Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 2:30 p.m. on September 3, 2003. Mayor John C. Anderson
presided. Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes-
District 2, Belinda Pena-District 3, JOhn N. Bertsch-District 4, Ross Owen-District 5,
Buddy McGehee-District 6 and Irene Favila-District 7.

Staff members present were: Wally Hatch-Interim City ManagedCity Attorney, John
Castro-Director of Community Services, John Berry-Director of Public Works, Jack
Keller-Budget Manager, Dale Simpson-Director of Civil Service, Gary Glass-Fire Chief,

Councilmember McGehee moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Favila and carried by unanimous vote. Items approved on
the Consent Calendar included: approval of minutes of August 26, 2003 and
September 4, 2003; receipt of departmental reports; and approval of expenditures,
The Council approved upon second reading, Ordinance No. 03-3394, an Ordinance
Amending the Zoning Map of The City Of Plainview By Issuance Of A Specific Use Permit
To Operate A Veterinary Clinic (With No Outside Pens) In A Retail (C-2) Zoning District
Said Parcel Being Lot 2 (.75 Acres), Westridge Unit #4, Same Being 201 South Interstate
Highway 27; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective
Date. The Council approved upon second reading, Ordinance No. 03-3395, an Ordinance
Amending Chapter 6, Buildings, Of The City Of Plainview Code Of Ordinances;
Providing For An Amendment To Section 6-1, Building Permit Fees, To Amend Fees
To Be Charged And Collected; Cumulativeness Clause; Conflicts Clause; Severability
Clause, And Effective Date. The Council approved upon second reading, Ordinance
No. 03-3396, an Ordinance Amending Chapter 10, Electricity, Of The City Of Plainview
Code Of Ordinances; Providing For An Amendment To Section 10-92, Application For
Permit, To Amend Fees To Be Charged And Collected; Cumulativeness Clause;
Conflicts Clause; Severability Clause, And Effective Date. The Council approved upon
second reading, Ordinance No. 03-3397, an Ordinance Amending Chapter 20,
Plumbing, Of The City Of Plainview Code Of Ordinances; Providing For An
Amendment To Section 20-99, Permit And Inspection Fees, To Amend Fees To Be
Charged And ColleCted; Cumulativeness Clause; Conflicts Clause; Severability Clause,
And Effective Date. The Council approved second reading, Ordinance No. 03-3398, an
Ordinance Amending Chapter 19, Planning And Zoning, Of The City Of Plainview
Code Of Ordinances; Providing For An Amendment To Section 19-82, Amendments, To
Amend Fees To Be Charged And Collected; Cumulativeness Clause; Conflicts Clause;
Severability Clause, And Effective Date. The Council approved upon second reading,
Ordinance No. 03-3401, an Ordinance Amending Chapter 12, Food And Food
Handlers, Of The City Of Plainview Code Of Ordinances; Providing For An Amendment
To Section 12-34, Permit Fee, To Amend Fees To Be Charged And Collected;
Cumulativeness Clause; Conflicts Clause; Severability Clause And Effective Date.

Wally Hatch, Interim City Manager presented for second reading Ordinance No. 03-
3402, an Ordinance of the City of Plainview amending Chapter 25, Article II
(Adjustment of Water Rates) entitled "Rates and Charges" of the Code of the City of
Plainview, Texas; cumulativeness clause, conflicts clause, severability clause; and
effective date.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember McGehee moved the Council adopt a rate reflective to use. He moved
that section 25.41 be amended to read as follows:
An additional charge of $1.30 for each one thousand gallons shall be assessed on all
water consumed up to and including 10,000 gallons.
The motion died for a lack of a second.
Councilmember Owen moved that Ordinance No. 03-3402 be adopted on second
reading as presented. The motion was duly seconded by Councilmember Favila.
Mayor Anderson, Councilmembers Bertsch, Owen and Favila voted "for" the motion.
Councilmembers Shanes and McGehee voted against the motion. Councilmembers
Tipton and Pena abstained due to a conflict of interest. The motion.carried.
Wally Hatch, Interim City Manager presented for first reading, Ordinance No. 03-3399,
an Ordinance Adopting And Approving The Budget For The Fiscal Year Beginning
October 1, 2003, And Terminating September 30, 2004, And Making Such
Appropriations For Each Department, Project And Account. He stated former City
Manager Jim Jeffers' presented him with a budget that had a $90,000 deficit. The
budget proposed by Mr. Hatch proposes to eliminate the following positions: Assistant
City Manager-S65,955, Intern position-S8,386, Animal Shelter Attendant-S12,269,
Temporary Parks Maintenance Worker-S9,292, Parks Department Crew Leader-S4,500,
Water Distribution & Collection Department-S2,877 and Water Distribution Collection
Department-S30,474. These personnel changes result in $29,000 excess revenues
over expenditures.
Mayor Anderson asked for public comment.
Terry Carter of 1302 Holiday commended Wally Hatch for saving the City money.
James Odom of 3509 Kirchwood commented that due to the rate increases the City
employees would experience a cut in pay.
Councilmember McGehee moved that the budget be amended to increase the pass thru
allocations, special revenues funds - hotel/motel occupancy taxes from $5,000 to
$6,500 to the Cultural Arts Council and the Llano Estacado Museum. The motion was
duly seconded by Councilmember ShaneS. Councilmember Shanes, Pena, Bertsch,
Favila and McGehee voted "for" the motion with Mayor Anderson, Councilmembers
Owen, and Tipton voting "against" the motion. The motion carried.

. Councilmember Shanes moved to amend the budget to retain the Assistant City
Manager position to allow the newly hired City Manager to make the decision as to
whether to keep the position or not. The motion was duly seconded by Councilmember
Bertsch. Councilmembers Shanes and Bertsch voted "for" the motion. Mayor
Anderson, Councilmembers Tipton, Pena, Owen, McGehee and Favila voted "against"
the motion. The motion failed.
Councilmember Owen complimented Jack Keller and his staff for their work on the
budget. He moved that Ordinance No. 03-3399 be approved for first reading as
presented with the agreement that the kennel master position would be revisited in 90
days. The motion was duly seconded by Councilmember Tipton. Mayor Anderson,
Councilmembers Tipton, Pena, Owen, McGehee and Favila voted "for" the motion.
Councilmembers Shanes and Bertsch voted "against" the motion. The motion carried.
Councilmember Owen moved the meeting be adjourned. The motion was duly seconded
by Councilmember Favila and carried by unanimous vote.
