BOARD OF ADJUSTMENT
MINUTES
JULY 24, 1995
The meeting was called to order by Vice-Chairperson, Betty Gonzales.
Board Members present were: Betty Gonzales, Lillie Terrell, Ridley Gibson, Ray Jameson,
and Veronica Gutierrez.
Staff members present were: Muff London, Director of Community Development.
Ray Jameson made a motion to approve the minutes of the last meeting as written. The
motion was seconded by Ridley Gibson. Motion passed 5 - 0.
BA Case 1242, the request of C.C. Blankenship, Jr. for the following variances to
construct a garage:
Fifteen (15) feet of the twenty (20) feet side setback as stated in Section
34:4;
Seven (7) feet of the twenty-five (25) feet rear setback as stated in Section
34:5;
In a Residential-1 Zoning District on Lot 12, Block 1 of the Day Addition, (1501 Dallas).
The Case was presented by Director of Community Development, Muff London. Ms.
London used transparencies and a video of the property in presenting the case. There
were two responses in favor of the request, from Oliver Massa, 1318 Dallas, and Ruth
H Oswald, 1402 Ennis Street. Chairperson asked Mr. Blankenship to come to the
microphone to answer questions the Board may have. Ridley Gibson pointed out that the
request stated that the purpose was for storage and asked Mr. Blankenship if he intended
to use it solely for that purpose. Mr. Blankenship explained that with the aging of his
parents and the necessity of their moving into a nursing home, he has obtained many
objects from their home. He told the Board that the Playhouse in the back is full of
furniture as well as the garage. He stated that he planned to use half the proposed
garage as storage and the other half to work on the furniture. Ridley Gibson asked if he
had a shop on the property. Mr. Blankenship explained that he was planning to do
refinishing which involved no large tools or equipment. Ms. London was asked to place
the transparency showing the layout of the property and the proposed garage back on
the overhead. Using this as a guide Mr. Blankenship was asked to explain the exact
location of the proposed garage. Mr. Blankenship explained that it would be 18' from the
property line to the outside wall of the proposed garage. Ray Jameson asked how long
they had lived at 1501 Dallas. Mr. Blankenship responded, since May of 1961. Ridley
Gibson asked why the Blankenships did not want to rent a storage building. Mr.

Blankenship stated that it was handier to have the furniture at home so he could work on
it regularly. It would be more convenient to have it stored at home rather than having to
go get it out of a storage unit when he wanted to work on something. Veronica Gutierrez
asked if other houses in the area have as much construction and if the Blankenship's
yard will be wall-to-wall buildings. Mr. Blankenship stated that most of the back yard is
covered. Ms. Blankenship stated that the house next door has a garage in the alley and
a house several houses down has built on. Ridley Gibson expressed concern over the
density on the lot, and that by law the Board has to determine a hardship to grant a
variance. He explained that in keeping with the esthetics of the neighborhood and the
lack of a hardship he did not feel the variance should be granted. Mr. Gibson stated that
he felt sure that any addition would look nice, but he has a difficult time finding a hardship
to base the variance on. Mr. Gibson also stated that he was faced with the same
hardship recently when he had to rent a storage unit to store some of his own things.
Mrs. Nell Blankenship came to the microphone and stated that some of the things the
storage was needed for were antiques and if stolen could not be replace. She stated that
storage buildings do get broken into, and that their granddaughter would like to have
some of these things at some time. Ms. Blankenship told the Board that the things would
be more secure on their property because they are home most of the time. Ridley
Gibson stated that he understood. Mr. Gibson made a motion that due to a lack of
hardship which would meet the requirements of the state for granting a variance, that the
request be denied. The motion was seconded by Ray Jameson. The motion passed 5 -
0.
BA Case No. 1243, the request of Jack Sanders for a variance of twenty-five (25) feet
of the twenty-five-(25) feet of the front setback for a carport as stated in Section 34:3 in
a Residential-2 Zoning District on Lot 12, Block 18 of the Thunderbird Unity #4, 1303
Navajo Trail. The case was presented by Muff London, Director of Community
Development, with the use of transparencies and a video of the property. Mr. Sanders
was present and Betty Gonzales asked him to come to the microphone and give his
name and address. Betty Gonzales asked how far from his property the next carport is.
Mr. Sanders said there was one four or five houses to the west on the north side of the
street. Ridley Gibson asked if that carport came all the way out to the sidewalk. Mr.
Sanders said he didn't think so. Ms. London said that it was set back from the property
line. Ridley Gibson asked what was in the back yard. Mr. Sanders said there was a shop
and a wide gate in the fence for entrance to the back. He also explained that Jay Leoffler
owned the house previously and he had built the shop and cellar. Mr. Sanders stated
that he just needed a one car carport to park his pick-up under. Lillie Terrell asked if
placing the carport only 6 inches from the sidewalk would not be dangerous. At this time
Chairperson asked the contractor to approach the microphone and state his name.
Lonnie Slaughter explained that the 6" was actually the roof overhang of the carport. He
also explained that there will be a water shed to shed water away from the vehicle when
going from the carport to the house. Ridley Gibson asked Mr. Sanders if there was room
in the back for a carport. Mr. Sanders explained that they had purchased the house
about 2¥~ years ago, and planted apples in the back. He also stated that there are

electrical wires going from the neighbors house to the pole are very Iow and they angle
across the yard at 1303 Navajo Trail. Ms. London asked if a vehicle could be parked in
the shop. Mr. Sanders explained that the shop is built over the cellar and would not allow
for parking a vehicle over it. Ray Jameson made a motion to deny the request of Jack
Sanders, due to the lack of an apparent hardship. Veronica Gutierrez seconded the
motion. Motion passed 5 - 0.
Ridley Gibson made a motion to adjourn the meeting, seconded by Ray Jameson.
Motion passed 5 - 0. Meeting was adjourned
