ORDINANCE NO. 97-3120
AN ORDINANCE AMElhlDING THE CITY OF PLAINVIEW
CODE OF ORDINANCES, CHAPTER 20, ADOPTING THE
UNIFORM MECHANICAL CODE AND AMENDING
SECTIONS OF THE UNIFORM MECHANICAL CODE;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE;
SEVERABILITY CLAUSE; AND EFFECTIVE DATE.
WHEREAS, The City of Plainview's Board of Building Code and Fire Code Board has
reviewed the need of the City of Plainview to adopt a mechanical code;
WHEREAS, The Building Code and Fire Code Board deems it necessary to adopt a
mechanical code to provide minimum standards to safeguard life or limb, health, property and
public welfare within the jurisdiction of the City of Plainview
WHEREAS, the Board of Building Code and Fire Code Board has made
recommendations for the following changes;
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of
Plainview, Texas that:
SECTION I
ARTICLE I. IN GENERAL
Before any person shall do any work or make any connections with
the sewer system or the gas system in the city, or do any plumbing
work connected or intended to be connected with the sewer or gas
system, he shall be licensed as provided in "The Plumbing License
Law of 1947", as amended, the same being title 109a, Revised
Civil Statutes of Texas, 1925. (Code 1977, Ch. 26,§1)
Before any person shall do any mechanical and refrigeration work,
he shall be licensed as provided by State of Texas Law for such
work.
Administration: The administration and enforcement of the
provisions of this chapter shall be vested in the city plumbing
inspector, who will be under the supervision of the building
official of the city.
ARTICLE II. TITLE CITED
Title Cited.
This ordinance shall be known as the Plumbing and Mechanical

Ordinance of the City of Plainview, and may be cited as such.
It shall be unlawful for any person, association of persons, co-
partnership or corporation to engage in the business of plumbing,
or perform any plumbing as defined in this ordinance, without first
having procured the necessary licenses and permits as hereinafter
provided for, and all plumbing, plumbing work and workmanship
and materials shall meet the requirements of this ordinance and
shall pass all inspections required in this ordinance in regard to the
work done.
It shall be unlawful for any person, association of persons, co-
partnership or corporation to engage in the business of mechanical
contracting, or perform any mechanical work as defined in this
ordinance, without first having procured the necessary licenses and
permits as hereinafter provided for, and all mechaniCal,
mechanical work and workmanship and materials shall meet the
requirements of this ordinance and shall pass all inspections
required in this ordinance in regard to the work done.
ARTICLE III.
INTENT AND PURPOSE
Purpose.
For the protection and preservation of life and of the public health,
safety, property and the general welfare of the people, the
following provisions are enacted relating to the installation,
alteration or repair of pipes, fittings, and fixtures for water,
sewage and natural gas in all buildings and structures and on all
property now erected or to be erected, changed, constructed,
reconstructed, repaired or altered in the City of Plainview, and
outside the City of Plainview, if same be connected to either the
City water, gas or sewage systems. The intent and purpose of this
ordinance is to regulate the consffuction, erections, enlargement,
alteration, maintenance or repair of all piping, fittings, fixtures,
etc., used for the conduction of water, sewage and natural gas in
or on and about any and all premises in the City of Plainview, and
outside the boundaries of the City of Plainview, if same be
connected to either the city water, gas or sewage systems.
ARTICLE IV.
PIPING AFFECTED BY THIS ORDINANCE
Extent of application.
This ordinance shall apply to all plumbing as herein defined within
the boundaries of the City of Plainview. Any plumbing outside the
boundaries of the City of Plainview, connecting to either the City
water or sewage systems shall meet all the requirements of this
ordinance as to methods of installation and materials and shall be

