HomeMy WebLinkAbout09.24.2002 BA MinutesBOARD OF ADJUSTMENT MINUTES 9-24-02 BOARD MEMBERS PRESENT: Ray Jameson, Fred Willis, Jennifer Wright, Max Browning STAFF MEMBERS PRESENT: John Castro, Director of Community Services, Katy Seals, Community Development Secretary OTHER GUESTS PRESENT: Guadalupe Cardenas, Dorothy Mitchell, Laura Lucio, Dianna Esquivel First item on the agenda: Approval of August 2002 minutes. Fred Willis made motion to approve minutes. Jennifer Wright seconded the motion. Motion carried 4-0. Second item on the agenda: The request ofErnesto Esquival for a variance of twenty-six (26) feet six (6) inches of the required thirty (30) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20' X 20' carport in a Single-family Residential (R-l) Zoning District, and being Block 3, Lots W50'ofS30'-6 S30'of W50' 7-8, Rowe-Goode Addition, Plainview, Hale County, Texas the same being 1804 W. l0th Street. Dianna Esquivel is present. John Castro showed the Board pictures of the property and a site plan of the proposed carport. John Castro told the Board that normally when a carport will be placed close to the side property line, a side setback is required; but in this case, no side setback is required because the property abuts an alley. He said that the front setback for a Single-family Residential (R-l) Zoning District is thirty (30) feet and that the existing house only sits twenty-three (23) feet six (6) inches from the front property line. This means the house is a legal non-conforming use. In order to make it conforming, the original setback the house should have had has been added to the part of the variance that is being requested. There were two responses received from the neighborhood in favor of the variance. Since the house is sitting on the property line, if the proposed carport is lined up with the house, it will sit on the property line as well. Ray Jameson asked what construction materials would be used. Dianna Esquivel said a certified carport builder, Tim Humphreys- would do the carport. She said the existing carport would be torn down and the new one would be look much better. Fred Willis made motion to grant the variance based on this being the only logical placement for the carport. Max Browning seconded the motion. Motion carried 4-0. Third item on the agenda: The request of Laura Lucio for a variance of twenty (20) feet of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20' X 21' carport in a Single-family Residential (R-2) Zoning District, and being Block 24, Lot 10, NSLS Addition, Plalnview, Hale County, Texas the same being 1619 Independence Street. Laura Lucio is present. John Castro showed the Board pictures of the property and a site plan showing the proposed carport. There were 5 responses received, all in favor of the variance. Jennifer Wright asked what construction materials would be used. Laura Lucio said it would be made of steel. Jennifer Wright made motion to approve the variance based on positive response from the neighborhood and this being the only logical placement for the carport. Fred Willis seconded the motion. Motion carried 4-0. Fourth item on the agenda: The request of Dorothy Mitchell for a variance of fourteen (14) feet of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 21' X 18' carport in a Single-family Residential (R-2) Zoning District, and being Block 23, Lot S45'-13 N10'-14, NSLS Addition, Plainview, Hale County, Texas the same being 1616 Independence Street. Dorothy Mitchell is present. John Castro showed the Board pictures of the property and a site plan showing the placement of the proposed carport. He said this house sits fifty-seven (57) feet from the fi-ont property line. He read the following from the ordinance: "Accessory buildings detached fi-om or attached to the main building by an enclosed or an unenclosed structure may be permitted when the allowable area of any lot defined by the required front, side, and rear building lines under the following conditions: Said accessory building has a side setback of not less than three (3) feet." He said this is why there is no side setback required for this carport. There were four (4) responses received from the neighborhood, all in favor of the variance. John Bickel asked what construction materials would be used. Dorothy Mitchell said it would be made of metal. Max Browning made motion to approve the variance request based on this being the only logical place for the carport and positive feedback from the neighborhood. Jennifer Wright seconded the motion. Motion carried 4-0. Fifth item on the agenda: The request of Guadalupe Cardenas for a variance of twenty-three (23) feet of the required twenty-five (25) foot front setback and three (3) feet eight (8) inches of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 21' X 12' carport in a Single-family Residential (R-2) Zoning District, and being Block 66, Lot N44.5' W/2-11 N28' E/2-11, Alexander and Westmoreland Addition, Plainview, Hale County, Texas the same being 804 E1 Paso Street. Guadalupe Cardenas is present. John Castro showed the Board pictures of the property and a site plan showing the proposed carport. He showed pictures of the existing carport on the property and explained it is sitting on top of a basement and parking there is causing deterioration of the basement. He said he does not know if Mr. Cardenas plans to tear down the existing carport. There were 3 neighborhood received, all in favor of the request. John Castro showed the Board a flyer indicating the pre-fabricated carport Mr. Car&nas is proposing to build. Fred Willis wanted to know if the other carport is not removed, would there be a violation of the City Ordinance that deals with amount of a lot being covered by buildings. John Castro total coverage for an R-2 Zoning District is forty-five (45) percent overall mass ground coverage. This lot would not be in violation. Fred Willis asked if the carport would be behind the existing fence. John Castro said it would be lined up with the existing carport. Fred Willis made motion to approve the variance based on positive response from the neighborhood. Max Browning seconded the motion. Motion carried 4-0. Sixth item on the agenda: The request of Eriberto Castro for a variance of five (5) feet of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct an 11' X 43' carport in a Single-family Residential (R-2) Zoning District, and being Block 25, Lot 9, NSLS, Plainview, Hale County, Texas the same being 1617 Joliet Street. There is no one present for this request. John Castro showed the Board pictures of the property and a site plan showing the proposed carport. He said there is no need for a front setback since the proposed carport will be lined up with the front of the house. He said there is a water line next to the foundation of the house and Eriberto Castro had said he had dug holes where he planned to place the carport poles to make sure he would not hit the water line. The carport wilt not line up with the door of the existing garage. The carport is for two vehicles. Fred Willis asked if the corner of the carport would be in line with the outside line of the garage door and John Castro said it would. Max Browning asked if the neighbor to the south had responded. John Castro said he did not respond. There were two (2) responses received, both in favor of the request. Jennifer Wright made motion to approve the variance based on this being the only logical place for the carport and positive response from the neighborhood. Fred Wiltis seconded the motion.
