BOARD OF ADJUSTMENT
MINUTES
APRIL 25, 1994
The regular meeting of the City of Plainview, Board of Adjustment was called to order by
Chairman, Lee Roy Lightfoot.
Board members present were: Chairman, Lee Roy Lightfoot, Randy Ballinger, Betty
Gonzales, Mary Ann Escamila, Paul Lyle, Alternate Ron Trusler, and Alternate Whit Hunt.
Staff members present were: Wally Hatch, City Attorney, and Debra Harris, Secretary
to the Board of Adjustment.
Guest present were: City Council member, Dwain Dodson, Linda Tiffin, Floyd Tiffin,
Clinton Thrasher, Sylvia Chavez, Mollie Hardier and Virginia Jenkins and her
representative.
B A CASE 1214: The request of Rodney Luera for a variance of five (5) feet of the
required eight (8) feet side setback as stated in Section 32:1 for an addition to a home
located in a Residential -1 Zoning District on the south half of Lot 3 and north half of Lot
4, Block 1 of the Harris Malone Addition (1009 N. Smyth) was presented by City Attorney,
Wally Hatch with the use of transparencies and a video of the area. Responses in favor
included Mr. L.D. Overgaard, and Mr. Wilborn A. Landrum. No negative responses were
received. Mr. Hatch explained that the concrete slab which covers the cellar extends past
the side setbacks, and that the location of the addition over the slab would enhance the
appearance of the house. Board member Paul Lyle asked if the cellar and slab had been
built recently. Mr. Hatch explained that it would be impossible for the City's Code
Enforcement staff to police all back yard construction. Paul Lyle stated that the over
hang of a structure would encroach even farther into the side setback. Randy Ballinger
asked how high the slab was. Mr. Hatch stated that the slab was constructed to support
a structure. Lee Roy Lightfoot asked when the slab and cellar were built. Mm. Luera
said in February, 1994. She also explained that the structure over the slab was to be
used as a utility room. Mr. Hatch stated that the location was the most appropriate
because of the location of the back door, and construction in another area would have
required extensive re-modeling of the house itself. Paul Lyle ask Mr. Hatch if the board
should table a decision or vote on a motion with conditions. Mr. Hatch stated that in
order to have a timely decision it would be better to vote at this time. Paul Lyle made a
motion that the variance be granted on the condition that the plans show that the
structure will be built allowing all water run-off to fall on the Luera's property and not on
their neighbors. Betty Gonzales seconded, motion passed 5 - 0.
B A CASE 1215: The request of Virginia Jenkins for a variance of twenty-seven (27) feet
of the thirty (30) feet required front setback as stated in Section 34.3 for a carport located
in a Residential - 1 Zoning District on Lot 14, Block 64 of the College Hill Addition, (612
Wayland) was presented by City Attorney, Wally Hatch with transparencies and a video
of the area. Responses in favor of the vadance were received from J. A. Burleson,
Bonnie Claycomb, Truitt D. Fletcher, and R. D. Scott. Mr. Hatch explained that Mrs
Jenkins' 93~year old mother lives with her and uses a walker. The wind break and
carport would make it much easier for her mother to get to and from the car. The video
of the area showed several carports in the area. Paul Lyle asked if the carport would
come out toward Wayland and if it would cross the sidewalk? Mrs. Jenkins explained that
it would face Wayland and would not cross the sidewalk. Randy Ballinger made a motion
that the variance be granted as requested, seconded by Lee Roy LightfOot. Motion
passed 5 - 0.
B A CASE 1211: The request of Floyd D. Tiffin for the following variances for the
construction of a carport:
Six (6) feet of the required eight (8) feet side setback as stated in Section
34.4;
Thirty (30) feet of the required thirty-five (35) feet front setback as stated in
Section 34.3;
Six (6) feet over the maximum twenty-four (24) feet largest dimension
allowed as stated in Section 3:31;
In a Residential 1 Zoning District and being the north 60 feet of Lot 1, Block 2 of the Day
Addition (3001 W. 16th Street) was presented by City Attorney, Wally Hatch with the use
of a video of the area and transparencies. Mr. Hatch explained that this case was to be
heard originally on March 28, 1994, but the meeting had to be canceled because of a lack
of quorum of the Board. A special meeting was called at that time for April 4, 1994,
however Mr. & Mrs. Tiffin were not present. Mr. Hatch stated that he had offered the
parties of Case 1212 the opportunity to be re-heard, but that party decided to accept the
stipulations set forth by the Board. Mr. Hatch stated that the City staff had no
recommendation for or against the granting of these variances. He did point out that the
house appears that it should have been constructed facing Canyon Street. Because the
house is sitting sideways on the lot, all the setbacks are off. Mr. Hatch stated that there
had been no opposition received concerning the variances, and that there are several
structures in the neighborhood which appear to be built on or very near the property lines.
Mr. Hatch stated that if the carport were lined up with the farthest extension of the house
there would still be 16 feet of space. Mr. Hatch stated that the carport could be placed
in an area that would require no variance, but would require that 2 very large trees be
pulled out. Paul Lyle asked Mr. Thrasher, the contractor who will build the carport for the
Tiffin's, how tall the structure would be. He stated that it would be 12 feet at the sides
with and an additional 18 inches for pitch, making the total height 13 and 1/2 feet. Mr.
Hatch explained that the structure has to be at least 30 feet long to cover the R.V. the
Tiffin's are purchasing. Paul Lyle made a motion that the variance be granted with the
condition that the front of the carport align with the front of the house. Randy Ballinger
seconded. Motion passed 5 - 0.
City Councilman, Dwain Dodson, expressed his appreciation and gratitude to the board
for volunteering their time to serve the citizens of Plainview.
A motion was made by Betty Gonzales to approve the minutes of the last meeting as
written, seconded by Randy Ballinger. Motion passed 5 - 0.
With no further business, Chairman Lee Roy Lightfoot adjourned the meeting.
