HomeMy WebLinkAbout14 0722 Council minutesThe Plainview City Council met on July 22, 2014 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:30 p.m. on July 16, 2014. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, Lionel Garcia -District 6 and Eric Hastey-District 7. Councilmember Larry Williams -District 2 was absent. Staff members present were: Jeffrey Snyder -City Manager, Leslie Pearce -City Attorney, Dennis Harkins -Police Captain, Rusty Powers -Fire Chief, Isauro Gutierrez - Information Technology Specialist, Sarianne Beversdorf-Director of Finance and Belinda Hinojosa-City Secretary. News Media Present: Doug McDonough -Plainview Herald and Caleb Hatch- Plainview Radio Mayor Pro Tem Teressa King delivered the invocation and led in the pledge of allegiance. Councilmember Susan Blackerby moved to approve the consent calendar. The motion was duly seconded by Councilmember Charles Starnes. Items approved on the consent calendar were the granting of an excused absence to Councilmember Larry Williams; approval of the minutes of July 3 and 8, 2014; and approval of the Financial Reports. Jeffrey Snyder, City Manager presented for consideration on first reading, Ordinance No. 14-3612, an Ordinance Amending The Zoning Map Of The City Of Plainview, Texas For The Rezoning Of Parcels From An Agriculture ("A") Zoning District To A Commercial General Business ("C-3") Zoning District, Said Parcels Being 131.1 Feet By 150.6 Feet Out Of The Southeast Part .45 Acres Of The Pre L S Kinder - Abstract 638, Known As 609 Cr Y; And Block D-6 Out Of The Southwest Part Of Section 16, 5.5 Acres - Abstract 1688, Known As 614 Cr Y; And South Of Railroad 1 Acre Out Of The East Part Of Pre L S Kinder - Abstract 638, Known As 615 Cr Y, City Of Plainview, Hale County, Texas; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. On June 26th, the Planning and Zoning Commission reviewed Zone Case 851 the request of Randy Ware and Virginia Champion to rezone property from an Agriculture ("A") Zoning District to a Commercial General Business ("C-3") Zoning District. Mr. Ware is proposing to operate an irrigation supply store and retail shop at 609 and 615 County Road Y which is an allowed use in the C-3 Zoning District. Mrs. Champion operates Pete's Palladium at 614 County Road Y which currently is a legal non- conforming use in the Agriculture Zoning District, but will become an allowed use in a C- 3 Zoning District with approval of this zone case. The Commission has determined that this request met the criteria for rezoning and recommended approval to the City Council. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 14-3612 on first reading. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. City Council Minutes July 22, 2014 Page 1 of 2 341 342 Mr. Snyder presented for consideration on first reading Ordinance No. 14-3613, an Ordinance Amending The Zoning Map Of The City Of Plainview By Issuance Of A Specific Use Permit To Operate A Portable Building Sales Business In The Commercial General Business ("C-3") Zoning District, Said Parcels Being 609 Cr Y And 615 Cr Y, City Of Plainview, Hale County, Texas; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. On June 26th, the Planning and Zoning Commission reviewed Zone Case 852, the request of Randy Ware for a Specific Use Permit to operate a Portable Building Sales Business in the Commercial General Business ("C-3") Zoning District located at 609 and 615 County Road Y. Portable Buildings Sales is a permitted use in the Commercial General Business ("C-3") Zoning District through the specific use permit process. The Planning and Zoning Commission has determined that Mr. Ware has met all of the requirements of a specific use permit as specified in the Zoning Ordinance and recommended approval to the City Council Mayor Dunlap asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 14-3613 on first reading. The motion was duly seconded by Mayor Pro Tem King and carried by unanimous vote.
