HomeMy WebLinkAbout14 0708 Council minutes336 The Plainview City Council met on July 8, 2014 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:00 p.m. on July 3, 2014. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, and Lionel Garcia -District 6. Councilmember Eric Hastey-District 7 was absent. Staff members present were: Jeffrey Snyder -City Manager, Leslie Pearce -City Attorney, Ken Coughlin -Police Chief, Rusty Powers -Fire Chief, lsauro Gutierrez - Information Technology Specialist, Rusty Reese -Parks Superintendent, Sarianne Beversdorf-Director of Finance and Belinda Hinojosa-City Secretary. Guests Present: Beverly McCaskill News Media Present: Homer Marquez -Plainview Herald and Caleb Hatch= Plainview Radio Councilmember Norma Juarez delivered the invocation and led in the pledge of allegiance. Councilmember Larry Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Norma Juarez. Items approved on the consent calendar were the granting of an excused absence to Councilmember Eric Hastey; approval of the minutes of June 13, 14, 15, 16 and 24, 2014; approval of Resolution R14-319, a Resolution of the City of Plainview, Texas Adopting an Updated Park, Recreation, And Open Spaces (Pros) Comprehensive Master Plan for The City Parks System. Councilmember Charles Starnes moved to amend the minutes of June 24, 2014 regarding the discussion on the Economic Development Corporation report on page 2 to state that "some members expressed concern" rather than the "Council expressed concern". The motion was duly seconded by Councilmember Larry Williams. Mayor asked for a vote on the matter. The motion carried by unanimous consent. Councilmember Starnes recognized Richard Purcell's contributions to the city; he established a wonderful partnership with the city; namely his work on the City's disk golf course. He also recognized the excellent cooperation that private groups get from the park's department as they work on these types of projects that help implement the comprehensive plan. He applauded the excellent work of the Parks Department as well as the initiative of various groups within the city who contribute to the recreation and amenities of our town. Mayor Dunlap asked for a vote on the original amended motion. The motion carried by unanimous vote. Mayor Dunlap moved to present Ordinance No. 14-3610 on second reading, an Ordinance Annexing the Hereinafter Described Territory to the City of Plainview, Hale County, Texas, and Extending the Boundary Limits of Said City so as to Include Said Hereinafter Described Property Within Said City Limits, and Granting to all the Inhabitants of Said Property all the Rights And Privileges Of Other Citizens And Binding City Council Minutes July 8, 2014 Page 1 of 3 Said Inhabitants by all of the Acts, Ordinances, Resolutions, and Regulations of Said City; Adopting a Municipal Service Plan; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 14-3610 on second reading. The motion was duly seconded by Mayor Pro Tem King and carried by unanimous vote. Mayor Dunlap presented for consideration Ordinance No. 14-3611, an Ordinance Amending Article 13.05, Water Conservation/Drought Contingency Plan, of the City of Plainview Code of Ordinances; Cumulativeness Clause; Repealer; Conflicts Clause; Severability Clause; And Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Starnes moved to amend ordinance as presented to amend Section 13.05.031(h) Specific Quantified 5 and 10 Year Targets to reflect the city's average daily water usage of 211 gallons per person per day vice the 220 as originally presented and to adjust the five and 10 year targets to 206 and 200 gallons per day. This is an editorial correction. The motion was duly seconded by Councilmember Blackerby. Councilmember Garcia commented that in order to get to the ten year goal of 200 gallons, he would challenge all on the Council to do what they can to help the City reach this goal; to provide some type of funding for retrofitting the facilities of the City. We need to take a more aggressive task to make everything more water efficient and also encourage our citizens to do the same at their homes in order to get to this 200 gallons target in the next ten years. Mayor Dunlap asked for a vote on the matter. The motion carried by unanimous vote. Councilmember Starnes moved to go into closed session to: 1. Deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. [Tex. Gov't. Code, Section 551.074]. Appointment to the Retired & Senior Volunteer Program Community Advisory Group; 2. Sec. 551.071 — Consult with attorney on a matter in which the attorney's duty to the government body under the Texas Disciplinary Rules of Professional Conduct conflicts with the open meeting statutes and about pending or contemplated litigation or settlement of same relating to Police Department; and 3. Deliberate the purchase, exchange, lease or value of real property, the public discussion of which would not be in the best interest of the City's bargaining position with third parties, in accordance with Tex. Gov't Code, Section 551.072. The motion was duly seconded by Councilmember Garcia and carried by unanimous vote. Mayor Dunlap recessed the meeting at 7:13 p.m. Mayor Dunlap called the meeting back in open session at 8:48 p.m. City Council Minutes July 8, 2014 Page 2 of 3 337 338 Councilmember Starnes moved to appoint Susan Blackerby as the Council Representative on the Retired Senior Volunteer Program Community Advisory Group. The motion was duly seconded by Councilmember Juarez. Mayor Dunlap asked for public comment. There was no public comment. The motion carried by unanimous vote.