inspected by the City Plumbing Inspector.
Exclusion.
This paragraph shall not apply to that work done by authorized
employees of the City of Plainview, in the laying of City water
mains and services and City sewer mains and services nor to the
installation of gas distributing mains and services in the streets and
alleys by authorized employees of any gas distributing company.
ARTICLE V.
DEFINITIONS
Air conditioning and refrigeration contracting: means the design,
installation, construction, maintenance, service, repair, alteration,
or modification of a product or of equipment in environmental air
conditioning, commercial refrigeration, or process cooling or
heating systems.
Air conditioning and refrigeration contractor, means a person
who performs air conditioning and refrigeration contracting.
Mechanical Work: means same as Air conditioning and
refrigeration contracting.
Plumber-Apprentice: A "Plumber's Apprentice" within the
meaning of this Code is any person other than a master plumber
or journeyman plumber, who, as his principal occupation, is
engaged in learning and assisting a licensed plumber in the
installation of plumbing.
Plumber-Journeyman: A "Journeyman Plumber', within the
meaning of this Code is any person other than a master plumber
who engages in or works at the actual installation, alteration,
repair and renovating of plumbing, and who is licensed by the
Texas State Board of Plumbing Examiners as provided by the
Plumbing License Law of 1947.
Plumber-Master: A "Master Plumber" within the meaning of this
Code is a plumber having a regular place of business, who, by
himself, or through a person or persons in his employ, performs
plumbing work, and who is licensed by the Texas State Board of
Plumbing Examiners as provided by the Plumbing License Law of
1947.
Plumbing: "Plumbing" as used in this Code means and shall
include: (1) All piping, fixtures, appurtenances and appliances for
a supply of water or gas, or both, for all personal or domestic
purposes in and about buildings where a person or persons live,
work or assemble; all piping, fixtures, appurtenances and
appliances outside a building connecting the building with the
source of water or gas supply, or both, on the premises, or the
main in the street, alley or at the curb; all piping fixtures,
appurtenances, appliances, drain or waste pipes carrying waste or
sewage from or within a building to the sewer service lateral at the
curb or in the street or alley or other disposal terminal holding

private or domestic sewage; (2) The installation, repair and
maintenance of all piping f~xtures, appurtenances and appliances
in and about buildings where a person or persons live, work or
assemble, for a supply of gas, water, or both, or disposal of waste
water or sewage.
Plumbing Fixtures: Plumbing fixtures are installed receptacles,
devices, or appliances which are supplied with water or which
receive or discharge liquids or liquid-borne wastes, with or without
discharge into the drainage system with which they may be directly
or indirectly connected.
Plumbing Inspector: The "Plumbing Inspector" within the
meaning of this Code is any person employed by the city for the
purpose of inspecting plumbing work and installations in
connection with health and safety laws as provided by this Code,
and who is licensed by the Texas State Board of Plumbing
Examiners in accordance with the Plumbing License Law of 1947.
Room or Space Heater: A self-contained gas-burning appliance
installed in and for heating rooms. This definition shall not
include unit heaters, central heating appliances, garage heaters, nor
vented recessed heaters.
Wall Heater Unvented Open-Flame Radiant Type: A room
heater of the open front type, designed for insertion in or
attachment to a wall or partition having fully exposed flames and
heat from which is reflected by ceramic radiants or a metal,
asbestos, clay back or equivalent backwall reflecting surface. It
incorporates no concealed venting arrangements in its construction
and discharges all products of combustion through the open front
into the room being heated.
ARTICLE VI. LICENSING REQUIREMENT
Air Conditioning and refrigeration License required. All persons
who engage in or work at air conditioning and refrigeration
contracting shall be licensed according to the State of Texas Air
Conditioning and Refrigeration Contractor License Law.
Plumbing License Required. All persons who engage in or work
at the actual installation, alteration, repair and renovating of
plumbing shall possess either a master or journeyman plumber's
license or an apprentice registration card in accordance with the
provisions of the Plumbing License Law.
Definition of Plumbing. The word or term "plumbing" as used in
"The Plumbing License Law" means and shall include: (1) All
piping, fixtures, appurtenances and appliances for supply or
recirculation of water, gas, liquids, and drainage or elimination of
sewage, including disposal systems or any combination thereof, for
all personal or domestic purposes in and about buildings where a
person or persons live, work or assemble; all piping fixtures,

