Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 5:30 p.m. on April 16, 2003. Mayor Mary Jane Shanes
presided. Councilmembers present were: Kelvin Tipton-District 1, Belinda Pena-District
3, John N. Bertsch-District 4, Ross Owen-District 5, and Buddy McGehee-District 6.
Councilmember Irene Favila-District 7 was absent.
Staff members present were: James P. Jeffers-City Manager, Dale Simpson-Civil
Service Director, Wally Hatch-City Attorney, Will Mull-Police Chief, John Berry-Director
of Public Works, John Castro-Director of Community Development, Jason Thompson-
Main Street Coordinator and Belinda Hinoiosa-City Secretary.

Councilmember McGehee delivered the invocation.
Mayor Shanes led in the Pledge of Allegiance.
Councilmember McGehee moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Tipton and carried by unanimous vote. Items approved
on the Consent Calendar included: approval of the minutes of April 8, 2003 and April
17, 2003; receipt of departmental reports; and approval of expei~ditures.' The Council
granted an excused absence to Irene Favila. The Council approved upon second
reading, an Ordinance of the City of Plainview Amending Ordihance No. 02-3350 To
Appropriate Funds From the General Fund for Election Expenses; Cumulativeness
Clause; Conflicts Clause; Severability Clause; Effective Date. ThiS Ordinance
appropriates $4,500 for election expenses for the special election to be held on May 3,
2003 for the election of a Mayor due to the death of Mayor Lloyd C. Woods. The
Council approved upon second reading Ordinance No. 03-3376, an Ordinance of the
City of Plainview, Texas Amending Chapter 6, Buildings, of the Plainview Code of
Ordinances Severability Clause; Cumulativeness Clause; Conflicts Clause; And
Effective Date. Said Ordinance would amend the Code of Ordinance to include
adoption of Appendix Chapter 34 of the Uniform Building Code along with Volumes 1, 2
and 3, which were already adopted. The Council approved the appointment of Glenn
D. Bickel to the Board of Adjustment for a term to expire on January 1, 2005. The
Council approved upon second reading, Ordinance No. 03-3377, an Ordinance of the
City of Plainview, Texas Designating A Portion of FM 3466 (SW 3rd Street) 500 Feet
West and 500 Feet East of Ennis Street as a School Zone; Providing For a Penalty;
Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Per
the request of the Plainview Christian Academy and a concerned citizen, TxDOT has
installed flashing beacons for a new reduced speed limit school zone on FM 3466 (SW
3rd). The reduced speed during flashing operation is 35 mph. This ordinance
establishes the new limits of the school zone and the 35 mph speed limit during times
the flashing beacons are in operation. The Council approved upon first reading,
Ordinance No. 03-3381, an Ordinance Of the City of Plainview, Texas Amending
Ordinance No. 02-3350 to Appropriate Funds in the Solid Waste Management Fund in
the 2002-2003 Budget For Matching Grant Fund to Purchase a Trommel Screening
Machine; Cumulativeness Clause; Conflicts Clause; Severability Clause; Effective
Date. In-kind funding for.composting grant was originally $12,000. The grant amount of

$58,000 has been reduced by 10%, necessitating an additional $5,800. This budget
amendment would appropriate the projected $12,000 plus an additional $5,800 for the
purchase of a Trommel Screening Machine.
Item No. 4, Ordinance No. 03-3378, an Ordinance Amending the Zoning Map of the City
of Plainview By Issuance of a Specific Use Permit to Operate an Arcade in a Central
Business (CBD) Zoning District Said Parcel Being AB 516 Pre E L Lowe 65'x75' .12
Acres, Same Being 1001 Broadway; Cumulativeness Clause; Conflicts Clause;
Severability Clause; And Effective Date has been withdrawn.
John Castro, Director of Community Services, presented for first reading Ordinance No.
03-3379, an Ordinance Amending The Zoning Map Of The City Of Plainview By Issuance
Of A Specific Use Permit To Operate A Furniture Store In A Commercial Retail (C-2)
Zoning District Said Parcel Being East 155.31' Of Lot 1, First National Plaza Addition,
Same Being 2601 Olton Road; Cumulativeness Clause; Conflicts Clause; Severability
Clause; And Effective Date. Joe McFarland (Showcase Home Furnishings) has applied
for a specific use permit to operate a furniture store at 2601 Olton Road in a
Commercial Retail (C-2) Zoning District. If the property were zoned C-3, a specific use
permit would not be required.
There was no public comment.
Councilmember Owen moved that Ordinance No. 03-3379, be approved upon first
reading. The motion was duly seconded by Councilmember Pena and carried
unanimously.
John Castro presented for first reading Ordinance No. 03-3380, an Ordinance
Amending the Zoning Map of the City of Plainview By Issuance of a Specific Use Permit
to Operate an Arcade in a General Commercial (C-3) Zoning District Said Parcel Being
AB 1472 Block JK-2 Sec 28 Out Of NE/4 40'x300' 40' FAC Hwy Beginning 70' East Of
Congress Inn, Same Being 3416 Olton Road; Cumulativeness Clause; Conflicts
Clause; Severability Clause; And Effective Date. (Ordinance No. 03-3380 - First
Reading). Betty Payne, a resident of Wolfforth, has applied for a specific use permit to
operate an arcade (6 or more machines of skill or chance) at 34:16 Olton Road. Mrs.
Payne has indicated if approved she will have 36 machines. She is fully aware of the
recent Attorney General opinion regarding eight liners. Mr. Castro stated since there
are already two arcades in this zoning area, if such is approved City ordinance would
not allow approval of any more specific use permits for arcades in this area.
Councilmember Owen moved to adopt upon first reading, Ordinance No. 03-3380. The
motion was duly seconded by Councilmember Tipton and carried unanimously.
John Berry, Director of Public Works presented the request of Maurice and Loretta
Hastey regarding Farmer's Place, Replat of Lot 1, Plainview, Hale County, Texas. Since
City ordinance does not allowing a portion of a lot to be sold, such is being requested so
that a portion of the property can be sold. The Planning and Zoning Commission
recommends approval of the replat.

Councilmember Bertsch stated the building on part of the property appeared to be an
eyesore and such should be looked at to make sure such is in compliance with City
ordinance.
Councilmember Owen moved to accept Farmer's Place, Replat of Lot 1, Plainview, Hale
.County, Texas. The motion was duly seconded by Councilmember Shanes and carried
unanimously.
Item 8, Plainview Housing Authority Annual Report was tabled until the next meeting.
