HomeMy WebLinkAbout06.24.1996 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES JUNE 24, 1996 The meeting was called to order by Chairman, Whit Hunt. Board members present were: Chairman, Whit Hunt, Betty Gonzales, Veronica Gutierrez, and Joe Ed Sullivan. Ray Jameson, Staff members present were: John Castro, Director of Community Services, and Debra Harris, Secretary, Community Services. Whit Hunt asked if there were any changes to the minutes of the last meeting. With none voiced the minutes were approved. John Castro presented BA Case No. 1256, the variance request of Ricardo Rubio, with the aid of transparencies and a video of the property. The staff recommended that the carport be taken down and properly anchored. Mr. Rubio was present and John Castro served as a translator; Mr. Rubio explained that the carport was bolted to the existing concrete in the front and to the existing carport in the rear. Joe Ed Sullivan asked if the post were stabilized. Mr. Rubio said only with the bolts in the concrete. Betty Gonzales asked if there were any responses from the neighbors, Mr. Castro reported only one in favor. Joe Ed Sullivan made a motion to approve the request of Ricardo Rubio for a variance of six (6) feet of the required twenty five (25) foot front setback and one and on half (11/2) feet of the required five (5) foot side setback, in Section 32 of the City of Plainview Zoning Ordinance, and being the N 29' of lot 7 and S 21' of lot 8, Blk 1, Gardenville Addition, known as 2502 Rochelle, with the stipulation that the structure there now be taken down and anchored into the concrete. The motion was seconded by Ray Jameson, motion passed 5 - 0. BA Case No. 1257, the variance request of Gaynelle Bayley, was presented by Director of Community Services, John Castro, with the use of transparencies and a video of the property. Dan McAnally was present representing Mrs. Bayley. Mr. McAnally will be constructing the carport and explained the he will place the structure closer to the house than the original plans showed making the variance request for twelve and one half (121/2) feet rather than fifteen feet (15) of the twenty five (25) foot required front set back. There were no negative responses received by the City Office. Mr. McAnally stated that drainage off the carport would be toward the South. Joe Ed Sullivan made a motion to grant the request of Gaynelle Bayley for a variance of twelve and one half (121/2) feet of the twenty five (25) foot front set back and two and one half (21/2) feet of the five (5) foot side set back required in Section 32 of the City of Plainview Zoning Ordinance, for a carport on Lot 25, BIk 3 of the Boynton Addition known as 109 SE 9th. Betty Gonzales seconded the motion, motion passed 5 - 0. 1 of 2 Director of Community Services, John Castro, presented BA Case 1258, with the use of transparencies and a video of the property. Mr. Castro stated that there were no responses received. Mr. Hickman came forward and explained that the porch had been added on to the house and he intended to attache the carport with 2 inch pipe. He further stated that he planned to use rain gutters to direct the runoff away from his neighbors. Whit Hunt expressed concern that it would not be free standing. Mr. Hickman explained that he could leave a gap between the porch and the carport, but that would allow rain to flow between. Ray Jameson said that sounded like a good place for a rain gutter. Ray Jameson made a motion to grant the request of Bobby C. Hickman for a variance of three (3) feet of the five (5) feet required side setback, in Section 32 of the City of Plainview Zoning Ordinance for placement of a carport in a Residential-2 Zoning District and being AB 907 Pre P. Smith 50' X 140'.161 and known as 714 E. 3rd. Betty Gonzales seconded the motion, motion passed 5 - 0. With no further business to discuss, the meeting was adjourned.