appurtenances and appliances outside a building connecting the
building with the source of water, gas, or other liquid supply, or
combinations thereof, on the premises, or the main in the street,
alley or at the curb; all piping, fixtures, appurtenances, appliances,
drain or waste pipes carrying waste water or sewage from or
within a building to the sewer service lateral at the curb or in the
street or alley or other disposal or septic terminal holding private
or domestic sewage; (2) the installation, repair, service, and
maintenance of all piping, fixtures, appurtenances and appliances
in and about buildings where a person or persons live, work or
hssemble, for a supply of gas, water, liquids, or any combination
thereof, or disposal of waste water or sewage.
ARTICLE VII. EXEMPTED ACTIVITY
Exemptions. The following acts, work and conduct shall be
expressly permitted without license:
(a) Plumbing and air conditioning and refrigeration work done by
a property owner in a building owned and occupied by him as his
homestead.
(b) Plumbing work done by anyone who is regularly employed as
or acting as a maintenance man or maintenance engineer,
incidental to and in connection with the business in which he is
employed or engaged and who does not engage in the occupation
of a plumber for the general public; and plumbing work done by
persons engaged by any public service company in the laying,
maintenance and operation of its service mains or lines and the
installation, alteration, adjustment, repair, removal and renovation
of all types of appurtenances, equipment and appliances; appliance
installation and service work done by anyone who is an appliance
dealer or is employed by an appliance dealer, and acting as an
appliance installation man or appliance service man in connecting
appliances to existing piping installations. PROVIDED,
HOWEVER, THAT ALL WORK AND SERVICE HEREIN
NAMED OR REFERRED TO SHALL BE SUBJECT TO
INSPECTION AND APPROVAL IN ACCORDANCE WITH
THE TERMS OF ALL LOCAL VALID CITY OR MUNICIPAL
ORDINANCES.
c) All licensing exemptions in the Air Conditioning and
Refrigeration Contractor License Law are hereby incorporated in
this ordinance.
ARTICLE VIII. PLUMBING AND MECHANICAL APPEALS AND ADVISORY
BOARD
Organization of Board There is hereby created a five member,
and one alternate, Plumbing and Mechanical Appeals and Advisory

Board consisting of:
(a) One licensed and active master plumber, who shall have had
at least ten years active experience as a plumber, one of such years
of experience having been performed in the City, working under
the provisions of this code.
(b) One licensed and active journeyman plumber, who shall have
had at least five years active experience as a plumber, one of such
years of experience having been performed in the City, working
under the provisions of this code.
(c) Three Two members, other than master or journeyman
plumbers, who shall have knowledge of building construction and
plumbing materials through experience as a contractor, engineer,
architect, supplier of building or plumbing materials or other
experience in a related field that would enable him/her to render
service in the interpretation of the provision of this code and to
make recommendations for improvements to the provisions of this
code.
d) One licensed and active Air Conditioning and Refrigeration
contractor.

~,~j (e) One alternate, other than a master or journeyman plumber,
who shall have knowledge of building construction and plumbing
materials through experience as a contractor, engineer, architect,
supplier of building or plumbing materials or other experience in
a related field that would enable him/her to render service in the
interpretation of the provision of this code and to make
recommendations for improvements to the provisions of this code.
(e-) 09 The City Building Inspector, or his authorized representative
who shall be an ex-officio member and serve as secretary for the
Plumbing Board without voting privileges.
(-~ (g) The City Engineer, who shall be an ex-officio member of
the Plumbing Board without voting privileges.
Appointment and Terms of Office: Members of the Board and
their successors shall be appointed by the Mayor and confirmed by
the City Council and shall hold office for terms of two (2) years,
or until their successors are appointed and have qualified. There
shall be no limit on the number of terms a member may serve,
provided the member is reappointed by the City Council.
Compensation: All members shall serve without compensation.
Election of Officers and Adoption of Rules: The members of the
Board shall meet as soon after their appointment as practicable for
the purpose of organization. The Board shall formally elect a
chairman, and a vice-chairman, from its members and may adopt
such rules as it deems necessary for the orderly conduct of its
affairs. A full and complete record of the proceedings of said
Board shall be kept by a representative of the Code Enforcement
Department. A majority of the Board shall constitute a quorum
for the transaction of business.

Absences: Each member of the Board shall attend no less than
75 % of the regular meeting called by the officers of the Board.
The secretary of the Board shall make a quarterly report to the
Mayor and City Council showing the attendance of each member
of the Board. Any representative failing to attend 75 % of the
regular meetings legally called during any calendar year without
an excused absence, as determined by a majority vote of the board
members, shall be automatically disqualified for service on the
Board and shall be replaced by the City Council. Should any
member of the Board move from the City or otherwise become
disqualified for any reason, he/she shall be deemed to have vacated
the office.
Duties and Powers of the Board: (a) Any person, f'rrm or
corporation aggrieved by any interpretation of this code or by any
decision or ruling by the Plumbing or Mechanical Inspector under
this code shall have the right to make an appeal to the Plumbing
and Mechanical Appeals and Advisory Board.
(b) Within a period of ten(10) days from the filing of the appeal,
the Board shall hear the appeal, together with the testimony of all
parties concerned, and render a decision thereon within three (3)
days thereafter. In hearing such an appeal, the Board shall not
have the power to waive or set aside the requirements of this code,
but shall have the power to interpret its provision and in case of
alternate types of construction or material, shall determine whether
standards of this code, considering adequacy, stability, strength,
sanitation and safety to the public health and welfare. Any person,
firm or corporation who may be aggrieved by the decision of the
Board shall have a right of appeal to the City Council within ten
(10) days from the rendition of such decision. Said appeal shall
be perfected by written notice addressed to the Mayor and City
Council asking for a hearing by the Council, and the action of the
City Council thereon shall be final. Except that due process shall
not be denied and further appeal may be made to the nearest court
of competent jurisdiction.
(c) The Board shall submit to the City Council such
recommendation for the improvement and revision of this Code as
it may from time to time deem necessary and proper in light of the
development of new materials, methods or techniques which would
result in a better and more economical installation. All requests
for use of materials or methods not covered in this Code shall be
fully supported by factual evidence, or prior approval, from a
recognized testing agency or such impartial qualified authority
acceptable to the Board.

