BOARD OF ADJUSTMENT
MINUTES
AUGUST 25, 1997
Board of Adjustment members present: Chairperson Betty Gonzales, Mary Ann
Guerrero, Fred Willis, Ray Jameson, and Veronica Gutierrez.
Staff Members present: John Castro, Director of Community Services, and Debra
Washington, Secretary of Community Services.
Others present: Mr. Gamboa, Mr. and Mrs. Prather Thomason, Mr. and Mrs. Boggs,
Barry Vitato, Roger DelCampo, and Mike Ramirez.
The meeting was called to order by acting chairperson, Betty Gonzales.
The minutes were read and motion made to approve by Ray Jameson and second by
Fred Willis.
First item on the agenda is BA Case #1278.
The request of Rogelio DelCampo for a variance of twenty-four (24) feet of the
required twenty-five (25) feet front setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to build an (11'x 24') carport in a R-2 Zoning district, and
being Lots 6, Block 1, Unit 1 of the Thunderbird Addition, Plainview, Texas the same
being 1109 Thunderbird Drive.
Mr. DelCampo is requesting to build a carport. Four responses were noted and all
were favorable.
Mr. DelCampo comes forward and states he would like a carport built.
Mr. John Castro states the city does not have a problem with the construction of the
carport.
Mr. DelCampo is asked if he will build the carport and the reply is yes.
Fred Willis makes the motion to grant the variance to Roger DelCampo.
Ray Jameson seconds the motion.
Motion passed 5-0.
The second item is BA Case #1279
The request of Juan Jose Gamboa for a variance on sitting a manufactured home in
district not so zoned as stated in Section 8 of the City of Plainview Zoning Ordinance
to situate a manufactured home a M-2 (Manufacturing Heavy Industrial) Zoning
district, and being Lots 8, Block 1, Unit 1 of the Railroad Addition, Plainview, Texas
the same being 1202 North Date Street.
In 1990, Mr. Gamboa requested a permit for a mobile home to be situated on the lot.
On August 27, 1990, he received a one-year approval because of the security at the
premises. On July 17, 1991, he asked for a year extension and he was granted that
on August 26, 1991. August 4, 1992, he came before the bOard for another year
extension and was given a three-year extension at that time which expired on August
3, 1995. When John Castro noticed in the file it was noted it had expired and Mr.
Gamboa was contacted to see what he wanted to do. He stated that he wanted to
keep the mobile home in place and he needed to come and apply for another
extension.
One reply was received and it was favorable.
Mr. Gamboa steps forward and is asked by the board members if the mobile home will
remain in place. His reply is yes.
Fred Willis asks when the house was set there, was zoning approved to set it so close
to the other house directly behind it.
Mr. Gamboa reply was yes.
Mrs. Andres Rodriguez comes forward to speak on behalf of her husband and she
states she is in favor of Mr. Gamboa keeping his mobile home.
Does the city have any concerns with the request?
John Castro states that there is not.
Fred Willis makes the motion instead of granting a temporary variance, making a
permanent variance in this case.
Ray Jameson seconds the motion.
Motion passed 5-0.
Third item on the agenda is BA Case #1282
The request of Cecil Boggs for a variance of thirteen (13) feet of the required twenty-
five (25) feet front setback and xxxfeet of the five (5)' feet required side setback as
stated in Section 34 of the City of Plainview Zoning Ordinance to build a (20'x 24')
Carport in a R-2 Zoning district, and being Lot 18, Block 3, of the Boynton Addition,
Plainview, Texas the same being 213 SE 9th Street.
This area of town requires a 25' front setback, the lot has 32' and that is why he is
requesting 13'. On the side setback, he has 9' 6" and there is a 5' required setback
so if the variance is granted, he will only need 1.5' of the side setback. Mr. Boggs
had six of his neighbors to respond and all were favorable.
Mr. Boggs comes forward.
No questions were asked.
Mary Ann Guerrero makes the motion to approve the variance.
Second by Fred Willis.
Motion approved 5-0.
Four item is BA Case #1283
The request of Jo Prather Thomason for a variance of Twenty-one (21) feet of the
required thirty-five (35) feet front setback as stated in Section 34 of the City of
Plainview Zoning Ordinance to build an (21'x 18') Carport in a R-2 Zoning district, and
being Lot 14, Block 3, of the Northside Addition, Plainview, Texas the same being
2006 Joliet Street.
This street is unique because there are many carports on the street but all are within
the setback when they were built. This house does not have a carport and needs the
variance. The city does not have a problem with the requested variance.
Mrs. Prather Thomason comes forward.
There was one positive response.
The question was asked by a Board Member if there was enough space.
Fred Willis makes the motion to approve the variance. Mary Ann Guerrero seconds
the motion.
Motion passed 5-0.
Last item on the agenda is BA Case #1284
The request of Barry Vitato for a variance of Twenty (20) feet of the required twenty-
five (25) feet rear setback as stated in Section 34 of the City of Plainview Zoning
Ordinance to build an attached garage in a R-2 Zoning district, and being Lot 7, S 3-8,
Block 3, of the College Hill Addition, Plainview, Texas the same being 710 Kokomo
Street.
Mr. Vitato wants to add a garage onto the existing house which will become part of
the house which any time you extend onto the house closer than 10 feet to the main
house,that building has to conform to setback of the main house. He is adding on to
the house and that must conform to the 25' setback and he has 25' and he is asking a
variance of 20' of that so that he can add a third garage. There is a solid brick and
the only thing on the other side of that is an alley.
There was one response that was opposed to the request and did not give the reason
for the opposition.
Mr. Vitato is asked to come forward. A board member asks if the house will just
extend straight where it is already line and it will be within five feet of the back fence
and there are no utilities or things of that nature in the way.
Mr. Vitato replies he will let a builder do the work.
John Castro stated if there are existing utility lines it will be worked on in the planning
process.
Ray Jameson makes the motion to approve the variance.
Second by Mary Ann Guerrero.
Motion passed 5-0.
