HomeMy WebLinkAbout10.27.1997 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES October 27, 1997 Board of Adjustment members present: Chairperson Whit Hunt, Mary Ann Escamilla, Fred Willis, and Ray Jameson. Staff Members present: John Castro, Director of Community Services, and Debra Washington, Secretary of Community Services. Others present: Eliborio Vargas, Lynnvel King, P. Lopez, and Steve Kemp. The meeting was called to order by acting chairperson, Whit Hunt. The minutes were read and motion made to approve by Ray Jameson and second by Fred Willis. Minutes are approved as read. First item on the agenda is BA Case//:1287 The request of Lynnvel King for a variance of twelve (12) feet six (6) inches of the required twenty-five (25) feet rear setback, twenty (20) feet of the required Twenty (20) feet side setback and one (1) foot six (6) inches of the required separation between accessory buildings and main structures as stated in Section 34 of the City of Plainview Zoning Ordinance to enclose a carport (convert to garage) in a R-1 Zoning district, and being S5'-5 All Lot 6, Block 67, of the College Hill Addition, Plainview, Texas the same being 401 Wayland Street. John Castro presents this case. He filmed the location from the corner of 4th and Wayland. Mr. and Mrs. King want to enclose the garage. Initially, the carport was built and later when he started to enclose it, the rules changed. Once a structure becomes a solid building with four walls, the ordinance requires the structure be 10' from the main house. If not, and the structure is closer, it must have the same rear setback as what is required for the main structure. In this case, it would be 25'. Mr. King is requesting a variance 12'6" of the rear setback, 1'6" of the space between the main building and his proposed enclosure on the garage. He is also requesting a variance for all of the required 20' side setback. He is not in the Right-of-Way. Mr. King has done very well in fixing up the property. When Mr. Castro drove by the house one day, he noticed it was being enclosed. Larry Gould went to speak to Mr. King to inform him that he could not enclose the building without a permit. He needed certain variances so he stopped work immediately and came to the city for more information. It will take 1'6" of the setback required between main buildings and accessory buildings. 12'6" feet of the required rear setback and 20' of the required side setback is what Mr. King is requesting. Whit Hunt asks how big is the overall structure? John Castro replies the new structure 24 x 24. Mr. King is available to answer questions. Fred Willis asks if this located at the rear of the house? Mr. Castro replies yes. This is the side that faces the alley. It has the wall, the overhead door and one wall located by the alley. LynnVel King comes forward. Ray Jameson asks how big is the total structure going to be? Mr, King replies 24 x 48. Fred Willis asks what is the intended use? Mr. King says he carries his tools and supplies and it will be used for storage for pickup and trailer. Ray JamesOn asks what kind of roof does it have? Mr. King says it has a gable roof. Fred Willis asks if there be any problem with the water shed since so much of the yard is used up? Mr. King does not believe there will be a problem. Whit Hunt asks if we exceed the 60% coverage rule? Mr. Castro responds that this was done when Mr. King added on to the other part of the house. Whit Hunt asks if the carport was counted into the 60% rule and if the a garage would have counted into the 60% rule. Mr. Castro states a carport will count into the 60% rule. Whit Hunt asks if the carport existed all the way back to the rear setback and will the setback be zero? Mr. Castro says no, the rear setback is 12'6". Mr. Hunt then asks what is the side setback? Mr. Castro points to the side setback that is opposite to the street and conforms to the requirements of 8'. Fred Willis asks if the picture they are looking at on the screen off the street? Was the entire 48' carport built previous to this time? John Castro replies yes, and it was there long before this meeting. When Mr. Castro started researching what was going on, He found the plan that Mr. King was working on at the time. Fred Willis makes a motion to accept the request by Lynnvel King. Second by Mary Ann Escamilla. Motion pasSed 4-0. Next case to be considered is BA Case #1288 The request of Steve Kemp on behalf of Caroline Kopp for a variance of ten (10) feet from the required rear setback of twenty five (25) feet, six (6) feet five (5) inches of the required side Setback of ten (10) feet, and five (5) feet of the required ten (10) feet of separation between accessory buildings and main structures as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 22' X 23" garage a R-1 Zoning district, and being Lot 73, Westridge Park Unit #3, Westridge Addition, Plainview, Texas, the same being 402 Navasota Drive. John Castro presents this case. This is an irregular-shaped lot. He shows a video of 402 Navasota in which you can see the top of a van that they want inside of the proposed garage. Mr. and Mrs. Kopp are requesting a variance of five feet between the accessory building and main building and ten feet from the required twenty-five feet rear setback, and six feet and five inches of the required ten feet of separation between the accessory and main buildings. Whit Hunt asks if the storage building will extend out? Steve Kemp replies that it will. Whit Hunt asks where is the entry to building going to be? Will it be back toward the alley? Steve Kemp states it will be back toward the alley. Mr. Hunt asks if he plans to put more concrete in? Mr. Kemp replies yes. Mr. Hunt states that the alley is concrete all the way from Navasota all the way to Dr. Kopp's house. Based on that, the runoff is going to be toward the front of the house and towards the alley. Steve Kemp replies that is correct. Mr. Hunt asks the peak of the roof is going to run sideways. Mr. Kemp says that is correct. Mr. Hunt asks if this new building will violate the 60% coverage rule? Steve Kemp does not believe it does. Whit Hunt asks if the 60% coverage rule applies to the whole lot. John Castro states no, in an R-1 Zone it is 50% mass total coverage. That is the total lot cannot exceed 50% and rear yard cannot exceed 40%. Ray Jameson makes the motion to approve the variance requested by Steve Kemp on behalf of Caroline Kopp. Fred Willis seconds the motion. Motion passed 4-0. Next case on the agenda is BA Case #1289 The request of Eliborio Vargas for a variance of twenty-five (25) feet of the required front setback of twenty five (25) feet as stated in Section 34 of the City of Plainview Zoning Ordinance to build a 24' X 20" carport a R-2 Zoning district, and being Lot S10'-6, Lot 7, Block 21, Original Town, Plainview, Texas the same being 203 Beech Street. John Castro explains the case. Mr. Vargas is asking for a variance from the front setback. He presents a video of the property and shows where he plans to put the carport and eventually, he would like to put a garage there. There were some responses. Two neighbors reply to the letters that were sent out to the property owners within two hundred feet. The responses are in favor of granting the variance to Mr. Vargas. Mary Ann Escamilla makes the motion to grant the variance requested by Mr. Vargas. Motion second by Fred Willis. Motion passed 4-0. With no further business, the meeting adjourned.
