HomeMy WebLinkAbout97-3115Speed Zone ORDINANCE NO. 97-3115 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING SECTION 24-160 (a)(c) OF THE CODE OF ORDINANCES TO REMOVE SCHOOL ZONE DESIGNATION DURING THE HOURS OF 11:30 a.m. AND 1:00 p.m. ON 12TH STREET BETWEEN FRESNO STREET AND INDEPENDENCE STREET; GALVESTON STREET BETWEEN WEST llTH STREET AND WEST 13TH STREET; HOUSTON STREET BETWEEN WEST llTH STREET AND WEST 13TH STREET; CANYON STREET BETWEEN 5TH STREET AND 10TH STREET; ON YONKERS BETWEEN 19TH STREET AND 24TH STREET; ON 29TH STREET BETWEEN YONKERS STREET AND AMARILLO STREET; PROVIDING FOR A PENALTY; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. Whereas, the City Council of the City of Plainview recognizes a need to amend § 24-160 (a) (c) of the Code of Ordinances to delete the school zone designation between the hours of 11:30 a.m. and 1:00 p.m. due to the fact the schools do not have children leaving the school grounds during the 11:30 a.m. to 1:00 p.m. time period. THE CITY OF PLAINVIEW HEREBY ORDAINS that: Section I § 24-160 (a)(c) be amended to delete 20 MPH school zone designation for: 12th Street between Fresno Street and Independence Street; Galveston Street between West llth Street and West 13th Street; Houston Street between West llth Street and West 13th Street (Houston Street School); Canyon Street between 5th Street and 10th Street; Ennis Street beginning 150 feet North of the North right-of-way line of Itasca Street to 150 feet South of the South right-of-way line of Itasca Street; On U.S. 70 (5th Street) beginning at the West curbline of the intersection of U.S. Highway 70 and Canyon Street, West a distance of 188' and beginning at the East curbline of the intersection of U.S. Highway 70 and Canyon Street, East a distance of 155' (College Hill School); On Yonkers Street between 19th Street and 24th Street; On 29th Street between Yonkers Street and Amarillo Street (Edgemere School). Section II Any person who shall violate or fail to comply with the provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not less than $1.00 and not more than $200.00. Section III Provision of this ordinance are cumulative and nothing therein shall prevent, alter, diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. Section IV All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. Section V Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, subsection, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. Section VI This ordinance shall be of full force and effect upon its passage and publication as required by law. Passed and Approved this ~) day of April, 1997.
