HomeMy WebLinkAboutR03-126Atmos Energy-Rate Increase Suspension Resolution No. R03-126 A Resolution of the City of Plainview suspending the effective date of the proposed increase in gas utility rates of Atmos Energy for 90 days; Authorizing the participation of the City of Plainview, Texas, with other service area cities located within the West Texas distribution system of Atmos Energy in a Steering Committee inquiring into the reasonableness of the Atmos Energy rates; Naming a representative to the Steering Committee; And providing an effective date. WHEREAS, the City of Plainview is the local regulatory authority for gas utility rate matters within its jurisdiction; and WHEREAS, on the 11th day of September, 2003, Atmos Energy filed a Statement of Intent with the City of Plainview to restructure its gas rates to moderate bill variability during the heating season and to increase its revenues from gas service. The Company also proposes changes to its Gas Cost Adjustment Clauses. The Company also proposes a new Rider to support a Weather Normalization Adjustment for Residential, Commercial, Public Authority, and State Institution customers. The proposed changes would affect all classes of customers residing within said municipality; and WHEREAS, said Statement of Intent proposes an effective date of October 16, 2003, for such increases in gas utility rates, changes to its gas cost adjustment clauses and new rider to support a weather normalization adjustment; and WHEREAS, the City Council of the City of Plainview wishes to insure that it has sufficient time to study the rate request of Atmos Energy; and WHEREAS, other cities within the West Texas distribution system of Atmos Energy have expressed interest in coordinating this study and inquiry; and WHEREAS, state law permits the governing body of the City of Plainview to suspend the effective date of any proposed increase by 90 days, until January 14, 2004, of gas utility rates within its original jurisdiction. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview, Texas: SECTION I That the proposed increases in gas utility rates, changes to its gas cost adjustment clauses and new rider to support a weather normalization adjustment as contained in the Statement of Intent of Atmos Energy, as filed with the City of Plainview, Texas, on September 11, 2003, is hereby suspended for 90 days, until January 14, 2004, or any Resolution R03-126 Atmos Energy-Rate Increase Suspension Page 1 of ~, amended or revised effective date, consistent with 35.08 (d) of Article 1446e, Vernon's Texas Civil Statutes, in order to allow the City of Plainview sufficient time to study and act upon such rate increase request. SECTION II That the City of Plainview, Texas, agrees to participate with other cities within the service area of the West Texas distribution system of Atmos Energy in a study and inquiry into the reasonableness of the rates of Atmos Energy. SECTION III That the City Manager or his designee may participate on the Steering Committee of other cities located within said service area of Atmos Energy and is authorized to receive notices concerning Steering Committee activities at the following address: City Manager City of Plainview 901 Broadway Plainview, TX 79072 SECTION IV That this resolution shall be delivered forthwith to Atmos Energy. SECTION V That this resolution shall take effect immediately from and after its passage. Passed and Adopted on the 14th day of October, 2003.
