HomeMy WebLinkAbout11.28.1994 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES NOVEMBER 28, 1994 The meeting was called to order by Chairman, Randy Ballinger. Board members present were: Chairman, Randy Ballinger, Mary Ann Guerrero, Whit Hunt, and Betty Gonzales. Nathan Boles, and Ron Trussler arrived a few minutes late. Staff members present were: Muff London, Director of Community Development. Whit Hunt made a motion a approve the minutes of the last meeting as written, seconded by Nathan Boles. Motion passed 4 - 0. Chairman Randy Ballinger informed the Board that he has moved outside the City limits and is resigning his position on the Board of Adjustment. Mr. Ballinger stated that over the last 6 years he has seen a lot of changes in the Board of Adjustment and thinks the direction the Board is working toward in for the betterment of Plainview. Mr. Ballinger also recommended that the Board choose Whit Hunt, to serve as Chairman. BA CASE 1233: The request of Heriberto Hinojosa for a variance of three (3) feet of the five (5) feet side setback required in Section 32, to build a fireplace on the residence located in a Residential - I Zoning District, on Lot 9 Bik 5 of the Country Club Addition, (301 Ailene St.) was presented by Muff London, Director of Community Development. Ms. London used transparencies and a video of the property to explain location of the fireplace. Ms. London stated that she had visited with the neighbor on the side which the fireplace would be going in. She has no objection at all. Paul Holdridge of 310 Juanita, and Elizabeth Atkins of 304 Ailene responded in favor of the request. Mr. Ballinger asked Ms. London to let them review the video again, and study the distance from the roof line of the neighboring house to the proposed chimney. Mr. Hinojosa explained that construction was stopped when he discovered that he would need a permit from the City. At this point there is a hole in the house and the chimney is not complete. Mr. Ballinger asked if the chimney would be taller than the neighboring house. Ms. London explained that it would. Ms. London explained that the original drawings were a little misleading and that the request should have read two (2) feet of the required five (5) feet set back rather than three (3). Whit Hunt asked= Mr. Hinojosa what his hardship was requiring this variance. Mr. Hinojosa explained that the room was originally the garage and has been converted into the living room. He said it was very cold in there and he had purchased an electric heater, which cost from $60 to $70 a month to run. That's when they decided to build a fireplace for heat in the room. Betty Gonzales made a motion to approved the request of Mr. Hinojosa for a variance of two (2) feet of the required five (5) feet side I of 3 setback to build a fireplace. Whit Hunt seconded the motion, motion passed 6 - 0. BA CASE 1234: The request of Bob Fenley for a variance of eighteen and one-quarter (181,4) feet of the twenty-five foot setback required in Section 32, to build a single family residence in a Residential - 2 Zoning District, on Lot 33 Bik 6 of the Thunderbird Addition, (3303 Joliet) was presented by Muff London, Director of Community Development. Ms. London used transparencies to point out that the lots were platted to face 31 st street instead of Joliet. There is one home facing Joliet, and the people contracting to have the home built would like for their home to face Joliet too. With the Video, Ms. London showed the location of the existing home and that the plans for the new home cannot meet the rear setback. Mr. Ballinger asked Mr. Fenley to come forward to answer any questions the board may have. Mr. Ballinger asked Mr. Fenley why the people purchasing the house want it to face Joliet. Mr. Fenely stated that he thought they only wanted the two house there to face the same direction. He also explained that the house was being built for a family of 6 and would be a fairly large house which would not fit on the lot normally, unless turned to face Joliet. Mr. Ballinger explained that the variance can only be granted due to a hardship and asked what the buyers hardship would be. Mr. Fenley stated that the house would not fit on the lot facing 31st. Street. Ms. London stated that she would have thought they would not want to face Joliet because of the traffic, but the City has no problem with it facing that way. Whit Hunt stated that he did not see a hardship, with Nathan Boles stating that he would prefer the house face the other way. Following more discussion of the situation, Mr. Fenley requested that the request be tabled by the Board. Ron Trussler made a motion to table BA Case 1234, seconded by Betty Gonzales. Motion passed 7-0. BA CASE 1235: The request of Ruth Reed for a variance to place a mobile home in a Commercial - 3 Zoning District, on Lots 1 - 3 BIk 5 of the Eoff Green Addition, (1500 S. Columbia) was presented by Muff London, Director of Community Development. Ms. London used transparencies and a video to present the case. in the video Ms. London pointed out that there is a fence around the total property. She pointed out that the residence is non-conforming because it is surrounded by businesses such as Bell Dairy, McDonaids Trading Post and The Care Inn. Randy Ballinger asked Suanna Bagwell to come forward to answer questions from the Board. Ms. Bagwell stated that the mobile home is a 14' X 80', 1984 model which she inherited. Ms. Bagwell explained that her mother, Ruth Reed is losing her eyesight, and has to be left alone sometimes for a week at a time while Ms. Bagweli travels to Iraan, Texas to take care of her aunt. Ms. Bagwells daughter is trying to move home from California, and the request if for her to be able to live in the mobile home to assist Ms. Bagwell in caring for Ms. Reed. Ron Trussler made a motion that the request be granted. Nathan Boles seconded. Randy Ballinger asked if there were utilities for the lots. Ms. Bagwell stated that there were mobile homes on those lots in the past. Home will be tied down and skirted properly. Muff London stated that the Board did not have to limit to a yearly variance. The motion was amended to stipulate that the variance be granted for only as long as the mobile home iS lived in by Chris and Suzette Gagne'.
