HomeMy WebLinkAbout09.22.1997 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES September 22, 1997 Board of ~ustment membem-present: Chairperson Whit Hunt, Mary Ann Escamiila, Fred Willis, Ray Jameson, and Betty Gonzales. Staff Members present: John Castro, Director of Community Services, and Debra Washington, Secretary of Community Services. Others present: Felipe Martinez, Gary Garrison, and Gary and Shirley Jackson. The meeting was called to order by acting chairperson, Whit Hunt. The minutes were read and motion made to approve by Ray Jameson and second by Betty Gonzales. Minutes are approved as read. First item on the agenda is BA Case #1285 The request of Gary and Shirley Jackson for a variance of Ten (10) feet of the required twenty. (20) feet side setback and twenty-four feet (24) of the required twenty- five feet (25) rear setback as stated in Section 34 of the City of Piainview Zoning Ordinance to build a garage in a R-2 Zoning district, and being E-CHAT Piv Sl10'8"x165.5' Tract 1, Block 9, Plainview, Texas the same being 309 Bryan Street. John Castro presents this case. Mr.. and Mrs. Jackson are requesting a vadance to build a carport/storage building on the comer on Raleigh and Cedar. In order to .. obtain a building permit, this area has to be platted. Mr. and Mrs. Jackson already appeared before the'Planning and-Zoning Commission and they..were granted a one- time. waiver of the platting process for this endeavor. They are ~vaiting to see if the vadance for constructing this building will be approved. If it is approved, they will do a 10' dedication along Cedar. Once 10' has been dedicated, there will be a new lot line. A 20' setback is required a building that has garage doors or entry from the side. They am requesting !0' of the m quire d side setback. In the back, .it will be one foot from the fence, Them is a 25' mar setback, and they am requesting a 24' variance. of the 25' setback. Mr. Jackson states he wants the building on the east side because them is a gas line on the other side, it is more concealed on the east side. Mr. Jackson is asked if the property will be commercial. Mr. Jackson replied it will not be. Motion made by Fred Willis to accept the requested variance. Second by Betty Gonzales. Motion passed 4-0. Next item on the agenda is BA Case #1286 The request of Fetipe Martinez for a variance to expand on a non-conforming use as stated in Section 37.4 of the City of Plainview Zoning Ordinance to enlarge the building along the existing front setback ina C-3 Zoning district, and being Lot 8,. Block 20, of the College Hill Addition, Plainview, Texas the same being 1600 W. 5th Street. Mr. Martinez is requested to expand on a non-conforming use. This is a 50' lot and it is very narrow, He is proposing to square it off. He wants to add 25' to the side of. the building. Them was one response.:from the house dim ctly behind the.building. They are concerned with the noise. The city does not have a problem but in view of the concerns of the citizens, the city is recommending approving the vadance and meet other cdteria as noted in. the 'ordinance, and erect a fence along the back line of the property to'shield it from the house located directly behind it. Mr. Martinez is putting parking and that will also serve as a barrier. They will have to conform to city ordinance code such paving of the lot, landscaping, etc. Mr. Castro pm sents pictures brought by Mm. Martinez. In a letter written by.Mm. Martinez states she wants the building to be mom spacious because of incmased inventory. They have been in business for seven year. In 1994, they went from mnting to buying a building located at 806 W. 5th Street. 'The business began to grow and they moved to a new building. In 1994-1996, the business doubled. The mere handise would be better organized and that attracts more business to Plainview. Mr. Castro adds if the building is expanded and redo the perking the lOt, it will makes the corner look better. The board asks Mr. and Mm. Martinez if they will conform to the code concerning paving, landscaping, and putting up a fence. The reply is yes. She also says she wants the business to look better and aim ady had plans to pave the lot. She also agrees to erecting the fence. Betty Gonzales makes a motion to grant, the vadance requested by Mr. and Mrs. Martinez. Second by Ray Jameson. Motion passed 4-0. The vadance is granted with the exception as noted in the staff's recommendations and as a part of the main motion. With no further business, the meeting adjourned.
