HomeMy WebLinkAbout08.28.1995 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES AUGUST 28, 1995 The meeting was called to order by Chairman, Whit Hunt. Board members present were: Chairman, Whit Hunt, Mary Ann Guerrero, Ray Jameson, Veronica Gutierrez, and Joe Ed Sullivan. Staff members present were: Muff London, Director of Community Development. Motion was made by Ray Jameson to approve the minutes of the last meeting as written, seconded by Joe Ed Sullivan. Motion passed 5 - 0. BA CASE NO. 1244, The request of Victor Gutierrez for a variance of sixteen (16) feet of the thirty (30) feet front setback as stated in Section 32 of the City of Plainview Zoning Ordinance for a Porte' Cochere in a Residential-1 Zoning District on Lot 55 Westridge Park Addition, 400 Mesa Circle, was presented by Muff London, Director of Community Development. Ms. London used transparencies and a video of the property in presenting the case. She also read responses from Joe and Ailene Martin who objected because of the visibility at the intersection. There was also a response from Mr. & Mm. Eugene Johnson opposing the case because they felt it would be too close to the street. Mr. Jerry Wofford is the contractor on the project and was in attendance with Dr. Gutierrez to answer any questions the Board may have concerning Construction of the Porte' Cochere. Dr. Gutierrez told the Board that he is planning to make many repairs on the house at a cost of approximately $150,000.00. Dr. Gutierrez explained that there is an existing drive over which the Porte' Cochere will be constructed. Jerry Wofford explained to the Board that when the house was built the owners at that time changed their minds and decided to put concrete tile on the roof. The construction of the home was not designed for concrete tile, because it is so heavy. This is the main problem causing many of the needed repairs. Mr. Wofford explained that the Porte' Cochere would be very attractive, and could be placed on the side without a variance. He also explained that Gene Johnson had objected to the Porte' Cochere until he saw the pictures of what it would look like. He also stated that he had talked to Ms. Martin and she had changed her mind and was no longer opposed. Chairman, Whit Hunt asked Dr. Gutierrez and Jerry Wofford if there was any hardship to base the variance on. Mr. Wofford explained that the only hardship is the shape of the lot. They're are not wanting to go all the way to the property line. He also stated that the main objective was to improve the looks of the house. Mr. Wofford stated that he requested the maximum, and he could work with a 12 foot variance. Mr. Wofford stated that the hardship was caused by the shape of the lot. Ray Jameson made a motion to approve the request of Victor Gutierrez for a variance of twelve (12) feet of the thirty (30) feet front setback as stated in Section 1 of 2 32 of the City of Plainview Zoning Ordinance for a Porte' Cochere in an R-1 Zoning District due to a hardship which was created not by the homeowner, but the shape of the lot. The motion was seconded by Joe Ed Sullivan. Motion passed 5 - 0. BA CASE NO 1245 The request of Eisa Carrera for a variance of six (6) feet side setback as stated in Section 32 of the City of Plainview Zoning Ordinance for a carport in a Residential-1 Zoning District on Lot 10 and the west 10 feet of Lot 11, BIk 1, Riverside Addition, 1010 W 9th St. was presented by Muff London, Director of Community Development. The Case was presented with the use of transparencies and Ms. London reported that the carport has been completed. Ms. Carrera was present to answer questions from the Board. Ms. Carrera stated that the neighbors next to the carport did not have a problem with the location of the carport. Whit Hunt ask what the hardship is which prevents this carport from being moved to met the setbacks. Ms. Carrera explained that if it were any closer to the house the structure would block the back door. Joe Ed Sullivan asked if Ms. Carrera had been contacted by anyone from the City while the carport was being constructed. Ms. Carrera stated that Mr. Lindstrom from the Building Department had spoken with her and ask if she was aware that a Building Permit was required. She also stated that her father was from Olton and had built a carport there without a permit and she was not aware that the City of Plainview required one. Ms. Carrera told the Board that all that was left to complete the carport when Mr. Lindstrom spoke with her was the top and she asked if it could be finished. Mr. Lindstrom told her it could be finished but she would have to get a permit and go before the Board of Adjustment for a variance. Whit Hunt asked if the carport could be moved closer to the house. Ms. Carrera said that the pole would be in the way of the back door and there is no concrete there. Ms. London said the home was in a Residential - 2 Zoning District, not a Residential - 1. A five (5) foot setback would satisfy the side setback in that district. Ray Jameson made a motion that the carport be moved to five (5) feet from the side property line in accordance with the setback regulations. Joe Ed Sullivan seconded the motion. Motion passed 5 - 0. Ms. Carrera asked how long she had to move the carport. Ms. London stated she needed to do it in a timely fashion and she could discuss the timeline with one of the Building Officials.
