plainview,
Texas, at which time persons appeared in support of the proposal; and
WHEREAS, the proposed issuance of a Specific Use Permit, as herein after made, has
been duly presented to the Planning and Zoning Commission for its recommendation, which was
received by the City Council; and
WHEREAS, it was determined by the City Council that the issuance of the Specific Use
Permit would not be detrimental or injurious to the public health, safety or general welfare, or
otherwise offensive to the neighborhood, said Specific Use Permit shall issue in the manner
hereinafter set forth in the body of this Ordinance;
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of
Plainview, Texas that:
SECTION I
Donald Mansel is hereby granted a Specific Use Permit to operate an arcade in a Commercial
Retail District, said parcel of land being

TRACT 1: Tract 1 out of Block 43, Lakeside Addition of the town of Plainview, Hale County,
Texas described by metes and bounds as follows:
BEGINNING at a point 155 feet East of the Northwest corner of said Block; THENCE South
170 feet;
THENCE East 288 feet;
THENCE Northwesterly along the boundary line of the Ft. Worth and Denver South Plains
Railroad right-of-way, 239;
THENCE West 132 feet to the PLACE OF BEGINNING.
TRACT 2: A tract of land 170 feet x 155 feet out of Block 43, Lakeside Addition to the town of
Plainview, Hale County, Texas, described by metes and bounds as follows:
BEGINNING at the Northwest corner of said Block No. 43;
THENCE East 155 feet;
THENCE South 170 feet:
THENCE West 155 feet;
THENCE North 170 feet to the PLACE OF BEGINNING.
TRACT 3: All that portion of Block No. 42, Lakeside Addition to the town of Plainview, Hale
County, Texas, lying South of the Ft. Worth and Denver South Plains Railroad right-of-way, and
being described by metes and bounds as follows:
BEGINNING at the Southwest corner of said Block No. 42;
THENCE East 225.6 feet to the West boundary line of the Ft. Worth and Denver South Plains
Railroad right-of-way;
THENCE Northwesterly across said Block with the West boundary line of said railroad right-of-
way to a point in the West line of said Block No. 42, 221.7 feet North of its Southwest comer;
THENCE South 221.7 feet to the PLACE OF BEGINNING.
The same being 2002 Quincy Street, Plainview, Texas
SECTION II
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or
diminish the applicability or enforcement of other ordinances restricting, regulating or governing
the subject matter herein.
SECTION IH
All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict
herewith, are hereby amended to conform with the provisions hereof.

SECTION IV
Should any section, subsection, or any portion hereof be deemed invalid for any reason,
such holding shall not render or invalidate any other section, sub-section, sentence, provision,
clause, phrase, or word severable therefrom and the same shall be deemed severable for this
purpose.
SECTION V
This ordinance shall be of full force and effect upon its passage and publication as required
by law.
