RESOLUTION R14-327
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF THE PLAINVIEW CHAMBER
OF COMMERCE TO HOST THEIR ANNUAL CHRISTMAS PARADE;
AUTHORIZING THE FILING OF THE AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION FOR THIS EVENT; DECLARING
THAT THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING TO
COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates U.S.
Highway 70 (5th Street) in the corporate limits of the City of Plainview; and
WHEREAS, the U.S. Highway 70 crosses Broadway Street within the corporate
limits of the City of Plainview; and
WHEREAS, the intersection of U.S. Highway 70 and Broadway Street is the critical
vein for parade use; and
WHEREAS, the City of Plainview received a request from the Plainview Chamber
of Commerce on October 16, 2014 for police assistance in its annual Christmas Parade,
which is to be held on Thursday, December 4, 2014; and
WHEREAS, the Christmas Parade will begin at 6:30 p.m. in Broadway Park and
will travel north on Broadway Street to the Santa Fe Depot where it will end at 7:30 p.m.
The Christmas Parade will cross U.S. Highway 70 on Broadway Street, closing this
intersection until the parade clears the intersection; and
WHEREAS, the City Council of the City of Plainview finds that such parade serves
a public purpose in that the parade recognizes the holiday season and the significance of
the local business community in this area; and
WHEREAS, the City Council of the City of Plainview finds it in the best interest for
the citizens of Plainview that the Christmas Parade be held this year on December 4,
2014 and use the above stated route; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of State Right -
of -Way for use of U.S. Highway 70; and
WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or terminate such
Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

Plainview that:
The request from the Plainview Chamber of Commerce to host the Chamber of
Commerce Christmas Parade for Thursday, December 4, 2014 is hereby approved.
The public purpose of this event is to celebrate the holiday season as well as to
recognize the significance of the local business community in this area.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT-OF-WAY with the Texas Department of Transportation is hereby
approved.
IV.
The Mayor is hereby authorized and directed to execute on behalf of the City of
Plainview all necessary documents, including the AGREEMENT FOR THE TEMPORARY
CLOSURE OF STATE RIGHT-OF-WAY to complete the parade preparation process.
