RESOLUTION R14 -317
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF PLAINVIEW MAIN STREET
PROMOTIONS COMMITTEE AND PLAINVIEW DOWNTOWN
ASSOCIATION TO HOST THE "2014 JULY 4 FREEDOM PARADE ";
AUTHORIZING THE FILING OF THE AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY WITH THE
TEXAS DEPARTMENT OF TRANSPORTATION FOR THIS EVENT;
DECLARING THAT THE EVENT SERVES A PUBLIC PURPOSE; AND
AGREEING TO COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates U.S.
Highway 70 (5 Street) in the corporate limits of the City of Plainview; and
Whereas, the U.S. Highway 70 crosses Broadway Street within the incorporated
limits of the City of Plainview; and
Whereas, the intersection of U.S. Highway 70 and Broadway Street is the critical
vein for parade use; and
WHEREAS, the City of Plainview received a request from the Plainview Main
Street Promotion Committee and the Plainview Downtown Association on May 21, 2014
for police assistance in its 2014 July 4 Freedom Parade; and
WHEREAS, the 2014 July 4 Freedom Parade will begin at 11:00 a.m. at the
Santa Fe Depot, going South on Broadway Street and will be ending in Broadway Park
at 12:45 pm; and
WHEREAS, the City Council of the City of Plainview finds that such event serves
a public purpose in that it increases the public awareness in the importance of our
history and our Nation's freedom; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that the 2014 July 4 Freedom Parade be held this
year on Friday, July 4, 2014 and use the above referenced route; and
WHEREAS, the Texas Department of Transportation requires the local
government to submit a completed Agreement for the Temporary Closure of State
Right -of -Way for use of U.S. Highway 70 (5 Street) in such public events as this 2014
July 4 Freedom Parade; and
WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or terminate
such Agreement on behalf of the City.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainview that:
The request from the Plainview Main Street Promotions Committee and the
Plainview Downtown Association for the 2014 July 4 Freedom Parade for July 4th,
2014 is hereby approved.
The public purpose of this event is to increase the public awareness in the
importance of our history and to celebrate our Nation's freedom.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby
approved.
The Mayor is hereby authorized and directed to execute, respectively, on behalf
of the City of Plainview, all necessary documents, including the AGREEMENT FOR
THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY to complete the Plainview
Main Street Promotions Committee and the Plainview Downtown Association "2014 July
4 Freedom Parade" preparation process.
