HomeMy WebLinkAbout03-3377 ord102 ORDINANCE NO. 03-3377 AN ORDINANCE OFTHE CITY OF PLAINVIEW, TEXAS DESIGNATING A PORTION OF FM 3466 (SW 3~d Street) 500 FEET WEST AND 500 FEET EAST OF ENNIS STREET AS A SCHOOL ZONE; PROVIDING FOR A PENALTY; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, the PlainView Christian Academy and La Mesa Elementary Schools lies just south of FM 3466 (SW 3rd Street); and WHEREAS, there currently does not exist a designated school zone on FM 3466 (SW 3~d Street); 500 feet west and 500 feet east of Ennis Street; and WHEREAS, The Texas: Department of Transportation has installed flashing beacons for a new reduced speed limit School zOne on FM 3466 (SW 3rd St'reet), said school zone is to be installed to enhance the safety of students crossin~ Southwest 3~d Street going to and from schools in the vicinity and attending activities at the Plainview Country Club during normal school hours; and WHEREAS, the City Council finds it in the best interest of the public safety of the citizens of the City of Plainview that the above-mentioned portion of FM 3466 (SW 3rd Street) be designated as a school zone with appropriate signage and certain speeds be prescribed during speCific hours; NOW, THEREFORE, BE IT ORDAIN ED by the City Council of the City of Plainview, Texas that: Section I On that portion of FM 3466 (SW 3rd Street) from 500 feet west of the center line of Ennis Street and same said distance of 500 feet east of the center line from Ennis Street. Flashing beacons informs the public when the school zone is in effect and proper signage states the speed limit to be thirty-five (35) mph. The flashing beacons shall be in operation on Monday through .Friday of each school week, it shall be unlawful for any person operating a mQtq~, yehiC]e, which is self-propelled, to operate said vehicle at a speed greater than thirty-five (35) miles per hour during times the flashing beacons are in operation. Section II Any person who shall violate or fail to comply with the provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not less than $1.00 and not more than $200.00 Ordinance No. 03-3377 School Zone Page i of 2 103 Section III Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein, Section IV All ordinances or portions of any ordinances of the City of Plainview, Texas in conflict herewith, are hereby amended to conform to the provisions hereof. Section V Should any section, subsection, or any portion hereof be :deemed invalid for any reason, such holding shall not render of invalidate any other section, Sub-section, sentence, provision, clause, phrase, or word severable therefore and the same shall be deemed severable for this purpose. Section VI This ordinance shall be in full force and effect upon its passage and publication as required by law.
