ORDINANCE NO. 97-3110
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS,
GRANTING A FRANCHISE FOR A NON-EMERGENCY
TRANSFER AMBULANCE SERVICE TO AID AMBULANCE
AND CANCELING THE FRANCHISE WITH PLAINVIEW
AMBULANCE SERVICE.
WHEREAS, the City of Plainview, Texas has provided for a private transfer ambulance service to
exist within the corporate limits of the city by Chapter Four, Article III of the Plainview Code; and
WHEREAS, Aid Ambulance has submitted an application in accordance with the terms of Chapter
Four, Article III of the Plalnview Code for a private, non-emergency, transfer ambulance service; and
WHEREAS, the City Council of the City of Plainview held public hearings on February 20, 1997 and
March 11, 1997, in accordance with Section 4-25 of the Plainview Code to determine the public
convenience and necessity justifying the granting of a franchise, determining whether the applicant
is qualified to render good service and whether the applicant has, or will have, sufficient equipment;
and
WHEREAS, the City Council of the City of Plainview has found sufficient and justifiable public
convenience and necessity for the granting of a non-exclusive, non-emergency transfer ambulance
service to Aid Ambulance Service within the City of Plainview, Texas, that:
SECTION I
Aid Ambulance Service is hereby granted a non-exclusive, non-emergency, transfer ambulance service
franchise under the terms and conditions as set forth in Article IH, Chapter 4, of the Plainview Code,
as amended.
SECTION II
The Schedule of Rates to be charged is attached hereto as "Exhibit A" and by reference, wholly
incorporated into this ordinance. Any changes in the rates set forth in Exhibit "A" are subject to the
provisions of Chapter Four, Article III, of the Plainview Code, as amended.
SECTION HI
The granting of this franchise does not surrender any government powers not presently nor hereafter
conferred upon the City.

SECTION IV
This franchise is not transferrable.
SECTION V
Aid Ambulance will indemnify and hold harmless the City against all claims arising out of grantees
actions under this franchise.
SECTION VI
This franchise shall not become effective until grantee files with the city secretary's office written
acceptance of this ordinance and the franchise granted herein.
SECTION VII
The term of the franchise granted by this Ordinance is three (3) years. Said term is subject to the
provisions of Chapter Four, Article III, of the Plainview Code as amended.
SECTION VIII
Aid Ambulance agrees to perform any further acts or execute or deliver subsequent documents which
are necessary to carry out the provisions of this Agreement.
SECTION IX
The City of Plainview may terminate this agreement at any time if it finds that Aid Ambulance is not
complying with the terms of this agreement.
SECTION X
Aid Ambulance will provide service to all who request such, regardless of ability to pay.
SECTION XI
To the extent that the provision of any existing City Ordinance or Ordinances inconsistent with the
provisions of this Ordinance, such inconsistent provisions are hereby amended to conform herewith.
SECTION XII
Chapter Four, Article IV, of the City of Plainview Code is repealed in its entirety.
