RESOLUTION NO. R14-326
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, AUTHORIZING AEROCARE TO ACT AS A PRIVATE TRANSFER
SERVICE FOR EMERGENCY MEDICAL SERVICES IN THE CITY OF
PLAINVIEW, TEXAS AFTER A PUBLIC HEARING SHOWING CLEAR AND
CONVINCING EVIDENCE OF THE COMMUNITY'S NEED FOR ADDITIONAL
SERVICES; GRANTING AEROCARE A PERMIT TO OPERATE THEIR
SERVICES WITHIN THE CITY; AND AUTHORIZING THE CITY SECRETARY
TO SIGN SUCH PRIVATE TRANSFER AMBULANCE SERVICE PERMIT.
WHEREAS, the City Council of Plainview, Texas has the authority to govern and
regulate private transfer ambulance service permits in accordance with City of Plainview
Code of Ordinances, Chapter 6, Article 6.05, Division 3, Private Transfer Ambulance Service;
and
WHEREAS, the City of Plainview has received a permit application from Med-Trans
Corporation dba AeroCare in Lubbock, Texas, to provide their services within the City of
Plainview; and
WHEREAS, in accordance with the City of Plainview Code of Ordinances at Section
6.05.066, the City Council set a public hearing and heard evidence showing additional
services are necessary within the City by clear and convincing evidence and further finds that
the community will not be adversely affected; and
WHEREAS, the Council also has deemed the applicant is qualified to render good
services and has or will have sufficient equipment of suitable type and condition; and
WHEREAS, the City of Plainview's City Council finds it necessary and in the best
interest of Plainview citizens to authorize AeroCare to act as a private transfer ambulance
service for emergency medical services within the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview:
AeroCare submitted an application for a permit to operate a private transfer
ambulance service for emergency medical services to the City of Plainview, Texas.
The City Council heard evidence at a public hearing regarding the necessity of
additional services within the City to benefit Plainview citizens and finds that such services
are necessary and will benefit the City as a whole.

The City Council further grants AeroCare a permit to operate their private transfer
ambulance service within the City of Plainview, Texas in accordance with City of Plainview
Code of Ordinances, Chapter 6, Article 6.05, Division 3, Private Transfer Ambulance Service.
IV.
In accordance with City of Plainview Code of Ordinances at Section 6.05.074, the City
Secretary is authorized to sign a transfer ambulance operator's permit to AeroCare for the
period of one (1) year from the issuance date.
V.
AeroCare is responsible for complying with all City, State, and Federal laws and
regulations regarding the operation of a private transfer ambulance service within the City of
Plainview, Texas. The City Manager or his designee may investigate any alleged legal
violations as well as any unsafe, dangerous, or hazardous conditions and revoke such
permit, if necessary.
