HomeMy WebLinkAbout09.27.1993 BA MinutesBOARD OF ADJUSTMENT HEARING Monday, September 27, 1993 MINUTES Meeting was called to order by Chairman, Lynn Davis. Board members present: Lynn Davis, Randy Ballinger, Paul Lyle, Eddie Sessions, and Mary Ann Escamila. Staff members present: Muff London, Director of Community Development, and Debra Harris, Secretary Board of Adjustment. Chairman, Lynn Davis read the minutes from the August 23rd meeting. Randy Ballinger made a motion that the minutes be approved as read, seconded by Paul Lyle. Motion carried 5 - 0. CASE 1197 was presented by Muff London, Director of Community Development, with the use of transparencies and a video of the property in question. Eddie Session asked if a carport exist on the property at this time. After reviewing the video it was clear there was not a carport on the property. Paul Lyle asked how close to the street the carport would be. Mr. Jerry Catlin that he didn~ have much mom for a carport. Mr. Lyle asked about distance to the street. Mr. Catlin stated that the carport would be 20' X 24'. Mr. Catlin added that the carport would not cause visibility problems any more than the pine tree which sets south of the location. Fred Beohtold tried to explain the distance to the street by using the cars setting in the ddve in the video. Muff London asked why the carport couldn't be constructed in the front of the garage instead of to the side. Mr. Catlin stated that he did not want to get in to the angle of the porch overhang which is not tall enough to drive a pick up under. Matt Bailey owns the adjoining house and Paul Lyle asked if Mr. Bailey and expressed any concerns about the location of the carport. None had been received. Randy Ballinger asked what the hardship was that would cause necessity of the variance. Mr. Catlin stated that with the double carport they could keep both of their vehicles covered and not have to move them when they needed access to the garage. Eddie Session made a motion that the Board approve the Request of Doris Catlin for the following variances: 1. Seventeen (17) feet of the thirty (30) feet required front setback for a carport as stated in Section 34.3; 2. Eight (8) feet of the eight (8) feet required side setback for a carport as stated in Section 34.4; In a Single Family Residential-1 Zoning District; and located or) the South 21.75 feet of Lot 2 and the north 35.25 feet of Lot 3, Block 1, Akin & Webb Addition [1619 UtiCa Street]. Motion died for lack of second. Muff London asked Mr. Catlin and Mr. Bechtold to do more research on changing the plan to accommodate backin off the property line, or building a single carport instead of a double. Paul Lyle made a motion that BA c~gse 1197 be tabled until the meeting scheduled for October 25, 1993, seconded by Mary Ann Escamila. Motion passed 5 - 0. Case 1198 was presented by Muff London with the assistance of transparencies and video of the property. Mr. Bechtold explained the size and location. Neighbors Judy Bechtold, 804 Borger and Sarah Ross, 815 Borger gave wdtten approval of the variance. When ask.e~l, about the hardship by Mr. Ballinger, Mr. Bechtold stated that the Patterson wanted to keep their vehicles out of the weather. Paul Lyle made a motion that the board approve the request of Fred Bechtold oh behalf of Glenn Patterson for the following variances: 1. Twenty-four (24) feet of the thirty (30) feet required front setback for a carport as stated in Section 34.3; 1 of 3 2. Three (3) feet of the eight (8) feet required side setback for a carport as stated in Section 34.4; In a Single Family Residential-1 Zoning District; and located on Lot 9, Block 4 of the Brandes Addition [813 Borger Street]. The motion was seconded by Randy Ballinger. Motion passed 5 - 0. BA Case 1199 was presented by Muff London with the assistance of transparencies and video of the property. Mrs. London stated that no responses for or against had been received. Mr. Bechtold stated that moving the proposed location of the carport to the east would block access to the garage if more than 1 car was parked under it. It was determined that Clyde Fields lived in the house which the carport would ioin. Mr. Fields had discussed the variance with Chairman, Lynn Davis, and had not opposed the project. Paul Lyle pointed out that the purpose of the Board of Adjustment was to make to make decisio ns in these situation. Mr. Lyle expressed concern that Mr. Field may not have expressed opposition simply to keep harmony in the neighborhood. The video was viewed again showing the closeness to the Fields house which the carport would sit. Mr. Bechtold stated that the carport would not be a fire hazard and would drain to the street. Plates had been placed in the concrete of the existing drive with the plan of adding the carport in the future. Fred Bechtold explained that he often represents the homeowners in these vadance hearing as an added service to his customers. Randy Ballinger asked if Mr. Robison had applied for a vadance before. He had not. Lynn Davis felt Mr. Lyles point about the neighbors trying to keep harmony in the neighborhood was valid. Muff London suggested that Mr. Bechtold work up some drawings to present to Mr. Morrison showing other options for the carport location. Paul Lyle made a motion that BA Case 1199 the request of Fred Bechtold on behalf of Roy Mordson for the following variances: 1. Twenty-four (24) feet of the thirty (30) feet required front setback for a carport as stated in Section 34.3; 2. Eight (8) feet of the eight (8) feet required side setback for a carport as stated in Section 34.4; In a Single Family Residential-1 Zoning District; located on all of Lot 8 and the West half of Lot 9, Block 5 of the High School Addition [1810 W. 20th Street], be tabled until the October 25, 1993, meeting. The motion was seconded by Randy Ballinger. Motion passe 5 - 0. BA Case 1200 was presented by Muff London, with the assistance of transparencies and a video. Mrs. London explained that the house itseff was a non-conforming structure and any improvements to the property would require a variance of some kind. Mr. Stanford was present at the meeting. Mrs. London explained that Mr. Stanford was aware that he would have to License for a Right to Encumber. Paul Lyle made a motion to approve the request of Joe D. Stanford for the following variances: 1. Thirty (30) feet of the thirty (30) feet required front setback for a carport as stated in Section 34.3; 2. Sixteen (16) feet of the required thirty (30) feet required front setback for a front porch as stated in Section 34.3; In a Single Family Residential One Zoning District; and located on all of Lot 5 and the East 34 feet of Lot 6, Block 7, of the High School Addition [2101 Smythe Street]. The motion was seconded by Eddie Sessions. Motion passed 5 - 0. BA Case 1201 was presented by Muff London with the help of transparencies. Mr. DeAsis was not present for the meeting. Mrs. London explained that the video showed a large empty area, and that the lots were odd sized with the average being 66 feet wide. Two homes have been built on lots 67 and 66, and each 2of 3 required a variance. Mrs London was not able to describe what type of homes were planned for the area. She had received 2 written noticeS from neighbors opposed to the project and 1 in favor. Randy Ballinger made a motion that the request of Jose DeAsis for a variance of three (3) feet of the eight (8) feet required side setback as stated in Section 34.4 in a Single Family Residential-1 Zoning District; and located on Lots 59-65 and 68-78 of the Town West te2 and Lots 5 & 6 of the Rose Addition and generally located at 2404, 2406, 2600, 2602, 2604, 2606, 2700, 2702, 2704, 2706, 2708, 2804, 2806, 2808, 2810, 2900, 2902, 2904, 2906 and 2908 Kermit Drive, be tabled until the October 25, 1993 meeting since no one representing Mr. DeAsis was at this meeting.
