HomeMy WebLinkAbout04 0224 minThe Plainview City Council met on February 24, 2004 at 7:00 p.m. in the CitY COuncil Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:00 p.m. on February 18, 2004. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes- District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Ross Owen-District 5, Buddy McGehee-District 6 and Irene Favila-District 7. 257 Staff members present were: Greg Ingham-City Manager, Wally Hatch-City Attorney, John Castro-Director of Community Services, Brice Clements-Engineer/Assistant Director of Public Works, Will Mull-Police Chief, Gary Glass-Fire Chief, Dennis Harkins- Police Captain, Rusty Reese-Parks Superintendent, Del Essary-Landfill Superintendent, Linda Milner-RSVP Coordinator and Belinda Hinojosa-City Secretary. Guests present were: Olene Yates, Drury Roberts, T. C. Wall, Jack McClung, Scott Alford and Cathy Graugnard News Media Representative: Richard Orr-Plainview Daily Herald Rev. Jack McClung delivered the invocation, Mayor Anderson led in the Pledge of Allegiance. Councilmember Owen moved to adopt the consent calendar. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Items approved on the Consent Calendar included: approval of minutes of February 10 and February 19, 2004 and approval of expenditures, Since no bids were received for asphalt, the Council chose to rebid. The Council awarded the bids for gravel to Thrasher, Inc. Their bid price was $20.98 per ton for a total of $71,332 for 3,400 tons. Two other bids received were: Capital Aggregates - $30.05 per ton for a total of $102,170 for 3,400 tons and Lipham Construction Co. - $23.60 per ton for a total of $80,240 for 3,400 tons. The Council awarded the pickup bids to Shamrock Chevrolet with a bid of $15,347 for the ~ Ton Pick-Up Extended Cab and $18,193. each for three % Ton Pick-up/Utility Box for a total of $54,579. Other bids received were: Gardner Chevrolet $16,881.75 for ~ Ton Pick-up Extended Cab with some exceptions and $19,891.55 each for three % Ton Pick-up/Utility Box for a total of $59,774.65; Jack Morris Ford $18,1t4.75 for ~ Ton Pick-up Extended Cab with some exceptions and $24,637.48 each for three ~ Ton Pick-up/Utility Box for a total of $74,912.44. The Council reappointed Dr. Michael Hinze, Sally Meeks, RN and Kit Linton, M.D. to the Board of Health with said terms to expire January 1, 2006. The Council approved the reappointment of Belinda Pena to the Board of Health with said term to expire January 1,2005. Linda Milner, RSVP Coordinator along with John Perry and Olene Yates, RSVP board members appeared to express their thanks to the City Council for sponsorship of the RSVP program. :~:~-,:: .: ~ KidsVille.and:.south~of the tennis courts. Scott Alford with the Rotary Club appeared before the Council to ask that they consider the request of the Rotary Club to construct and donate a 20' x 40' open sided pavilion to the City to be located at Regional Running Water Draw Park and to be dedicated in honor of the late Mayor Lloyd C. Woods. Mr, Alford stated they have contacted Noel Industry to assist with the construction. The proposed site is adjacent to Rusty Reese will work with the landscaping. Councilmember Bertsch stated it was admirable of the Rotarians and they should consider throwing out a challenge to the Kiwanis and Lions to construct pavilions in all the parks. Councilmember Shanes moved that the council approve the request from the Rotarians. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Del Essary, Landfill Superintendent presented Resolution R04-131, a Resolution of the City Council of the City of Plainview, Texas, Authorizing the Filing of a Grant Application With the South Plains Association of Governments For a Regional Solid Waste Grants Program Grant; Authorizing Del Essary to Act on Behalf of the City of Plainview in all Matters Related to the Application; And Pledging That if a Grant is Received the City of Plainview Will Comply With the Grant Requirements of.the South Plains Association of Governments, the Texas Commission on Environmental Quality and the State of Texas~ It is an application for an annual solid waste reduction grant administered and awarded by South Plains Association of Governments. The grant would be for $8,000 to purchase a slightly used compost turner. There was no public comment. Councilmember McGehee moved to adopt Resolution R04-131~ The motion was duly seconded by Councilmember Owen and carried by unanimous vote. Brice Clements, Engineer presented for review and consideration the approval of the Preliminary Plat for Western Acres Unit No. 2 out of the NW Part of Section 29, Block JK-2, Southwest of Plainview, Hale County, Texas the same being located East of Westridge Road and South of Southwest Third Street. He stated the request is from Brunson Builders. Each lot is one acre in size. The lots are oversized since there will be no utilities. The property is located under the Extra Territorial Jurisdiction, which is managed by the City due to an agreement between the County and the City. The ETJ is one mile outside the city limits. There was no public comment. Councilmember Owen moved to approve the preliminary plat. Councilmember McGehee modified the motion to read "move to approve the preliminary plat subject to revisions recommended by the engineer." The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. John Castro, Director of Community Services and Development presented upon first reading Ordinance No. 04-3414, an Ordinance Amending the Zoning Map of the City of Plainview, Texas For Rezoning From Multi Family (MF-1), Multi Family (MF-2), Single Family Residential (R-2), And Heavy Manufacturing (M-2) Zoning District To Single Family Residential (R-2) Zoning Distdct Said Parcel Being A 28.8710 Acre Tract out of the NW Part of the S 1/2 of the NW 1/4 Of Survey No. 38, AB 2956, Block JK-2 the Same Being in the Vicinity of 3200 and 3300 Blocks of Lexington Street, City of Plainview, Hale County, Texas; Cumulativeness Clause; Conflicts Clause; Severability Clause; and City of Plainview Minutes February 24, 2004 Page 2 of 3 Effective Date. Mr. Castr° advised that T. C. Wall has applied for rezoning on behalf of High Plains COncrete. One response was received in favor and the Planning-& Zoning Commission recommends approval. There was no public comment. Councilmember Bertsch moved to adopt Ordinance No. 04-3414 upon first reading. The motion was duly seconded by Councilmember Favila and carried by unanimous vote. Mr. Castro presented upon first reading, Ordinance No. 04-3415, an Ordinance Amending the Zoning Map of the City of Plainview, Texas for Rezoning From a Retail (C-2) Zoning District to a Commercial General Business (C-3) Zoning Distdct Said Parcel Being Lots 7, Unit 2, Joslin Subdivision, the Same Being 2602 Olton Road, City of Plainview, Hale County, Texas, Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. Mr. Castro advised that Drury Roberts, on behalf of Realty Income Texas Properties L.P., has requested rezoning of 2602 Olton Road (old Buns Over Texas Property) from a Retail (C-2) Zoning District to a Commercial General Business (C-3) Zoning District. The Planning & Zoning Commission recommends approval. It is anticipated that the current building will be demolished and a new building constructed for use as a furniture rental outlet. There was no public comment. Councilmember Shanes moved to adopt Ordinance 04-3415 upon first reading. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Police Chief William Mull and Captain Dennis Harkins presented the 2003 Racial Profiling Report, Councilmember Owen moved to adjourn the meeting. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. There being no further business, Mayor Anderson adjourned the meeting at 8:08 p,m.
