CITY OF PLAINVIEW
MINUTES
APRIL 4, 1994
The City of Plainview Board of Adjustment held a special meeting on April 4,1994 to
consider cases on which no action was taken during the regular March meeting because
of a lack of quorum.
Board members present were: Chairman, Lee Roy Lightfoot, Randy Ballinger, Betty
Gonzales, Mary Ann Escamila, Paul Lyle, and Whit Hunt.
Staff present were: Muff London, Director of Community Development.
Meeting was called to order by Chairman, Lee Roy Lightfoot. Paul Lyle made a motion
to approve the minutes of the February 24, 1994 meeting as written. Motion seconded
by Betty Gonzales. Motion passed 5 - 0.
BA Case 1211, the request of Floyd D. Tiffin for the following variances for the
construction of a carport:
1. Six (6) feet of the

2. Thirty (30) feet of

the carport with a 10 foot front setback instead of the five
foot front setback as requested. Paul Lyle asked if the carport would be attached to the
house. London said no it would not. Mr. Lyle asked if there were similar structures in
the neighborhood and if there were any responses from the neighbors. Ms. London
stated there were not anymore carports nearby and that the city did not receive any
responses. London stated she had been concerned about the height of the carport and
Mr. Tiffin, the builder, had stated the carport would be 12 feet at its tallest dimension.
The commission viewed the video of the property at this time. Whit Hunt asked if he
could make a motion or was he sitting as an alternate. Ms. London stated he could
participate in the discussion, but the motion and votes would need to be by the regular
five board members.
Lightfoot said he understood that if you have an RV, you do not want to store it
somewhere and nol have it accessible, but if you allow it to be parked in the back yard,
you cannot predict what people are going to do in the future.
Lyle stated that after looking at the packet and the video, he felt the board was breaking
new ground. He said he didn't know why there had not been any complaints and that he
would complain if it was his neighborhood. He stated without a true hardship and with
the carport detached from the house, he felt the request was a luxury. Mr. Lightfoot
stated we do have storage around town for RV's.
Mary Ann Escamillia made the motion to decline Case 1211 and Betty Gonzales
seconded the motion. The board voted 5 - 0 to deny Case 1211.
BA Case 1212, the request of Richard Green for the following variances for duplex
construction:
1. Seven (7) feet of the required fifteen (15) feet side setback as stated in
Section 32.1;
2. Two (2) feet of the required fifteen (15) feet side setback as stated in
Section 32.1;
3. One (1) foot of the required fifteen (15) feet side setback as stated in
Section 32.1;
was presented by Muff London, Director of Community Development with a video of the
property and transparencies. Staff recommended the variance for the duplex
construction. London pointed out during the video that the north side of the property was
adjacent to a driveway that gave extra footage between the developments.
Construction of the duplex was done with the use of minimum square footage, but still
cannot meet the side setbacks. There is no problem with the front and back setbacks.
Paul Lyle made the motion to grant the variance as presented. Betty Gonzales seconded
the motion. The motion passed 5- 0.
BA Case 1213, the request of Rodolfo Blanco for the following variances for a garage;
1. Six (6) feet of the required eight (8) feet side setback as stated in Section
32.1;
2. Eighteen (18) feet of the required twenty (20) feet rear setback for entry to
a garage from an alley as stated in Section 34.5;
was presented by Muff London with the use of a video of the property and
transparencies. Staff recommended the garage be allowed with the side setback of 8 feet
being met and the length of the garage be 24 feet long. By setting the garage back 8
feet instead of the two feet, the garage will be in alignment with the house.
Mr. Blanco applied for the variance because the garage had been taken into the house
prior to his purchasing the house. This caused him and his family a great deal of difficulty
finding room for parking their cars. He further stated that the layout of his house
prevented him from adding an attached garage, because of existing porches and
windows.
Paul Lyle moved to grant the variance with aligning the garage with the house at an eight
(8) foot side setback and allowing the rear setback of two (2) feet and allowing twenty-
four (24) feet in length. Mary Ann Escamilla seconded the motion. Motion passed 5 -
0.
With no further business to discuss the meeting was adjourned.
