First item on the agenda: Approval of June 2003 minutes. Glenn Bickel made motion to approve minutes as
read. Kenny Brown seconded. Motion carried 4-0.
Second item on the agenda: Discussion and change of meeting time. John Castro informed the Board the City
Council and other Boards have changed their meeting times from 7:30 P.M. to 7 P.M. with Precession at 6:30 P.M.
instead of 7:00 P.M. He told the Board they may chose to keep their meeting time as is or they may change it. Max
Browning made motion to change the meeting time from 7:30 P.M. to 7:00 P.M. and to change precession time from
7:00 P.M. to 6:30 P.M. Glenn Bickel seconded. Motion carried 4-0.
Third item on the agenda: Case 1449 - The request of Carlos Ibarra for a variance of thirteen (13) feet of the
required twenty-five (25) foot front setback and a variance of five (5) feet of the required five (5) foot side setback
as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20'X19' carport in a Single Family
Residential (R-2) Zoning District, and being Block 8, Lot 4, McClelland Addition, Plainview, Hale County, Texas
the same being 309 Fir Street. Juanita Ibarra, wife of Carlos Ibarra, is present to answer any questions of the Board.
John Castro showed the Board pictures of the property and the proposed placement of the carport as well as a
neighborhood map showing other properties in the area. Max Browning asked what materials would be used to
construct the carport and Juanita Ibarra said it would be a prefabricated carport. There were no responses received
from the neighborhood property owners. Glenn Bickel made motion to approve the variance based on this being the
only logical place for the carport and there being no negative responses from the neighborhood. Kenny Brown
seconded the motion. Motion carried 4-0.
Fourth item on the agenda: Case 1450 - The request of Lydia Carrillo for a variance of fifteen (15) feet six (6)
inches of the required twenty-five (25) foot front as stated in Section 34 of the City of Plainview Zoning Ordinance
to construct a 10'X20' carport in a Single Family Residential (R-2) Zoning District, and being Block 2, Lot 23,
Hillcrest Addition, Plainview, Hale County, Texas the same being 222 SE 10t~ Street. Salvador Azua is present on
behalf of Lydia Carrillo to answer questions from the Board. John Castro showed the Board pictures of the
proposed placement of the carport in relation to the property as well as a map of the neighborhood. There was one
response from the neighborhood received, which was in favor of the request. Ray Jameson asked what type
materials would be used in the construction of the carport and Salvador Azua said he would be using 4X4 square
tubing and 4 inch C perling. Glenn Bickel asked which direction would water drain and Salvador Azua said it
would drain toward the street. Salvador Azua asked if he could level off the curb where the driveway will be
located. John Castro told him that when he tears out the curb he can put roll curb back in its place. Salvador Azua
then asked if he could extend the carport another four (4) feet in width and John Castro said he can only make the
carport 10'X20' as requested since that is the way it was published. Max Browning made motion to approve the
variance based on positive response from the neighborhood and this being the only logical place for the carport.
Kenny Brown seconded the motion. Motion carried 4-0.
Fifth item on the agenda: Case 1451 - The request of Robert Kollman for a variance of seventeen (17) feet of the
required twenty (20) foot rear setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct
a 26'8"X24' garage in a Single Family Residential (R-I) Zoning District, and being Block 3, Lot 7, Westridge
Addition, Plainview, Hale County, Texas the same being 405 Kirchwood Street. Robert Kollman is present to
answer questions from the Board. John Castro showed the Board pictures of the location of the proposed garage as
well as a map of the neighborhood as well as a floor plan of the proposed garage. He said this property has an odd
shape. He also said that this property has a utility easement and he showed pictures of the electrical pole and guide
wrres on the property. He said there were a couple existing trees that Mr. Kollman does not want to cut down and
that is part of the reason for the chosen placement of the proposed garage. There was one response received, in
favor of the request/jthe following restrictions are made:
1. This construction should be restricted for residential use only.
2. No commercial activity should be allowed now or in the future if this property should be sold.
3. We would expect the proper city officials to monitor the use of this structure.
Robert Kollman said he had visited with this neighbor and assured the neighbor as well as the Board that the garage
would be used only for his own personal use - no commercial activity would take place in the garage. John Castro
said the City Zoning Ordinance would take care of this concern of the neighbors. He als0 added there were probably
deed restrictions in that neighborhood that would not allow any type commercial activity. Glenn Bickel asked if Mr.
Kollman planned to brick the building and Robert Kollman said he did intend to brick it. He added that all he wants
to use the building for would be storage of hiS vehicle and storage. He said that even though th~ floor plan showed a
place for a washer and dryer in the upstairs portion, that he only intends to use that space for storage. He did say
that he is planning to put in a restroom in the downstairs area. Glenn Bickel asked if he planned to pave the alley
and Robert Kollman said he does not plan to pave the alley. Glenn Bickel made motion to approve the variance
request for the garage due to the odd shaped lot and the special conditions, and in addition, the garage can be used
only for personal, residential use and is not intended for any commercial use. Kenny Brown seconded the motion.
Motion carried 4-0.