ARTICLE IX.
PERMITS, FEES AND INSPECTIONS
Persons Who May Obtain a Permit: Permits shall be issued only to the
following:
(a) Permits and inspections shall be required for all new
installations and/or repair of lawn sprinkler equipment when the
repair involves replacement of the back flow prevention. Permits
shall be issued only to homeowners, Master Plumbers, or persons
licensed as Landscape irrigators by the Texas State Board of
Landscape Architects in accordance with Article 249 (C), Vernon's
Texas Civil Statutes, Chapter 475, Acts of the 61st Legislature,
1969.
(b) Permits and inspections shall be required for all new
installations, exchanges, servicing, and repair of water softening
or water conditioning equipment. Permits shall be issued only to
homeowners, Master Plumbers, or persons certified by the Texas
Department of Health, Division of Water Hygiene in accordance
with Article 6243-101, Vernon's Texas Civil Statutes Senate Bill
No. 147 of the 65th Legislature. 1977.
(c) Any Master Plumber licensed by the State Board of Plumbing
Examiners,
(d) Any property owner for plumbing or mechanical work to be
done by him in a building owned and occupied by him as his
home.
(e) Any person licensed as a Landscape Irrigator by the Texas
State Board of Landscape Architects may secure a permit for lawn
sprinkler systems only.
(f) Any person certified by the Texas Department of Health,
Water Hygiene Division may secure a permit for water
softening/water conditioning equipment only.
(g) Any person licensed as a Air Conditioning and Refrigeration
Contractor by the State of Texas Department of Licensing and
Regulation.

Permits Not Transferable: Each permit issued under this code
shall be personal to the Permittee. No such permit shall be
assigned or transferred to another person and no persons shall
permit another person to obtain a permit in his name, or permit
any plumbing or gas fitting work to be performed under his permit
by any person other than the person authorized to do the same.
False Statement of Bad Faith: Any person who shall willfully
make any false statement in order to obtain a permit shall be guilty
of a misdemeanor and subject to the penalty provided herein. Bad
faith or unreasonable delay in the performance of plumbing work
shall be deemed a sufficient reason for subjecting the plumber so
offending, to a suspension of the permit and no further permit shall
be issued until such act of bad faith or unreasonable delay has been
corrected.
Permit and Inspection Fees: Application for permits either by
phone or in person by the contractor must be secured prior to
commencement of any work. Contractors may pay in advance or
apply for an account to be paid once a month. Contractor's will
be billed monthly. If an approved contractor fails to pay their
account within 15 days after the date of the billing statement, no
permits can be issued to the contractor until the past due account
has been paid in full. Fees are as follows:

ARTICLE X. INSTALLATION REGULATIONS
Standard: 1994 Uniform Plumbing Code Incorporated by
Reference: All installation hereafter installed within the corporate
limits of the City of Plainview shall be done in a first class
workmanlike manner in accordance with the 1994 edition of the
Uniform Plumbing Code as adopted at the sixty-fourth annual
conference of the International Association of Plumbing and
Mechanical Officials, and said Uniform Plumbing Code is made a
part of this Ordinance, with the additions and deviations therefrom
contained in this code.
Conformance with Code: All plumbing systems hereafter installed
shall conform with the provisions of the 1994 Uniform Plumbing
Code and the amendments to that code as follows:
(a) Every building in which plumbing fixtures are installed shall
have a connection to a public sewer. Exception: When there is no
sewer available within one hundred fifty feet (150') approved,
private sewage disposal system may be used.
(c) The drainage system of each new building and new work
installed in existing buildings shall be separate and independent
from that of any other building and when available, shall have an
independent connection with a public sewer. Exception: When
one building stands in the rear of another building, on an interior
lot and these buildings are on parcel of land under one owner, then
the building sewer may be extended to serve the rear building.
(d) A house sewer may not cross another lot unless an easement
or right-of-way is provided to protect all property owners.
Amendments to the 1994 Uniform Plumbing Code:
Section 410.7 is amended to allow regular valves for single family
residential use.
Section 504.2 is amended to establish a spot check basis for
inspection of water heaters, (replacement water heaters when no
change is made in rough-in plumbing).
Section 603.3.7 is amended to exempt vacuum breakers on
residential exterior house bibbs.
Section 608.5 is amended to allow T & P valve drain to
condensate drain trap, or other drain traps.
Section 610 is amended to allow 3/4 inch supply water to single
family residential, as a standard service line.

