HomeMy WebLinkAbout03 0812 min1 ~ ~ The Plainview City Council met on August. 12, 2003. at 7:00. p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting. was posted in City Hall at 9:30 a.m. on August 5, 2003. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Mary .Jane Shanes- District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Ross .Owen-District 5, and Buddy McGehee-District 6. Councilmember Frene Favila-.District 7 was absent. Staff members present were: Wally Hatch-Interim City. Manager,. John Castro-Director of Community Services,. John Bel-ry-,Director. of .Public Works,. Will.. Mull-Police Chief, Jason Thompson-Main Street Coordinator, Elizabeth Regner--Assistant City Manager, Dale Simpson-Director of Civil Service, Gary Glass-Fire Chief and Belinda Hinojosa-.City Secretary. Guests present were: Charlene Osborne, .Marvin Osborne.,: James Odom, Annette Odom and Gene Whitfill Rev. Steve Martinez .from Nueva Vida/New Life Assembly of God delivered the invocation. Kylan Riley, Pack 206, Webelos Den led in the Pledge of Allegiance. Councilmember McGehee moved to adopt the consent calendar. The motion was duly seconded by Counclmember Owen and carried by unanimous vote. Items approved on the Consent Calendar included:. approval of .minutes. of July 22, 2003_ and. August 7, 2003; receipt of .departmental reports; approval of expenditures and granting an excused absence to Councilmember Irene Favila. The Council approved the award of mosquito insecticide bids to Vopak of Dallas, Texas at a ..cost of $19.18 per. gallon. One other bid was received and that was from. Cheminova Inc. of Wayne, New Jersey in the .amount of $.19.95 per gallon. The Council. approved the reappointment of Norman Wright to the Canadian River Municipal Water .Authority with a term to expire on August 31, 2005. The Council approved upon second reading, Ordinance No. 03-3393,. an Ordinance Amending the Zoning. Map of the City Of Plainview, Texas For Rezoning From. Agricultural (A) And .Retail. (C-2) Zoning District, To Commercial General Business (C-3) Zoning District Said Parcel Being Tract 29.739 Ac out of Sec27 Block JK-2, Same Being 1400 And 1500 Block Of North Interstate Highway- 27, Plainview, HHale .County, Texas, Cumulativeness Clause;' Conflict Clause; Severability Clause; And ,Effective Date. Mr. John Castro, Director of Community Services .presented for second reading., Ordinance No. 03-3388, an ordinance amending the zoning map of the City of Plainview by issuance of a specific use .permit.. to erect a communication..tower in a single family residential (R-2) zoning. district, said parcel being Lots 9-12, Block 24, College Hill Addition, same being 912 Portland Street, cumulativeness clause; .conflicts clause; severability clause; and effective date. AMA TechTel Communications filed;. on behalf of PISD, for a Specific Use Permit to erect a' communication tower at 912 .Portland for their internal use to transmit data from school to school Two responses were received, and all were in favor of the specific use permit. Mayor Anderson asked for public comment. Marvin Osborne, who resides at 308 W. Alpine stated he was concerned with the whole package. He felt they should all be tabled and sent back to the Planning & Zoning Commission. He stated the package. was different than that sent to the zoning commission. Councilmember Owen asked ifthere was any difference in height or location? -Mr. Castro stated it was originally posted at a height of 64 feet, but has. since been lowered to 56 feet. Councilmember .Pena asked if everyone had been initially notified. Mr. Castro stated everyone within 200 feet was notified. Councilmember Owen moved to adopt upon second reading Ordinance No. 03-3388. The motion was duly seconded. by Councilmember Pena and carried unanimously. Mr. Castro presented for first reading, Ordinance No. 03-3389, an ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential {R-2) zoning district, said parcel being all of Block27; Lakeside Addition, Same being 1800,Joliet Street; cumulativeness clause; conflicts clause; severability- clause; and effective date. Mr. Castro stated he had gone back and corrected the procedure for notification of property owners located within 200 feet. Five responses were received and all were in favor. There was no public comment. Councilmember Tipton moved that Ordinance No.,03-3389 be adopted upon first reading. Themotion was duly seconded by Councilmember Owen and carried unanimously. Mr. Castro presented for first reading, Ordinance No. 03-3390, an ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential (R-2) zoning district, said parcel being Block 12, Lots 4-16, Block 13 & 15, Block 14, Lots 12-15, Block 16, Lots 18-24, West Hillcrest Addition, same being 315 SW Alpine. Drive; cumulativeness clause; conflicts clause; severability clause; and- effective .date. Mr. Castro stated some places had been missed and he had gone and renotified everyone. Initially, two responses were received against the specific use permit. No new responses were received. Mayor Anderson asked for public comment. Marvin Osborne stated he was totally against the project. Charlene Osborne of 308 SW Alpine stated her. concern was that at the Planning & Zoning Commission meeting it was presented as a package and was voted as a package. Council is voting as a separate item. Wally Hatch, Interim City. Manager/City Attorney stated it was not uncommon for the Planning & Zoning Commission to look at items such as this as a package. The Commission's job is to make a recommendation to the Council, with the Council having final say. Councilmember Shanes asked if everyone had been renotified. Mr. Castro stated yes, two ~.:- ~. were against and none were in favor. The Council was also advised that AMA Tech Tel had aletter-from FAA stating the FAA did not have a problem with the towers. -_~ Councilmember Owen moved that Ordinance No. 03-3390 be approved upon first reading. Mayor Anderson, Councilmember Tipton, Pena, Bertsch, Owen, and McGehee <voted "for" the a motion. Councilmember Shanes voted "against" the motion. The motion carried. Mr. Castro presented for first reading Ordinance No. 03-3391, an ordinance amending the. zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower. in a single family residential (R-1) zoning district, said parcel being Block 88, South -10 acres of Block 89, College HiIL Addition, same being 707 Canyon Street; cumulativeness clause; conflicts clause;. severability clause; and effective-date. Mr. Castro stated some folks were. originally missed in this area, but all were, renotified. The first time around one response was received in-favor and two were against. The. second time around four responses were received with three in favor and one against{had responded previously). Mr. Castro said the tower at this school had been installed .in error due to a misunderstanding of one of the subcontractors, but was immediately-taken down. There was no public comment.. Councilmember McGehee' moved. that Ordinance No. 03-3391 be adopted upon first reading. The motion was duly seconded by Councilmember Owen and carried unanimously.` Mr. Castro presented for first reading Ordinance No. 03-3392, an ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential (R-2) zoning. district, said parcel being AB 1956 Block JK-2 Sec 38 12.6 acres out of NW4, same being 1200'W. 32"d Street; cumulativeness clause; conflicts clause; severabilityclause; and effective date. Mr. Castro stated again his office failed to notify some folks, but all were renotified. Four individuals responded in favor of the specific use permit. There was no public comment. Councilmember Pena moved that Ordinance 03-3392 be approved upon first reading. The motion was duly seconded by Councilmember Tipton and carried unanimously. Councilmember Owen moved the meeting be adjourned. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote.
