BOARD OF ADJUSTMENT
MINUTES
JUNE 26, 1995
The meeting was called to order by Chairman Whit Hunt.
Ridley Gibson made a motion to approve the minutes of the last meeting. The motion
was seconded by Joe Ed Sullivan. Motion passed 5 - 0.
Board members present were: Chairman, Whit Hunt, Ridley Gibson, Ray Jameson,
Veronica Gutierrez, and Joe Ed Sullivan.
Staff members present were: Muff London, Director of Community Development.
Muff London, Director of Community Development presented BA Case 1239, the request
of Aubrey Myers for a Special Exception to Section 37 for a hook-up of an 8 by 27 foot
trailer as temporary living quarters in a Residential-2 Zoning District on Lot 53 of Town
West Unit 2 Addition, commonly known as 3905 Ridgeway. Ms. London used
transparencies and a video of the property in presenting the case. Mrs. Nelda Myers
explained to the Board that the trailer is for her elderly father to live in. Joe Ed Sullivan
made a motion that the special exception be approved with the condition that Mrs. Myers
notify the City of any changes in the situation. Ridley Gibson seconded the motion.
Motion passed 5 - 0.
BA Case 1240, the request of Floyd Bannister for avariance to Section 34 of thirteen and
one-half (131/2) feet of the twenty (20) feet required setback for a garage in a Residential-
1 Zoning District on Lot 9 and the south 2 feet of Lot 10, Block 2, of the Brannon
Addition, commonly know as 1000 Amarillo, was presented by Muff London, Director of
Community Development. Ms. London used transparencies and a video of the property
in her presentation. There was discussion on the location of the fence in relation to the
property line. Ms. London stated that the fence was possibly in the City Right-of- Way.
Mr. Bannister stated the fence was 13 feet from the curb. Mr. Bannister explained that
the building would be used as a garage and storage. The plans show the proposed
garage to be lined up with the existing house. Ridley Gibson made a motion to approve
the variance because of the location of the gas line and the cellar. The motion was
seconded by Joe Ed Sullivan. Motion passed 5 - 0.
Muff London, Director of Community Development, presented BACase 1241, the request
of Mack Schmalzried for a variance to Section 32 for Thirty (30) feet of the thirty (30) feet
front setback for a carport in a Residential-1 Zoning District on the West half of Lots 9 &
10, Block 1 of the Harris Malone Addition (1000 Travis). Ms. London presented
transparencies and a video of the property. Mr. Schmalzried was present and explained
that he could not put both new vehicles in his garage and was requesting the variance

to protect his property. Ray Jameson made a motion to deny Mr. Schmalzreid's request,
seconded by Joe Ed Sullivan. The motion failed 3 to I with Whit Hunt abstaining.
During discussion it was pointed out that there are similar structures in the area and that
the property is a non-conforming lot. Ridley Gibson made a motion to approve the
request of Mack Schmalzried, based on 1) there are other carports in the area, 2) for
protection of Mr. Schmalzried vehicles, and 3) the lot is non-conforming and there is very
little yard area. The motion was seconded by Joe Ed Sullivan. Motion passed 4 to 1 with
Whit Hunt voting against the request.
With no further business to discuss, the meeting was adjourned.
