HomeMy WebLinkAbout03 1125 min234 The Plainview City Council met on November 25, 2003 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The'agenda for this meeting was posted in City Hall at 3:45 p.m. on November 21, 2003. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Belinda Pena-District 3, John N, Bertsch-District 4, Ross Owen-District 5, Buddy McGehee-District 6 and Irene Favila-District 7. Councilmember Mary Jane Shanes-District 2 was absent Staff members present were: Wally Hatch-Interim City Manager/City Attorney, John Castro-Director of Community Services, John Berry-Director of Public Works, Dale Simpson-Director of Civil Service, Gary Glass-Fire Chief, Will Mull-Police Chief, and Belinda Hinojosa-City Secretary. Guests present were: Capt, Ernest Lozano, Capt. Denise Lozano, Jim MoCk and Lynn Davis News Media Representative: Richard Orr-Plainview Daily Herald Rev. Santos Rodriguez from Iglesia Bautista Date Street delivered the invocation. Councilmember Pena led in the Pledge of Allegiance. Chief William Mull recognized Corporal Jose Porras for 5 years of service. Councilmember McGehee moved to adopt the consent calendar. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Items approved on the Consent Calendar included: approval of minutes of November 11, 2003; receipt of departmental reports; approval of expenditures and granting Councilmember Shanes an excused absence. The Council approved waiving the City funds for the Juvenile Accountability Incentive Block Grant (JAIBG). Wally Hatch presented for first reading Ordinance No. 03-3407, an Ordinance of the City of Plainview, Texas, amending Section 7-201 of the Code of Ordinances to prohibiting street or highway solicitation, or attempt to solicit, employment, business or contributions from the occupant of any vehicle. Mr. Hatch reminded the Council that any restrictions must apply to all groups. Mayor Anderson asked for public comment. Captain Ernest Lozano with the Salvation Army stated he understood the concerns of the group. He stated the funds collected by the Salvation Army are used for people in our community. He stated he had no objection to having to seek a permit. There was no other public comment. Councilmember Bertsch asked Captain Lozano what were their collection periods. Mr. Lozano stated they usually begin collecting the Friday before Thanksgiving through December 24th. Councilmember McGehee moved that consideration of this ordinance be tabled until the next regular council meeting. The motion was duly seconded by Councilmember Owen and carried by unanimous vote. City of Plainview Minutes November 25, 2003 Page I of 2 Wally Hatch presented for consideration the purchase of 48.5 acres out of the SW/4 of Section 40, Block JK-2, Hale County, Texas. He stated the property owner would sell to the City the whole 48.5 acres for $40,000. The City has put $4,000 into escrow and City staff recommends the purchase. The benefit of owning this property were (1) 10 acres of the property will be used for the hike/bike trail; (2) property could be used for Greenbelt Plat; and (3) for water well distribution. Mayor Anderson asked for public comment. Mr. R. C. Stevens of Plainview asked where the property was located? He was advised it was located behind the shopping center. Councilmember McGehee stated the City of Plainview has not received a lot of publicity, but the City of Lubbock has regarding the depletion of the water supply. He stated we are in the same situation regarding the water supply and by purchasing this additional land we are being proactive in this problem. Councilmember McGehee moved to approve the purchase of this property. The motion was duly seconded by Councilmember Favila and carded by unanimous vote. Councilmember Owen moved that the Council go into closed session (1) to discuss or deliberate regarding commercial or financial information that the City of Plainview has received from a business prospect that the City of Plainview seeks to have locate, stay, or expand in or near territory of the City of Plainview in which the City of Plainview is conducting economic development negotiations; and/or (2) to deliberate the offer of financial or other incentive to a business prospect described by Subdivision (1) [Texas Gov't. Code Ann. Section 551.087} (Peanut Processing Plant). The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Mayor Anderson recessed the meeting into closed session at 7:25 p.m. The Council reconvened in open session at 7:34 p.m. Councilmember Tipton moved that the City go in and raise the ante by $3,000 to $13,000 a year for a period of 10 years provided the County and Plainview/Hale County Industrial Foundation match this amount. The motion was duly seconded by Councilmember Favila and carried by unanimous vote. Councilmember Owen moved the meeting be adjourned. The motion was duly seconded by Councilmember McGehee and carried by unanimous vote.
