The Plainview City Council met on June 24, 2003 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 4:30 p.m. on June 16, 2003. Mayor John C. Anderson
presided. Councilmembers present were: Mary Jane Shanes-District 2, Belinda Pena-
District 3, John N. Bertsch-District 4, Ross Owen-District 5, Buddy McGehee-District 6
and Irene Favila-District 7. Councilmember Kelvin Tipton-District 1 was absent.
Staff members present were: James P. Jeffers-City Manager, Wally Hatch-City
Attorney, John Castro-Director of Community Services, John Berry-Director of Public
Works, Dale Simpson-Director of Civil Service, Dennis Harkins-Police Captain, Jason
Thompson-Main Street Coordinator, and Belinda Hinojosa-City Secretary.

Guests present were:
Jacob Rogers
Jarret Koenning, Tommie McMillan, Jimmy Rogers and
Rev. Horace Abbott delivered the invocation.
Jacob Rogers with Pack 206 Webelos Den led in the Pledge of Allegiance.
Mayor Anderson presented a Certificate of Recognition to Tommie McMillan on behalf
of the Optimist League.
Councilmember Shanes moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Favila and carried by unanimous vote. Items approved on
the Consent Calendar included: approval of the minutes of June 10, 2003 and June
19, 2003; receipt of departmental reports; approval of expenditures and granting an
excused absence to Councilmember Kelvin Tipton. The Council approved upon
second reading, Ordinance No. 03-3384, an Ordinance of the City of Plainview, Texas
Amending Ordinance No. 02-3350 to Appropriate Funds in the Swimming Pool Fund
in the 2002-2003 Budget For Repairs to the Swimming Pool Sewer Line;
Cumulativeness Clause; Conflicts Clause; Severability Clause; Effective Date. The
Council approved upon second reading, Ordinance No. 03-3385, an Ordinance of the
City of Plainview, Texas Amending Ordinance No. 02-3350 to Appropriate Funds in the
Water Distribution in the 2002-2003 Budget for Repairs to a Caterpillar Backhoe;
Cumulativeness Clause; Conflicts Clause; Severability Clause; Effective Date. The
Council approved the Reciprocal Governmental Agreement between Hale ' County
and the City of Plainview. The agreement pertains to .the housing of inmates, municipal
court arraignments, animal control and police emergency assistance. The Council
chose to reject all bids on the ambulance bids.
Director of Community Services John Castro presented for first reading Ordinance No.
03-3386, an Ordinance of the City of Plainview, Texas, Hale County, Texas Amending
Section 8:37 Radio, Television, and Microwave Towers Regulations of the Zoning
Ordinance 89-2798; Regarding Requirements for Location of Radio, Television and
Microwave Towers; Cumulativeness Clause; Conflicts Clause; Severability Clause; and
Effective Date. Mr. Castro stated this would clear up the discrepancy in the regulations
of the Zoning Ordinance as it pertains to municipal government and state government.
This ordinance was presented to the Planning & Zoning Commission who
recommended approVal of this ordinance.

There was no public comment.
Councilmember Irene Favila moved that Ordinance No. 03-3386 be approved upon first
reading. The motion was duly seconded by Councilmember Owen and carried
unanimously.
Mr. Castro presented for first reading Ordinance No. 03-3387, an Ordinance Amending
the Zoning Map of the City of Plainview by Issuance of a Specific Use Permit to Operate
a Private Club/Arcade in a Commercial Retail (C-2) Zoning District Said Parcel Being
AB 500 Block JK-2 N40 160'x169.25' Tr 18-A-4, Same Being 600 West 5th Street;
Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. Mr.
Castro stated that Robert Moore had applied for a specific use permit to operate a
private club at 600 W. 5th Street. Mr. Castro stated that the Planning & Zoning
Commission had looked at the ordinance and stated the building and area needs to be
maintained as requested in the previous specific use permit. Mr. Castro advised that if
requirements are not met, then the specific use permit could be pulled.
There was no public comment.
Councilmember Owen stated it needed to be reflected in the minutes that the Council
was not voting on.the morals on the consumption of alcohol, but strictly on the specific
use permit.
Councilmember Owen moved to adopt Ordinance No. 03-3387 upon first reading. The
motion was duly seconded by Councilmember Pena. Mayor Anderson, Councilmember
Shanes, Pena, Owen, McGehee and Favila voted "for" the motion and Councilmember
Bertsch voted "against." The motion carded.
Items 6 Closed Meeting to deliberate the appointment, employment, evaluation,
reassignment or duties, removal, discipline or dismissal of a public officer or employee,
board, commission, or committee member, or to hear complaints or charges. [Tex.
Gov't. Code Section 551.074]. City Manager was pulled from the agenda.
Item 7 to consider possible action regarding City Manager was pulled from the agenda.
Councilmember Shanes moved the meeting be adjourned. The motion was duly
seconded by Councilmember Owen and carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 7:17 p.m.
