HomeMy WebLinkAbout03 0826 minThe Plainview City Council met on August 26, 2003 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:30 p.m. on August 20, 2003. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes- District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Ross Owen-District 5, Buddy McGehee-District 6 and Irene Favila-District 7. Staff members present were: Wally Hatch-Interim City Manager/City Attorney, John Castro-Director of Community Services, John Berry-Director of Public Works, Will Mull- Police Chief, Jason Thompson-Main Street Coordinator, Elizabeth Regner-Assistant City Manager, Dale Simpson-Director of Civil Service, Gary Glass-Fire Chief, Jack Keller-Budget Manager, Rusty Reese-Parks Superintendent and Belinda Hinojosa-City Secretary. Guests present were: Gene Whitfill, Kay Harris, Vickie Gray, Rusty Gray, Nikki McCarthy, Dr. Travis Hart, Helen Fields, Steve Hurt, Melvin Ritter, Marvin Graham, Ron Roberts Dr. Travis Hart from First Baptist Church delivered the invocation. The Mayor led in the Pledge of Allegiance. Councilmember Shanes moved to adopt the consent calendar. The motion was duly seconded by Councilmember Owen and carried by unanimous vote. Items approved on the Consent Calendar included: approval of minutes of August 12, 2003 and August 21,2003; receipt of departmental reports; and approval of expenditures. The Council approved $25,000 to be spent on park improvements as recommended by the Parks Advisory Commission. $12,500 will be spent on a walking track in the John D. Stoneham Park and $12,500 for a pedestrian crossing at 7th Street Park. The Council approved accepting the Local Law Enforcement Block Grant 2003 in the amount of $13,500 and for the expenditure of funds from the Federal Shares seizure income fund of $1,350.00 from the City of Plainview 2002-2003 budget. Since the County did not spend their portion of last year's grant, they were ineligible to receive a grant this year. The City was awarded the full grant. Mayor Anderson moved to open a public hearing on the 2003-2004 City of Plainview budget. The motion was duly seconded by Councilmember Tipton and carried unanimously. Mayor Anderson asked for public comment. Nikki McCarthy from the Humane Society expressed concern with the City cutting the kennel master position. She said the City has two wonderful officers and was afraid they would lose interest in the position with the extra workload. The City is currently using the assistance of community service workers and .probationers to clean the kennels, but she still felt the brunt of the cleaning would be done by the officers. Helen Fields, Director of the Hale County Crisis Center was present t° request $10,000 from the City to assist in continuing to provide services to the senior citizens. 20],: City of Plainview Minutes August 26, 2003 Page I of 7 'Rusty Gray, Director of Parent's Place Family Resource.' Center asked the Council for $5,000 to assist with their services. Kay Harris, Executive Director of the Hale County Crisis Center stated they requested $2,500 for the battering intervention prevention program. Since the Council last year asked her to try to find other funding sources, she applied for a grant from the Criminal Justice Division. She found out a few days ago that they had been awarded the grant; therefore she cannot accept any funding from the City for this program, but would however accept this money for one of her other programs. Since there was no further public comment, Councilmember Owen moved to close the public hearing. The motion was duly seconded by Councilmember Favila and carried unanimously. Mayor Anderson closed the public hearing at 7:16 p.m. Mayor Anderson introduced for second reading Ordinance No. 03-3389, an Ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential (R-2) zoning district said parcel being all of Block 27, Lakeside Addition, same being 1800 Joliet Street; cumulativeness clause; conflicts clause; severability clause; and effective date. There was no staff briefing since this was the second of two readings. Mayor Anderson asked for public comment. There was no public comment. Councilmember McGehee moved to adopt Ordinance No. 03-3389 upon second reading. The motion was duly seconded by Councilmember Pena and carried unanimously. Mayor Anderson introduced for second reading Ordinance No. 03-3390, an Ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential (R-2) zoning district said parcel being Block 12, Lots 4-16, Blocks 13 & 15, Block 14, Lots 