HomeMy WebLinkAbout14 0923 Council minutesThe Plainview City Council met on September 23, 2014 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:40 p.m. on September 19, 2014. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams - District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, Lionel Garcia -District 6 and Eric Hastey-District 7. Staff members present were: Jeffrey Snyder -City Manager, Leslie Spear -City Attorney, Mike Gilliland -Director of Public Works, Sarianne Beversdorf-Director of Finance, Ken Coughlin -Police Chief, Rusty Powers -Fire Chief, lsauro Gutierrez -Information Technology Specialist, Andrew Freeman -Assistant City Manager, and Belinda Hinojosa- City Secretary. News Media Present: Homer Marquez -Plainview Herald and Caleb Hatch - Plainview Radio Guests Present: Mike Fox, Tom Almon, and Beverly McCaskill Councilmember Eric Hastey delivered the invocation and led in the pledge of allegiance. Councilmember Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Items approved on the consent calendar were the minutes of August 21, August 26, and September 4, 2014; the financial reports; Resolution R14-324, a Resolution of the City Council of the City of Plainview Establishing a Designated Downtown Area of the City as Slum or Blighted; Authorizing the Submission of a Texas Capital Fund Main Street Improvements Program Application to the Office of the Texas Department Of Agriculture; and Authorizing the Mayor to Act as the City's Executive Officer and Authorized Representative in All Matters Pertaining to the City's Participation in the Texas Department of Agriculture Texas Capital Fund Main Street Improvements Program; and Resolution R14-325, a Resolution of the City Council of the City of Plainview, Texas Authorizing the Filing of a Grant Application For Downtown Improvements with the Texas Department of Agriculture Main Street Program; Designating an Authorized Official and Authorizing Such Official to Execute all Documents Necessary; and Pledging Compliance to the Awarded Grant Program. Mayor Dunlap introduced Ordinance 14-3614, an Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2014 and Terminating September 30, 2015, and Making Such Appropriations for Each Department, Project and Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 14-3614 on second reading. The motion was duly seconded by Councilmember Juarez. Mayor Dunlap introduced Ordinance No. 14-3615, an Ordinance Levying Municipal Ad Valorem Taxes For The City Of Plainview, Texas, For The Year 2014, And Directing The Assessment And Collection Thereof; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; And Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Starnes moved that the property tax rate be adopted at the effective tax rate of sixty and thirty-eight hundredths cents ($.6038), which is effectively a 2.3767 percent decrease in the tax rate. The motion was duly seconded by Councilmember Williams. Mayor Dunlap introduced Ordinance No. 14-3616, an Ordinance of the City of Plainview Amending Ordinance No. 13-3598 and Ordinance No. 14-3609 To Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (a) and (d) of the Plainview City Charter Allowing For Supplemental Appropriations in the 2013-2014 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 14-3616 on second reading. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Jeffrey Snyder, City Manager presented for consideration Resolution R14-323, a Resolution By the City of Plainview, Texas, Authorizing Refunding of Canadian River Municipal Water Authority Contract Revenue Refunding Bonds, Series 2005 (Conjunctive Use Groundwater Supply Project) and/or Canadian River Municipal Water Authority Contract Revenue Bonds, Series 2006 (Conjunctive Use Groundwater Supply Project) City Council Minutes September 23, 2014 Page 2 of 3 The City of Plainview has a Conjunctive Use Groundwater Supply Contract with the Canadian River Municipal Water Authority (CRMWA) and CRMWA has issued revenue bonds based on that contract (Plainview's percentage ownership in CRMWA is 3.691 %). The Financial Advisor, George Williford with First Southwest Company, has identified potentially significant savings for CRMWA and its member cities if the CRMWA Revenue Refunding Bonds, Series 2005 and CRMWA Contract Revenue Bonds, Series 2006 are refunded. If the CRMWA Board, with the approval of the member cities, chooses to move forward with the refunding process, it would set up a parameter sale. This would basically give their financial advisor the authority to watch the market, and if certain parameters in terms of savings are met, they can go ahead with the refunding. If the preapproved parameters for savings are not met, there will be no refunding issue. Typically, a 3% present value savings is used to identify acceptable refunding. There are several parameter sale options the financial advisor has evaluated and recommended for this refunding. This Resolution waives the notice requirements and consents to the issuance of the refunding bonds. Staff recommends approval of the Resolution authorizing CRMWA to proceed with the refunding of the CRMWA Revenue Refunding Bonds, Series 2005 and CRMWA Contract Revenue Bonds, Series 2006 if the present value savings targets can be achieved. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to adopt Resolution R14-323. The motion was duly seconded by Mayor Pro Tem King and carried by unanimous vote.
