HomeMy WebLinkAbout03 1209 minThe Plainview City Council met on D~cember 9, 2003 at 7:00 p,m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:15 p.m. on December 1, 2003. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes- District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Ross Owen-District 5, Buddy McGehee-District 6 and Irene Favila-District 7. Staff members present were: Wally Hatch-Interim City Manager/City Attorney, John CaStro-Director of Community Services, John Berry-Director of Public Works, Dale Simpson-Director of Civil Service, Gary Glass-Fire Chief, Will Mull-Police Chief, and Belinda Hinojosa-City Secretary. Guests present were: Capt. Ernest Lozano and Capt. Denise Lozano News Media Representative: Richard Orr-Plainview Daily Herald Councilmember Shanes delivered the invocation. Councilmember McGehee led in the Pledge of Allegiance. Councilmember Shanes moved to adopt the consent calendar. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Items approved on the Consent Calendar included: approval of minutes of November 25, 2003 and December 4, 2003; receipt of departmental reports; and approval of expenditures. The Council approved awarding of the bids for the five police vehicles to the Iow bidder, Capitol Chevrolet of Austin in the amount of $79,975.00. Other bids received were as follows: Red McCombs Dodge of San Antonio ($85,546.25), Bob Gardner Chevrolet of Plainview ($92,390.00) and Jack Morris Ford, Plainview ($104,134.55). The Council approved membership in High Ground of Texas. Wally Hatch, Interim City Manager/City Attorney presented for first reading Ordinance No, 03-3407, an Ordinance of the City of Plainview, Texas, amending Section 7-201 of the Code of Ordinances to prohibiting without a license street or highway solicitation, or attempt to solicit, employment, business or contributions from the occupant of any vehicle. He stated City staff had presented a very restrictive version to the Council. Staff has pared off original version to include a safety requirement, permit fee of $100.00, requirement of group to fill out application process 30 days prior to solicitation period, and limit permits to one per year. Each of the Councilmembers should have received a copy of a letter from Captain Lozano of the Salvation Army stating they have no problem with the proposed ordinance. Mayor Anderson asked for public comment. Captain Lozano with the Salvation Army stated he shared the same concerns along with the citizens of the City. He said he did not see anything that they would be against and he stated they are al~ for the ordinance. Councilmember McGehee thanked Capt. Lozano for his input on this issue. Councilmember Owen stated that the citizens of Plainview need to understand that we · are-not trying to place undue hardship on legitimate organizations, but are working on City of Plainview Minutes December 9, 2003 Page '1 of 2 237 238 giving law enforcement guidelines to follow from. Councilmember Owen moved to adopt Ordinance No. 03-3407 upon first reading. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Mr. Hatch presented upon second reading Ordinance No. 03-3408, an Ordinance of the City of Plainview, Texas amending Chapter 25, Utilities, of the Plainview Code of Ordinances to provide for the regulation of water contributed to the wastewater disposal system to prevent the introduction of inadequately treated wastewater into the system; cumulativeness clause; severability clause; conflicts clause; effective date. Mr. Hatch stated this was basically housekeeping and that the changes were made pursuant to an inspection made by TCEQ. There was no public comment. Councilmember Pena moved to adopt Ordinance No. 03-3408 on second reading. The motion was duly seconded by Councilmember Favila and carried by unanimous vote. Councilmember Owen moved the meeting be adjourned. The motion was duly seconded by Councilmember Shanes and carried by unanimous vote.
