BOARD OF ADJUSTMENT MEETING MINUTES
Monday, February 22, 1993, 7:30 P.M.
Council Chambers, City Hall, 901 Broadway
members present were: Eddie Sessions, Betty Gonzalez, Jannie Benson, Mary
Ann Escamila, Lee Roy Lighffoot, Don Willis and~andy Ballinger.
Staff present were: Diane Groh, Director for Community Services; Larry Gould,
Building Inspections; Jim Lindstrom, Code Enforcement Department; and Janice
Anderson, Secretary.
Visitors present were Roy Tullis and wife, Dorothy Tullis Brown and Louis
Flores.
Don Willis moved, seconded by Randy Ballinger to take the cases out of order.
Motion carried unanimously.
Diane Groh explained non-conforming uses to the board.
B. A. CASE NO. 1175: Request of Victor A. Gutierrez, M.D. for a
variance to Section 35:5(5) to reestablish a non-conforming use to allow a
residential use in a C-2 (Light Retail and Commercial District) Zoning
District, being a tract of land out of Section 34, Block JK-2, Hale County
Texas.
Larry Gould presented Case No. 1175 to the board. One (1) positive and one (1)
negative reply were received.
Leroy Lightfoot moved, seconded by Betty Gonzales to approve the request as
stated. Motion carried 6-0 with Paul Lyle abstaining.
B. A. CASE NO. 1176: Request of Clinton and Phyllis Wall for four
(4) feet of the twenty-five (25) feet required rear setback in Section
32; and to allow more than 50% of front yard to be covered by
driveway as required in Section 31:5.5; being Lot 32 plus parts of
Lots 31 and 33, Grandview Addition and generally located at 3303
Grandview.

Larry Gould presented Case No. 1176 to the board. Three positive replies were
received.
Leroy Lightfoot moved, seconded by Don Willis to approve the request as stated.
Motion carried unanimously.
B. A. CASE NO. 1174: Request of Roy L. Tullis & Dorothy P.
Tullis/Brown for variances to rebuild two (2) non-conforming
duplexes which have been damaged in excess of 50% of it value by a
fire, Section 35:1(4); and have been discontinued in its use more
than six (6) consecutive months, Section 35:5(5); and to grant a
variance of the Floodplain Ordinance No. 88-2769 as called for in
Section 4:D(6) to allow substantial improvement of the called for in
Section 4:D(6) to allow substantial improvement of the two (2)
duplexes at the current elevation instaed of raising it to one (1) foot
above base flood level as required in Section 5:B(1); being Lots 24
and 25, Block 11, West Lynn Addition and generally located at 1223 &
1225 W. 21st Street.
Jim presented Case No. 1174 to the board. Randy Ballinger moved, seconded by
Leroy Lightfoot to limit time to five (5) minutes per party speaking for or against
the case. Motion carried unanimously.
Roy Tullis, Louis Flores and Dorothy Tullis/Brown spoke in favor of the request.
The staff's position was against granting the request as stated.
After a lengthy discussion on the case Randy Ballinger moved, seconded by Don
Willis to table case until next meeting. Motion carried unanimously.
With no further business Paul Lyle moved, seconded by Don Willis to adjourn.
Motion carried unanimously.
