ORDINANCE NO. 97-3112
AN ORDINANCE OF THE CITY OF PLAINVIEW,
AMENDING ARTICLE II. SECTION 25-41, ENTITLED
"WATER RATES, BILLINGS" OF THE CODE OF THE CITY
OF PLAINVlEW, TEXAS, AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, the City of Plainview, Texas, provides water to its citizens; and
WHEREAS, the City Council is charged with the responsibility of establishing water rates
in order to insure that the services provided are maintained at an acceptable level; and
WHEREAS, the City Council finds that an increase in the fees charged for such services
is necessary to insure the continued viability of said program;
THE CITY OF PLAINVIEW HEREBY ORDAINS that Section 25-41 entitled "Water Rates,
Billings" of the Code of the City of Plainview, Texas, is hereby amended and shall
henceforth read as follows:
Section 25-41. Water Rates, Billings.
The City shall charge and collect, and every consumer of water shall pay for the water
furnished by the City to the consumer the amounts calculated by application of the rates
to metered readings as provided in this chapter.
(a) The following are established as the monthly rates to be charged for water
furnished by the City of Plainview for all consumers, unless otherwise noted:
The City shall make a m~nimum monthly charge of eight dollars and twenty-five
cents ($8.25), to each consumer using City water. An additional charge of one dollar
and four cents ($1.04) for each one thousand (1,000) gallons shall be made on all water
consumed.
The net amount due may be paid on or before the past due date printed on the
bill. All payments must be in the possession of the utility accounting department by
5:00 p.m. on the past-due date to prevent a penalty charge being assessed.
Penalty on delinquent bills. A one-time penalty of ten (10) percent of the total
utility bill shall be assessed on all bills not paid on or before the past-due date printed
on the bill. All payments must be in the possession of the utility accounting department
by 5:00 p.m. close of business on the past-due date to prevent a penalty charge being

assessed. The gross due, which includes penalty, shall be the amount due after 5:00
p.m. on the past-due date.
(b) All rates and charges for utility services shall be billed on one bill. Payment
of the amount due on such bill shall be in full for the total amount billed. Partial payment
will not be accepted without prior approval from the Water Department.
(c) State Prison Rates. The City shall charge ninety cents ($.90) per one
thousand (1000) gallons for water furnished by the City to the Wheeler Unit and Formby
Unit pdson facilities. This rate is guaranteed for five (5) years, said period to begin after
the facility begins to accept inmates; thereafter, charged rates will be equal to the rates
charged commercial customers inside the City limits. The date the Wheeler Unit will
change rates is March 20, 2000. The date the Formby Unit will change rates is
September 6, 2001.
Effective Date: This ordinance shall be effective with the billings after April 1,
1997.
