HomeMy WebLinkAbout03.25.1996 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES MARCH 25, 1996 The meeting was called to order by Chairman, Whit Hunt. Board members present were: Chairman, Whit Hunt, Ridley Gibson, Betty Gonzales, Ray Jameson and Joe Ed Sullivan. Staff members present were: John Castro, Director of Community Services and Larry Gould, Chief Building Inspector. Visitors were: Dan Wilkins and Sean Betenbough. Chief Building Inspector, Larry Gould, presented BA Case 1251, the request of Sean Betenbough on behalf of Betenbough & Co., for a variance of three and one half (31/2) feet of the required twenty five (25) foot rear set back in Section 32 in an R-2 Zone, 3904 Owens. Mr. Gould used transparencies and a video of the property. One favorable response was received from Greg Lindsey, 3909 Sides. Chairman, Whit Hunt asked for a representative of Betenbough & Co. to come forward to answer questions from the Board. Mr. Hunt asked if the houses on either side were on the same depth lot. Ridley Gibson made a motion to approve the request. The motion was seconded by Joe Ed Sullivan. Motion passed 5 - 0. Whit Hunt and Ray Jameson expressed concern about setting a precedent of granting variances, just because the builder wants to build this size house on the lot. Chairman Whit Hunt said that it opens the door for variances to be sought randomly, and he feels the Board needs to be very careful. Mr. Hunt explained that to appeal the decision of the Board you have to go to District Court, and he didn't want to have to explain in court that a variance was approved for the Betenboughs, but wouldn't for someone else. Ridley Gibson questioned the hardship, which was explained by the Betenboughs as the size of the house. Ridley Gibson made a motion to approve the request of Betenbough & Co. Motion was seconded by Joe Ed Sullivan. Motion passed 5 - 0. Chief Building Inspector, Larry Gould, presented BA Case 1253, the request of Nu Trinh for a variance of six (6) feet of the required thirty (30) feet front set back and seven (7) foot of the required eight (8) foot side setback in Section 32, for placement of a carport at 1807 W 12th. Mr. Gould stated that the front set back was added by him because this is a non-conforming situation, and if the house was sold in the future the situation would be on record. Ridley Gibson asked how far the carport would be off the side property line. Mr. Gould said one foot. Mr. Gould used transparencies and a video of the property in presenting the case. The Board expressed concern for the drainage off the carport. Ray Jameson asked why the carport is intended to be wide enough to cover 2 cars when the drive way is only wide enough for one. It was explained that the drive could be widen without a variance, because it would not be an above ground structure. Following a brief discussion Ray Jameson made a motion to approve the motion of Nu Trinh, seconded by Joe Ed Sullivan. Motion passed 5 - O. With no further business to discuss, Chairman, Whit Hunt, adjourned the meeting.
