HomeMy WebLinkAbout97-3129CURFEWS - MINORS ORDINANCE NO. 97-3129 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING SEC. 17-41(B) OF CHAPTER 17, CURFEWS - MINORS, OF THE PLAINVIEW CODE OF ORDINANCES; REDEFINING THE CURFEW HOURS; CUMULATIVENESS CLAUSE; SEVERABILITY CLAUSE; CONFLICTS CLAUSE; EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. WHEREAS, on February 8, 1994, the City Council of the City of Plainview passed Ordinance No. 94-5984 establishing a juvenile curfew for the City of Plainview, Texas; and WHEREAS, the City Council seeks to implement this ordinance subject to review on or immediately prior to the first day of the 1998-1999 School Year as defined by Plainview Independent School District; WHEREAS, the City Council desires to amend the above referenced section to read as follows: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION I. That Sec. 17-41(b) of Chapter 17, Curfews- Minors of the Plainview Code of Ordinances be hereby amended to read as follows: (b) CURFEW HOURS means: (1) 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday, or Thursday until 6:00 a.m. of the following day, during the regular school year as defined by Plainview ISD; and (2) 12:01 a.m. until 6:00 a.m. on any Saturday or Sunday; and, (3) 12:01 a.m. until 6:00 a.m. on any day of the week beginning on the day that Plainview ISD releases students for summer recess, and ending the last weekday immediately prior to the date Plainview ISD begins the subsequent fall term. (4) The provisions set forth in section (b)(3), or any section of this ordinance, 1 - Curfew Amended Ord. do not provide for amended curfew hours during brief vacations or recess during the regularly scheduled school year as defined by Plainview ISD. SECTION II. The provisions of this ordinance are intended to be severable. Should any phrase, clause, sentence, subsection or section hereof be found to be unconstitutional or invalid for any reason, such portion shall be severed without effect on the remainder of this ordinance. SECTION III. Provisions of this ordinance are cumulative and nothing herein shah prevent, alter or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter. SECTION IV. All ordinances or portions of any ordinance of the City of Plainview, Texas, in conflict herewith, are herebY amended to conform with the provisions hereof. SECTION V. This ordinance shall become and be effective '~--l ~ in the Plainview Daily Herald within 10 days after passage. , 1997, and after publication PASSED AND APPROVED by the City Council of the City of Plainview, Texas, on this 12th of August, 1997.
