The meeting was called to order by chairperson, Lynn Davis.
Other board members present were: Randy Ballinger, Lee Roy
Lightfoot, Jannie Benson and Brandon Brownlee.
Staff present were: Diane Groh, Director for Community Services;
Tom Egleston, Building Official; Larry Gould, Code Enforcement
Officer; and Janice Anderson, Secretary for Community Services.
B. A. CASE NO. 1128:
Request of Pasquel Aguirre for a 7 foot variance to the 8 foot
side yard required by Section 32:1 (Side Yard Setbacks) to permit
a carport 1 foot from the side and 9 feet from the front property
line in a R-1 (Single Family Residential District) Zoning
District. Property is Lot 1, Block 10, High School Addition and
generally located at 2009 W. 20th.
Diane Groh presented the case to the board.

variance of 1 foot from the side and 9 feet from the front
property line as requested. Motion carried unanimously.
B. A. CASE NO. 1129:
Request of Orval McGuire for a 21 foot variance to 25 foot
required rear yard setback, Section 32:1 (Rear Yard Setbacks) in
a R-1 (Single Family Residential District) Zoning District to
permit construction of a recreational vehicle cover 4 feet from
the rear property line. Lot 12, High School Addition, Unit No. 2
and generally located at 2005 Dimmitt Road.

B. A. CASE NO. 1130:
Request of Arturo Lopez for a 15 foot variance to the 15 foot
required setback in Section 32:1 (Side Yard Setbacks) in a R-1
(Single Family Residential District) Zoning District to allow a
storage building to be built on the side property line, being Lot
11, Block 23, Lakeside Addition generally located at 1623
Houston.
Diane Groh presented the case to the board. Mr. Lopez explained
where the storage building would be on the property and the type
of construction it would be.
Lee Roy Lightfoot moved, seconded by Jannie Benson to grant the
15 foot variance to the 15 foot required setback as requested.
Motion carried unanimously.
B. A. CASE NO. 1131:
Request of Bill Orman on behalf of Hale County Compress under
Section 37:2(d) to rebuild a single family house in a M-1
(Industrial District) Zoning District, AB 658 Pre H. McClelland,
4.18 acres and generally located at 609 E. 7th Street.
Diane Groh presented the case to the board explaining that the
residence had been for security purposes and lightning had struck
the residence as the reason for rebuilding.
Henry Watson, General Manager spoke for the variance stating
security as purpose of residence.
Bill Orman also spoke for the variance stating there had been a
break in that possibly could have been prevented if there had
been someone living at the residence.
Randy Ballinger moved, seconded by Brandon Brownlee to grant the
request to rebuild the single family house in a M-1 (Industrial
District) Zoning District for security purposes. Motion carried
unanimously.
B. A. CASE NO. 1132:
Request of Fred Bechtold on behalf of Jimmy Rogers for a variance
of 1 foot and 3 foot to the 10 foot required side yard setback
and a variance of 24 feet to the 25 foot required front yard
setback in Section 32:1 (Side and Front Yard Setbacks) in a C-2
(Retail District) Zoning District to permit construction of a
carport and described as follows:

Being a 1,921 square foot tract out of the West part of Lot 3,
Block 65, Revised, College Hill Addition, Plainview, Hale County,
Texas, revised plat of said block recorded in Volume 195, page
281, of the Hale County Deed Records:
BEGINNING at a 3/8 inch steel rod found for the Northwest corner
of Lot 3, Block 65, Revised, College Hill Addition, Plainview,
Hale County, Texas;
THENCE N. 89°48'15'' E. 47.9 feet along the North line of said Lot
to a 1/2 inch steel rod set 92.1 feet S. 89°48'15'' W., of the
Northeast corner of said lot;
THENCE S. 6~32'02'' W. 47.55 feet to a 1/2 inch steel rod set in
the South line of said Lot 3 and in the North line of an alley,
said rod being 99.8 feet N. 77~02'05'' W., of the Southeast corner
of said lot;
THENCE N. 77°02'05'' W. 43.7 feet to a 1/2 steel rod steel rod set
for the Southwest corner of said lot;
THENCE North 37.3 feet along the West line of said lot to the
POINT OF BEGINNING containing 0.044 acres and located at 2308 W.
5th Street, Rear.
Diane Groh presented the case to the board explaining that this
lot is a nonconforming lot. Fred Bechtold explained the
construction of the carport to be built and how the parking would
be arranged.
Lee Roy Lightfoot moved, seconded by Brandon Brownlee to grant
the variance 1 foot and 3 foot to the 10 foot required side yard
setback and the variance of 24 feet to the 25 foot required front
yard setback to construct a open carport. Motion carried
unanimously.
With no further business pending before the board, meeting
adjourned.
