STAFF MEMBERS PRESENT: Jeffrey Snyder — Assistant City Manager and Judy Rasher, Community Services Secretaries. GUESTS PRESENT: Mark Hardin called the meeting to order at 7:00 P. M. FIRST ITEM ON THE AGENDA: Oath of office to members: Not applicable SECOND ITEM ON THE AGENDA: Approval of June 25, 2012 minutes. Joe Frank Rodriguez made a motion to approve minutes as presented. Kevin Carter seconded the motion. Motion carried unanimously. THIRD ITEM ON THE AGENDA: BA Case No. 1618 - Consider the request of a special exception to the required minimum twenty -five (25) foot front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(h) Special Exceptions. Property Owner: Santos and Yolanda Rodriguez Address: 1315 Godsey Legal Description: Lots 18 -19 Block 2 of Merryman Addition Zoning: R -2 Joe Frank Rodriguez made a motion to approve the variance based on the request. Kevin Carter seconded and the motion carried unanimously. FOURTH ITEM ON THE AGENDA: BA Case No. 1619 - Consider the request of a special exception to the required minimum twenty -five (25) foot front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(h) Special Exceptions. Property Owner: Address: 1309 Navajo Trail Legal Description: Lot 9 Unit 4 Block 18 of Thunderbird Addition Zoning: R -2 Kevin Carter made a motion to approve the variance based on the request. Joe Frank Rodriguez seconded and the motion carried unanimously. Property Owner: Luis Gallegos and Adriana Salazar Address: 1202 Nassau Legal Description: Lot 11 Block 39 of Highland Addition Zoning: R -2 Joe Frank Rodriguez made a motion to approve the variance based on the request. Kevin Carter seconded and the motion carried unanimously. SIXTH ITEM ON THE AGENDA: BA Case No. 1621 - Consider the request of a special exception to the required minimum twenty-five (25) foot front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(h) Special Exceptions. Property Owner: Eluid and Nohemi Ruiz Address: 1907 W. 17th Street Legal Description: E35' of Lot 4 and W25' of Lot 5 Block 1 of High School Addition Zoning: R -1 Andra Dorzil, Interpreter for Mr. & Mrs. Ruiz was present. Kevin Carter made a motion to approve the variance based on the request. Joe Frank Rodriguez seconded and the motion carried unanimously. SEVENTH ITEM ON THE AGENDA: BA Case No. 1622 - Consider the request of a special exception to the required minimum twenty -five (25) foot front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(h) Special Exceptions. Property Owner: Cresencio and Olga L Perez Address: 804 Lexington Legal Description: Lot 11 Block 5 of College Hill Addition Zoning: R -2 Joe Frank Rodriguez made a motion to approve the variance based on the request. Kevin Carter seconded and the motion carried unanimously. EIGHTH ITEM ON THE AGENDA: BA Case No. 1623 - Consider the request of a special exception to the required minimum twenty -five (25) foot front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(h) Special Exceptions. Property Owner: Kenneth and Tammy Service Address: 109 Juanita Legal Description: Lots 14 -15 Block 6 Country Club Addition Zoning: R -1 Board of Adjustment August 27, 2012 Minutes Page 2 of 3 Homeowners, Ken and Tammy Service were present at the hearing. Homeowners presented new plans of a Carport that did not meet the requirements under the city of Plainview Zoning Ordinance Section 37.2.2(h) Special Exceptions. Jeffrey Snyder, Assistant City Manager request that the new plans be denied. Kevin Carter made a motion to table this matter until such time the homeowners and the City of Plainview reach a decision on the proper requirements of the constructions of a carport. Joe Frank Rodriguez seconded and the motion carried unanimously. NINTH ITEM ON THE AGENDA: Adjournment — Meeting adjourned at 7:32 P.M.