12-15, Block 16, Lots 18- 24, West Hillcrest Addition, same being 315 SW Alpine Drive; cumulativeness clause; conflicts clause; severability clause; and effective date. Since this was the second of two readings, the Council chose to forego the staff briefing. Mayor Anderson asked for public comment. There was no public comment. Councilmember Favila moved to adopt Ordinance No. 03-3390 upon second reading. The motion was duly seconded by Councilmember Tipton. Mayor Anderson, Councilmembers Tipton, Pena, Bertsch, Owen, McGehee and Favila voted "for" the motion. Councilmember Shanes voted "against" the motion. The motion carried. Mayor Anderson introduced Ordinance No. 03-3391, an Ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential (R-l) zoning district said parcel being Block 88, South 10 Acres of Block 89, College Hill Addition, same being 707 Canyon Street; cumulativeness clause; conflicts clause; severability clause; and effective date. The motion was duly seconded by Councilmember McGehee and carried unanimously. Mayor Anderson introduced upon second reading Ordinance No. 03-3392, an Ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to erect a communication tower in a single family residential (R-2) zoning district said parcel being AB 1956 Block JK-2 Sec 38 12.6 Acres Out of NW4, same being 1200 W 32"d Street; cumulativeness clause; conflicts clause; severability clause; and effective date. Since this was the second of two readings, the Council chose to forego the staff briefing. Mayor Anderson asked for public comment. There was no public comment. Councilmember Favila reading. The motion unanimously. moved that Ordinance No. 03-3392 be approved upon second was duly seconded by Councilmember Owen and carried John Castro, Director of Community Services introduced for first reading Ordinance No. 03-3394, an Ordinance amending the zoning map of the City of Plainview by issuance of a specific use permit to operate a small animal veterinary clinic (with no outside pens) in a retail (C-2) zoning district said parcel being Lot 2 (.75 acres), Westridge Unit fl4, same being 201 South Interstate Highway 27; cumulativeness clause; conflicts clause; severability clause; and effective date. Mr. Castro stated Dr. Blaine Long proposed to move his small animal vet clinic to this location. The area has eleven parking spaces. No responses were received; he did however receive several tele phonic inquiries. Mayor Anderson asked for public comment. Dr. Blaine Long veterinary clinic. more efficiently. stated he was asking for the specific use permit to build a small animal He would own this property and felt this would allow him to do his job There was no further public comment. Upon questioning from Council, Dr. Long stated he planned to renovate the building and planned to plant some grass and trees on the North side. Councilmember McGehee moved to adopt Ordinance No. 03-3394 upon first reading. The motion was duly seconded by Councilmember Shanes and carried unanimously. Wally Hatch, Interim City Manager stated the remaining Ordinances were to increase the charge for several permit fees. The proposed increases would only generate an additional $41,000 in the general fund. Such increases would not bring any additional revenue, but would assist in meeting the City's cost to provide such services. Mayor Anderson introduced Ordinance No. 03-3397, an Ordinance amending chapter 20, plumbing, of the City of Plainview Code of Ordinances; providing for an amendment to Section 20-99, permit and inspection fees, to amend fees to be charged and collected; cumulativeness clause; conflicts clause; severability clause, and effective date. There was no public comment. Councilmember Owen moved that Ordinance No. 03-3401 be approved upon first reading. The motion was duly seconded by Councilmember Shanes and carried by unanimous vote. Mayor Anderson moved the Council go into closed session for discussion of pending or contemplated litigation. {Meridian Alliance Group, LLC} This meeting is authorized by TEX: GOV. CODE ANN. 551.071 (Vernon 1994). The motion was duly seconded by Councilmember Favila and carried by unanimous vote. Mayor Anderson recessed the meeting into closed session at 7:40 p.m. The Council reconvened in open session at 7:57 p.m. Wally Hatch, Interim City Manager/City Attorney asked the Council to authorize him to settle the lawsuit with Meridian Alliance involving the Plainview Independent School District and Hale County and to pay the City's portion of fees currently owed.
