BOARD OF ADJUSTMENT MEETING MINUTES
Monday, April 26, 1993, 7:30 P.M.

Larry Gould presented B.A. Case No. 1182, the request of Jesus Chavez for a
variance of twenty-one and one-half (21½) feet of the twenty-five (25) feet
required front setback and a variance of two (2) feet of the five (5) feet required
side setback in Section 32, being Lot 21, Jordan-Lafont Addition and generally
located at 610 W. 17th Street.
With little discussion of the request Lee Roy Lightfoot moved seconded by Randy
Ballinger to approve the request as stated. Motion carried unanimously.
Larry Gould presented B.A. Case No. 1183, the request of Don Dickson for a
variance of five (5) feet of the five (5) feet required side yard setback in Section
32, being Lots 7 and 8, Block 7, Highland Addition and generally located at 1005
W. lth Street.
Two (2) positive replies were received. Mrs. Dickson explained to the board that
this request was to enlarge an existing structure for a garage. Randy Ballinger
moved seconded by Betty Gonzaiez to grant the request as stated. Motion carried
unanimously.
Jim Lindstrom presented B.A. Case No. 1174, the request of Roy L. Tullls &
Dorothy P. Tullis/Brown for the following variances:
To rebuild two (2) non-conforming duplexes which have
been damaged in excess of 50% of its value by a fire,
Section 35:1(4); and has been discontinued in its use
more than six (6) months, Section 35: 5 (5); and
To grant a variance of the Floodplain Ordinance No. 88-
2769 as called for in Section 4:D(6) to allow substantial
improvement of the two (2) duplexes at the current
elevation instead of raising it to one (1) foot above base
flood level as required in Section 5:B (1);
And being Lots 24 and 24, Block 11, West Lynn Addition and
generally located at 1223 and 1225 W. 25th Street.

Mr. Lindstrom listed for the board the repairs that needed to be made and relayed
a conversation with Mr. Ellison of FEMA. Mr. Ellison expressed the problems that
could be incurred if this variance was granted.
Dorothy Tullis/Brown spoke to the board on price of repairs to structures in
question. No estimates were given to the board. Roy Tullis also spoke to the
board on repairing the structures as requested.
Jim Lindstrom explained the applicant's right to go to District Court if the
request was denied by the Board of Adjustment.
After a discussion of the request Leroy Lightfoot moved,
Ballinger to deny the request. Motion carried unanimously.
With no further business to attend to meeting adjourned.
