HomeMy WebLinkAbout02.24.1997 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES FEBRUARY 24, 1997 The meeting was called to order by Chairman, Whit Hunt. Members Present: Chairman, Whit Hunt, Mary Ann Escamilla, Fred Willis, and Veronica GUtierrez, Betty Gonzalez, Ray Jameson, Fred Willis, and Bruce Hoffman. Staff Members Present: John Castro, Director of Community Development and Dolores Montelongo, Secretary of Community Development. Other Present: John Marse, Hugh Shelton, Clinton Thrasher and Joe Ibarra. Betty Gonzalez made a motion to approve the minutes of the last meeting as wdtten, seconded by Ray Jameson. Motion passed 5-0. John Castro presented BA Case #1269, the request of John 'Marse for a variance of 5 feet of the required 10 feet setback as stated in Section 14 of the City of Plainview Zoning Ordinance to place supporting pillars for a patio in a 2F zoning district. Mr. Castro presented a plat of the area to the Board. John Marse of 214 S. Ennis stepped forward and presented the site plan to the Board. Mr. Marse explained, he would like a 12 ft 3 inch patio, but after re-doing his plans with the City, he was left with only a 6ft patio. Mr. Marse said there is no problem with the front setback. He also plans to extend the roof about 5 ft. Mr. Marse said he will invest money into the area and expects it to look good. Whit Hunt said in a previous hearing Max Gabriel assured the Board everyone in the neighborhood would not ask for a variance and the homes would be at least 10 feet apart. Fred Willis asked Mr. Marse how much patio he would have without the 5 ft variance. Mr. Marse responded he would have a 6 1/2 ft patio. Whit Hunt said he is concerned about emergency access to the home in case of a tire. Mr. Hunt asked if the plans have been approved by the Homeowners Association? John Marse said the plans have been approved by the Homeowners Association. Mr. Marse said he does not want this to be detrimental to the neighborhood, and he will invest money so it is not. Mr. Marse said there are about 15 feet between the homes in that area. Fred Willis said the code was set to have access to the homes in case of a fire. Whit Hunt said it was also set to giVe the residents some space. John Castro said this lot has 10 feet because the lOt next to it has a 0 ft lot line. Mr. Castro said anything built above the ground is part of the structure. The house will still be 10 feet away except for the poles and the roof. John Marse said the measurements of the patio are 26 feet and 29 feet for the roof. Whit Hunt asked Mr. Marse if he could do without the 5 feet variance. Mr. Marse responded he could not. Ray Jameson made a motion to deny John Marse's request, seconded by Mary Ann Escamiila. Motion passed 5-0. John Castro presented BA Case #1270, the request of Clinton Thrasher on behalf of Joe Ibarra for a variance of 15 feet of the required 25 foot front setback and thirteen feet two inches of the required 25 foot rear setback as stated in Section 32 of the City of Plainview Zoning Ordinance to move a house in an R-2 zoning district. Mr. Castro presented a plat and a video of the area to the Board. Clinton Thrasher stepped forWard and discussed the site plans. He explained the house will face 14th Street. Mr. Thrasher said he originally wanted the house to face Oakland Street, however the ~house will not fit this way. The driveway will be 11 ft, 2 inches. Mr. Thrasher said this home will make the empty lot look better. Ray Jameson and Fred Willis agreed the neighborhood will look better with the home. John Castro mentioned no reply forms were returned from the neighbors. Betty Gonzalez made a motion to approve Mr. Thrasher's request, seconded by Fred Willis, Motion passed 5 - 0. John Castro presented BA Case #1271, the request of Hugh Shelton for a variance from the zoning requirements as stated in Section 3, of the City of Piainview Zoning Ordinance to situate a Mobile Home (manufactured house) in a C-3 Zoning District at 309 1/2 South Date. Mr. Castro said the house will sit on the back part of the 30 feet travel eastmount, behind two houses already there. Mr. Castro presented a plat and video of the area. He mentioned there is a difference between the mobile home made before 1976 and after 1976. Hugh Shelton stepped forWard and explained his situation to the Board. Mr. Shelton said he trains dogs, horSes, etc. Mr. Thrasher said he has spoken the neighbors and they have no problem with his request. Mr. Thrasher said he will set the home 5 ft above the ground, to protect the home from being flooded. Whit Hunt asked Mr. Shelton what kind of home he is planning to purchase, and explained the homes made before 1976 are mobile homes and the homes made after 1976 are manufactured homes. Fred Willis said the manufactured houses, are safer and the structure was improved. Hugh Shelton said he is looking into purchasing a manufactured home no older than a 1986 model. Whit Hunt said there is no problem with granting Mr, Shelton's request as lOng as he lives at the hOme. Mr. Shelton explained he works for the USDA and could be transferred from Plainview, then he will have to either sell or rent the property. John Castro said the Board can set requirements for Mr. Shelton. Fred Willis made a motion to approve Mr. Shelton's request as long as he lives in the manufactured home, seconded by Betty Gonzalez.