Section 1202.10 is amended to require Dielectric unions on all gas
lines except where Poly-pipe is used with prefabricated risers.
Section 1204.3.2 is amended to require gas line tests to be 10
inches of mercury. EXCEPTION: 6 inches of mercury may be
allow by the plumbing inspector when conditions warrant.
Section 1204.5 is amended to add:
a) Unvented gas-burning room heaters equipped with an Integral
Oxygen Depletion Sensing System (ODS) may be installed in
Group R-3 occupancies if the unit is Certified by an approved
scientific testing laboratory and it is installed in accordance with
the National Fuel Gas Code as, copyrighted in 1992 by the
American Gas Association, 1515 Wilson Boulevard, Arlington,
VA 222209.
b) Existing gas-burning unvented room heater(s) installed in R-3
occupancies which do not comply with code requirements shall be
removed or replaced with vented or other approved heaters when
alterations or remodeling of the structure occur which would
require a building permit, or when a city pressure test is required
on the gas line system. Additionally all gas outlets for room
heaters in bathrooms and bedrooms shall be capped.
EXEMPTION: Homeowners that are living in their homestead are
exempted from the requirement of removing the non-approved
heaters when a pressure test of the gas line is done. However, the
requirements to replace unvented heaters shall be enforced when
a building permit is required.
Section 1211.16 shall be deleted.
APPENDIX E is amended forbidding gas piping to be installed
under ground under any mobile home.
Standard: 1994 Uniform Mechanical Code Incorporated by
Reference:
All installation hereafter installed within the corporate limits of the City
of Plainview shall be done in a first class workmanlike manner in
accordance with the 1994 edition of the Uniform Mechanical Code
published by the International Association of Plumbing and Mechanical
Officials, and said Uniform Mechanical Code is made a part of this
Ordinance
Conformance with Code: All mechanical systems hereafter
installed shall conform with the provisions of the 1994 Uniform
Mechanical Code and amendments to that code as follows:
(a) Section 110.0 - Board of Appeals shall mean the Plumbing and

mechanical Appeals and Advisory Board.
ARTICLE XI
MATERIALS
Minimum Mechanical Standards. The materials used shall conform
with the standards set forth in the 1994 edition of the Uniform
Mechanical Code.
Minimum Plumbing Standards. The materials used shall conform
with the standards set forth in the 1994 edition of the Uniform
Plumbing Code, unless amended in this ordinance.
Materials not listed. Materials other than those listed in the 1994
Uniform Plumbing Code may be permitted upon approval of the
Plumbing and Mechanical Appeals and Advisory Board.
Prohibited Materials. The use of lead pipes, solder and flux is
prohibited when used in the installation or repair of any public
water system or any plumbing in a residential or non-residential
water system providing water for human consumption. This
prohibition does not apply to leaded joints necessary for repair of
cast iron pipes. For the purpose of this prohibition, the definition
of "lead free" shall mean (1) when used with respect to solder and
flux it refers to solder and flux containing not more than 0.2%
lead, and (2) when used with respect to pipes and pipe fittings it
refers to pipe and pipe fittings containing not more that 8.0 % lead.

Materials not listed: Materials other than those listed for the various uses may be
permitted upon approval of the Plumbing and Mechanical Appeals and Advisory
Board. The Board shall not approve any material unless the same is shown to be
equal or better than materials listed in this Ordinance or the Uniform Plumbing
Code.
SECTION II

Provisions of this Jinance are cumulative and nothin~.~..~rein shall prevent, alter,
or dim inish the applicabili~ ~y or enforcement of other ordinances restricting, regulating or
governing the subject matter herein.
SECTION III
All ordinances or portions of any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with the provisions hereof.
SECTION IV
Should any section, subsection, or any portion hereof be deemed invalid for any
reason, such holding shall not render or invalidate any other section, sub-section,
sentence, provision, clause, phrase, or word severable therefrom and the same shall be
deemed severable for this purpose.
SECTION V
This ordinance shall be of full force and effect upon its passage and publication
as required by law.
