HomeMy WebLinkAbout96-3107 (2)CABLE FRANCHISE ORDINANCE NO. 96-3107 AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 81-2474; EXTENDING THE DURATION AND ACCEPTANCE OF A NONEXCLUSIVE FRANCHISE WITH TELESERVICE CORPORATION OF AMERICA, D/B/A PLAINVIEW CABLE TELEVISION, FOR ONE (1) YEAR; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, the Agreement between the City of Plainview and Teleservice Corporation of America, d/b/a Plainview Cable Television, expires on the 12th day of January, 1997; and WHEREAS, negotiations for a new long-term agreement between the City of Plainview and Teleservice Corporation of America have not been completed; and WHEREAS, the City Council of the City of Plainview wishes to continue the current Agreement for a period not to exceed one (1) year from the effective date of this Ordinance so that negotiations may be continued; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview that Section 5 of Ordinance No. 81-2474 shall be and is hereby amended to read as set forth herein: SECTION I Section 5. Duration and Acceptance of Franchise The franchise and the rights, privileges and authority hereby granted shall take effect and be in force from and after final passage thereof, as provided by law, and shall continue in force and effect for a term of one (1) year after the effective date of this Ordinance. SECTION II Provisions of this Ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other Ordinances restricting, regulating, or governing the subject matter herein. SECTION III All Ordinances or portions of any Ordinance of the City of Plainview, Texas, in conflict herewith are hereby amended to conform with the provisions hereof. 1 of 2 SECTION IV Should any section, subsection, or any portion hereof, be deemed invalid for any reason, such holding shall not render or invalidate any other section, subsection, sentence, provision, clause, phrase, or word severable therefrom, and the same shall be deemed severable for this purpose. SECTION V This Ordinance shall be of full force and effect upon its passage and publication as required by law. Presented and given first reading on the 14 day of January, 1997, at a regular meeting of the City Council of the City of Plainview, Texas. Presented and given second reading and PASSED AND APPROVED this 28 day of January, 1997, by a vote of 8 ayes and no nays at a regular meeting of the City Council of the City of Plainview, Texas.
