FIRE/EMS PAY
ORDINANCE NO. 97-3121
AN ORDINANCE OF THE CITY OF PLAINVIEW AMENDING ORDINANCE
NO. 96-3090 TO APPROPRIATE FUNDS WITHIN THE GENERAL FUND FOR
DEPARTMENT 8 (FIRE) AND DEPARTMENT 9 (EMS) FOR THE
BUDGETED FISCAL YEAR OF 1996-1997; CUMULATIVENESS CLAUSE;
CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE.
WHEREAS, on the 10th day of September, 1996, through the adoption of Ordinance
No. 96-3090 the City Council of the City of Plainview approved the 1996-1997 budget; and
WHEREAS, the budget is a general guideline for revenue and expenditures and may
require periodic amendments; and
WHEREAS, the City Council has determined that as of May 27, 1997, the salary for
an entry level certified fire fighter should be adjusted to twenty thousand six hundred
seventeen and no/100 dollars ($20,617), as reflected in Exhibit A attached hereto and made
part hereof; and
WHEREAS, the City Council has determined that as of May 27, 1997, all other
classifications should be adjusted, as reflected in Exhibit A attached hereto and made part
hereof; and
WHEREAS, the City Council has determined that there should be no additional
salary adjustments, excluding certification, longevity, promotion, and disciplinary adjustments
and that after October 1, 1997, all certified fire/EMS personnel should receive salary
adjustments in accordance with current City Policy; and
WHEREAS, the Director of Finance certifies that funds are available to support the
salary adjustments ~tated herein;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview
that the 1996-1997 budget is hereby amended to appropriate funds as follows:

SECTION II
Provisions of this Ordinance are cumulative and nothing herein shall prevent, alter,
or diminish the applicability or enforcement of other Ordinances restricting, regulating, or
governing the subject matter herein.
SECTION III
Provisions of this Ordinance shall not alter or diminish the applicability or
enforcement of the City of Plainview Personnel Policy provisions, including, but not limited
to at-will employment provisions.
SECTION IV
All Ordinances or portions of any Ordinance of the City of Plainview, Texas, in
conflict herewith are hereby amended to conform with the provisions hereof.
SECTION V
Should any section, subsection, or any portion hereof, be deemed invalid for any
reason, such holding shall not render or invalidate any other section, subsection, sentence,
provision, clause, phrase, or word severable therefrom, and the same shall be deemed
severable for this purpose.
SECTION VI
This Ordinance shall be of full force and effect upon its passage and publication as
required by law.

If a promotion to a new position occurs and the entry step 1 is not at least a
2.5% salary increase, a minimum increase of 2.5% may be given, but additional
increase for steps will not occur until the position entry salary reaches a
step which is more than the entry salary of that person, then wilt increase
only to the amount indicated, regardless of the amount increase.
