HomeMy WebLinkAbout08.29.1994 BA MinutesBOARD OF ADJUSTMENT MINUTES AUGUST 29, 1994 AT 7:30 P.M. The Board of Adjustment met on Monday, August the 29th at 7:30 p.m. Board members present were: Randy Ballinger, Chairman, Ron Trussler, Nathan Boles, Whit Hunt, Eddie Sessions, Betty Gonzales and Mary Ann Escamilla. Staff members present were: Muff London, Director of Community Development. Chairman, Randy Ballinger, made a statement that the Board of Adjustment had met with the Mayor and the City Council at Work Session on August 18, 1994 to discuss the Boards activities. There were good comments made during the work session. Mr. Ballinger extended invitations to the Mayor and Council to attend their meetings so that they could better understand what type of decisions the Board was having to make. He said that he hoped in the future some of them would attend. Muff London stood up and stated that the reason that there was not anyone in attendance this Monday was because we had changed the meeting to the 5th Monday this month and that they had a standing meeting on the 5th Monday of every month. At that time, Ron Trussler made a motion to approve the minutes of the last meeting as written, and Nathan Boles seconded. Motion passed 5 - 0. CASE NO. 1227: The request of Charles Hawkins for the following variances for a carport; Twenty-seven and three forth feet (27 3/4) of a Thirty (30) foot front setback as stated in Section 32, four (4) feet of the eight (8) feet side setback as stated in Section 32, on Lot 8 BIk 55 of the College Hill Addition in a Residential-1 Zoning District, commonly known as 2204 W. 4th. Mrs. London gave a presentation with an overhead and also showed a video of the property. There were also two responses from the neighbors in favor of allowing Mr. Hawkins his carport, one from Monty Mcllroy at 318 Vernon, and one from Bahl Clauser, 320 Vernon St. both neighbors were in favor of the variance. Mr. Ballinger asked Mr. Hawkins what his hardship was. Mr. Hawkins said that at times he had to use a wheelchair to get around and that his pickup was out in the open and that it would be better if it was under a carport and not in the weather when he was getting in and out of his pickup with his wheelchair. Mm. London asked if the carport needed to be about that length. He said yes that it needed to be. With that length it lacked about (5) inches covering the length of his pickup. Mr. Ron Trussler asked Mr. Hawkins what the carport would be constructed of. Mr. Hawkins said that it would be an all steel carport. Whit Hunt made a motion to approve the carport and Eddie Sessions second it. The variances were granted 5 - 0. 1 of 2 CASE NO. 1228; The request of Richard Ligon on behalf of McDonald's for a variance of Twenty-three (23) feet of the Thirty-five (35) foot front setback as stated in Section 32 for an addition on Lot 2.^ of Duncan Unit 3 in a Commercial-3 Zoning District, or commonly known as 815 N. 1-27. Mm. London presented an overhead and video to show that McDonald's wanted to enclose their playground area. She stated it would probably be safer for people to actually be inside a building than it to be in an open area. As far as visibility, there was really not going to be much of a change because the playground did not allow for there to be any visibility and there was not a problem with the care driving and pulling out as far as being able to see if this playground was being taken in as a building.
