HomeMy WebLinkAbout10.24.1994 BA MinutesCITY OF PLAINVIEW BOARD OF ADJUSTMENT MINUTES OCTOBER 24, 1994 The meeting was called to order by Chairman, Randy Ballinger. Board members present were: Chairman Randy Ballinger, Betty Gonzales, Mary Ann Guerrero, Ron Trussler, Whit Hunt, and Nathan Boles. Staff members present were: Muff London, Director of Community Development. Whit Hunt made a motion to approve the minutes of the last meeting as wdtten, seconded by Betty Gonzales. Motion passed 5 - 0. BA Case 1230, the request of Robert C. Landry for a variance of seventeen (17) feet of the thirty (30) feet required front setback for a carport on Lot 10, BIk 7 of the Brock Unit 2 Addition in a Residential - 1 Zoning District, (1401 Floydada) was presented by Muff London, Director of Community Development. Ms. London used transparencies and a video tape of the property to demonstrate the location and description of the proposed carport. Ms. London explained that Mr. Landry has prepared 4 choices, which are shown on transparencies. Randy Ballinger asked the difference between plan I and plan 2. Ms. London explained that one is a single carport the other is double. Ms. London reported that her office has received one response, which was in favor of the variance, sent by J.C. Armstrong of 1405 Floydada. Ms. London stated that there are other carports in the neighborhood and the one across the street is in front of the home and appears to meet the setback requirements. There is a carport South of Mr. Landry's home at 1301 Floydada, which was granted a variance to build the carport in 1979. Mr. Landry came forward and addressed the Board. Mr. Ballinger asked Mr. Landry to explain the hardship which would require him to ask for this variance. Mr. Landry stated that he had purchased a new car and had no way to keep the hail storms off it. There is no physical hardship. Mr. Ballinger ask if Mr. Landry's neighbor had any objection to the concrete or the carport. Mr. Landry stated that Mr. Stanton and he had discussed the carport and Mr. Stanton had no objection. Perry Stanton, 1403 Floydada, next door to the property in question spoke and stated that he felt Mr. Landry would build a nice carport and he feels like the carport is needed. Mr. Landry has hired a contractor to construct a metal carport with 4 in. metal post and 26 gauge metal sheet iron. Whit Hunt stated that he did not feel this was needed to alleviate a hardship, but for convenience. Whit Hunt made a motion to deny the request due to the lack of a hardship, Ron Trussler seconded. The motion passed 6-0. BA CASE 1231: The request of Doyn Merriman for a variance of two and one-half (2~) feet of the twenty (20) feet required rear setback for a garage on Lot 4, BIk 12 of the Brock Addition Unit #2 in a Residential - I Zoning District, 1503 Garland. Muff London I of 3 presented the request with the use of video and transparencies. Ms. London explained that Mr. Merriman is requesting a variance to build a garage in the rear with the entrance from the alley. One phone call was made to a council person, in favor of the request, the name was not on the list, also received a response from lialph Lemon of 1609 Garland, who was in favor. Helen McLaurin of 1507' Garland, stated that she was in favor of the 2 car garage. Mr. Doyn Merriman addressed the Board, and stated that the garage was needed for storage and protection for cars. liandy Ballinger asked Mr. Merriman to explain the construction materials planned. Mr. Merriman explained that the building would have a metal reof and metal siding and he plans to do the work himself. Mr. Ballinger asked if there would be enough clearance frem any utility lines in the alley. Mr. Merriman stated that there should be no problem. Whit Hunt asked if the roof line would be any taller that the roof line on the house. Mr. Merriman said no, it will be the same and tie into the house. Whit Hunt asked if there was any way Mr. Merriman could build the garage within the setback to avoid the variance. Mr. Merriman said he could but when you try to store things in front of your automobiles you need reom to walk and if you keep cutting it down you don't have that reom. Ken Halblieb, 1410 Holiday, explained that the roof line would follow frem the house, and the patio is totally covered. Ms. London stated that Mrs. Merriman has just recently had a hip replacement surgery and does need the extra reom to make it easier for her to get in and out of the garage and cars. Whit Hunt made a motion to appre ye the request because of Mrs. Merriman's hardship, lion Trussler seconded. The motion passed 6 - 0. Ken Halblieb, spoke to the Board and stated that Garland is a narrow street and he would like to see extensions built on the rear of the houses instead of the front. He stated that he appreciates the job the Board does for the City. Narrower streets need to be using the back yard area to save water and landfill space. Whit Hunt suggest that Mr. Halbleib speak to the Council and make his recommendations to them, so they can change the ordinance. BA CASE 1232: The request of Dale Ballew for a variance of twenty-eight (28) feet of the thirty-five (35) feet required front setback for a carport on Lot 7, BIk 3 of the Harris Malone Addition in a Residential I Zoning District, 2012 W l 1 th. Muff London presented the case with the use of transparencies and a video of the property. Ms. London reported that Mr. Ballews home is in the middle of the Block on 11th St., which is a high traffic area. In response to the request, J.B. Ballew, of 2010 W 11th, mailed his response and stated that them were a number of carports on the street including his own and has no objection. John Kirchhoff of Temple, Texas responded in favor, also Frank Buchannan, 2019 W 21st St. stated his daughter lives at 2008 W. 11th St. in a house owned by him. The house east of there has a carport, and another one should not make any difference in property evaluation. 1008 Travis, Lowel Overgaurd, responded in favor. After reviewing the video, Whit Hunt asked if there was a carport in the area which goes out into the easement. Ms. London stated that all the carports in the area violate the setbacks. 11th street is a major thoroughfare, and the set backs are 5 feet further making them 35 feet. Clinton Thrasher, contractor, told the Board that them is a carport 2of3 just west of there, which he plans to build this the same distance from the street. Randy Ballinger asked Mr. Ballew what the hardship was causing him to make this request. Mr. Ballew stated that there is no reom for it in the back or on the other side of the house. His wife works at Wal-Mart Distribution and goes to work at 4:00 in the morning, and the carport would help with ice build up on the car. This is a permanent schedule for Mm. Ballew. Ron Trussler asked how long the carport would be. Mr. Ballew stated 24 X 12. Through discussion, it was determined that the house itself and other houses in the area are non-conforming.
