Council Chambers, City Hall, 901 Broadway Meeting was called to order by Chairman, Lynn Davis. Members present: Lynn Davis, Chairman, Don Willis, Paul Lyle, Mary Ann Escamila, and Jannie Benson. Staff present: Muff London, Director of Community Development, Debra Harris, Secretary, Board of Adjustment. Guest present: Leslie Trotter and Lee Bledsoe. Director of Community Development, Muff London presented B.A. Case 1195. Leslie Trotter requested a variance of fifteen feet of the twenty feet side setback for a garage as defined in Section 34.4 in an R-1 Zoning District, located at 700 Amarillo St. Ms. London read two responses received by her, in favor of the variance. Board member Jannie Benson questioned the appearance of two measurements (18X24 and 24X24) shown on the sight drawing. Mr. Trotter explained that he is planning to move in a building to be used as a garage which is 24' X 24', and had also made alternative plans for Jim Matlock to build an 18' X 24' metal building, depending on the findings of the Board. Mr. Trotter stated that Muff London had explained that any building moved onto the site would have to meet City Codes. The hardship causing the variance request is the fact that no other site on the property would allow the construction of any kind of garage. Lynn Davis questioned which side of the building the variance would affect. Muff London and Mr. Trotter stated that the difference would be toward the back of the property only. The video of the property was viewed. Motion was made by Paul Lyle that the Variance requested by Leslie Trotter be approved. Motion seconded by Don Willis. Motion carried unanimously. Muff London, Director of Cummunity Development presented B.A. Case 1196 a request by L & L , Inc. for a variance of: eighteen feet of the twenty feet required front setback for a canopy for the pump station as stated in Section 34.3 and thirteen feet of the thirty feet required front setback for the gas pump islands as stated in Section 34.3: in a C-2 zoning district, and being located at 2104 W. 5th St. Ms. London read 3 responses received by her, in favor of the variance. Muff London explained that the variance was needed because the pumps were replaced as before and were non-conforming to current ordinances. The canopy needed to cover the non-conforming pumps could not meet the 20 foot setback requirements. London explained the hardship of L & L meeting environmental and Gas Co. requirements must include these variances for the gas station to exist without moving buildings, etc. 1 of 2 Lee Bledsoe, representing L & L, Inc., stated that the pumps were not being replaced. They are being moved in order to replace storage tanks. These tanks are being replace because of Environmental requirements. He further stated that Phillips, the company from which he purchases his gas requires that the pumps be covered by a canopy. While the pumps had to be moved anyway he requested the variance to build the canopy. Muff London stated that the only reason the pumps were too close to Olton Road is because the ordinance changed in 1989. It was also pointed out that Olton Road had been widened. Paul Lyle stated that the Trio Rebel Drive-In was right across the street and its canopy was lower and closer to the Road. Jannie Benson made the motion that the variance be approved as requested, seconded by Paul Lyle. Motion carried unanimously.
