The City Council met on September 4, 2003 at the Plainview Convention Center, 2902
West 4th Street, Plainview, Texas. The agenda for this meeting was posted in City Hall
at 11:30 a.m. on August 29, 2003. Mayor John C. Anderson presided.
Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes-District 2,
Belinda Pena-District 3, Ross Owen-District 5, Buddy McGehee-District 6 and Irene
Favila-District 7. Councilmember John N. Bertsch-District 4 was absent.
Staff members present were: Wally Hatch-Interim City ManagedCity Attorney, John
Castro-Director of Community Services, Jack Keller-Budget Manager, Jason
Thompson-Main Street Coordinator, Elizabeth Regner-Assistant City Manager, John
Berry-Director of Public Works, Brice Clements-Engineer/Assistant Director of Public
Works, Gary Glass-Fire Chief, Dale Simpson-Director of Civil Service and Belinda
Hinojosa-City Secretary.

Councilmember Belinda Pena delivered the Invocation.
The Council granted an excused absence to Councilmember Bertsch.
The Council and staff reviewed the agenda for the City Council meeting of September 9,
2003.
Wally Hatch, Interim City Manager presented Ordinance No. 03-3400, an ordinance
levying municipal ad valorem taxes for the City of Plainview, Texas, for the year 2003,
and directing the assessment and collection thereof; severability clause; cumulativeness
clause; conflicts clause; and effective date.
Mr. Hatch stated the proposed .02¢ on the one hundred dollars valuation of all property,
real, personal and mixed would generate $120,000 per year.
Mayor Anderson asked for public comment. There was no public comment.
Mayor Anderson moved to adopt Ordinance No. 03-3400. The motion was duly
seconded by Councilmember Tipton. Mayor Anderson, Councilmember Tipton, Pena,
Owen, McGehee and Favila voted "for" the motion. Councilmember Shanes voted
"against" the motion. The motion carried.
Mr. Hatch presented for first reading Ordinance No. 03-3402, an Ordinance of the City
of PlainvieW amending Chapter 25, Article II (Adjustment of Water Rates) entitled
"Rates and Charges" of the Code of the City of Plainview, Texas; cumulativeness
clause, conflicts clause, severability clause; and effective date. He stated that
Councilmember Pena and Councilmember Tipton had declared a conflict of interest and
would not be participating in the discussion or voting on the matter.

Mr. Hatch stated the staff's recommendation was Proposal 3.
Mr. Jack Keller, Budget Manager stated the reason for recommending Proposal 3 was
that Proposal 3 was the most predicable and would be easier to explain to the
customers.
Councilmember McGehee stated he would like to see the City adopt Proposal 1. This
amount would benefit the customers that use very limited water.
Councilmember McGehee moved to adopt Ordinance No. 03-3402 with Proposal 1.
The motion was duly seconded by Councilmember Favila. Councilmembers McGehee
and Favila voted "for" the motion. Mayor Anderson, Councilmember Shanes and Owen
voted "against" the motion. Councilmembers Tipton and Pena abstained due to a
conflict of interest. The motion failed.
Councilmember Owen~moved to adopt Ordinance No. 03-3402 with Proposal 3. The
motion was duly seconded by Mayor Anderson. Mayor Anderson and Councilmember

"against" the motion. Councilmembers Tipton and Pena abstained due to a conflict of
interest, The motion failed,
Councilmember Owen moved to adopt Ordinance No, 03-3402 with Proposal 3. The
motion was duly seconded by Mayor Anderson. Mayor Anderson, Councilmembers
Owen and Favila voted "for" the motion. Councilmember Shanes and McGehee voted
"against" the motion. Councilmembers Tipton and Pena abstained due to a conflict of
interest. The motion carried.
Councilmember Shanes moved the meeting be adjourned. The motion was duly
seconded by Councilmember Owen and carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 12:25 p.m.
