City Hall at 901 Broadway, Plainview, Texas. The agenda for this meeting was posted in
City Hall at 11:40 a.m. on July 6, 2015. Mayor Wendell Dunlap presided.
Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2,
Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, Lionel
Garcia -District 6 and Eric Hastey-District 7.
Staff members present were: Jeffrey Snyder -City Manager, Andrew Freeman -Assistant
City Manager, Leslie Spear Schmidt -City Attorney, Rusty Powers -Fire Chief, Ken
Coughlin -Police Chief, Mike Gilliland -Director of Public Works, Sarianne Beversdorf-
Director of Finance, lsauro Gutierrez -Information Technology Specialist and Belinda
Hinojosa-City Secretary.

Councilmember Susan Blackerby led in the Invocation.
Jeffrey Snyder, City Manager presented for consideration on first reading, Ordinance No.
15-3621, an Ordinance Creating Chapter 1, Article 1.13, Division 6, Skate Park Rules of
the Code of Ordinances of the City of Plainview, Texas, Defining Terms; Authorizing
Signage to be Conspicuously Posted Providing Curfew Hours for the Skate Park;
Adopting Rules And Regulations; Establishing Offenses and Penalties for Violation of the
Skatepark Rules With a Fine Not to Exceed $500; Severability Clause; Cumulativeness
Clause; Conflicts Clause; Effective Date; and Providing for Publication and Enforcement
of such Ordinance. Texas House Bill 1058 enacted as of September 1, 1999, is intended
to limit a municipality's liability arising out of the use of skateboard and other recreational
facilities, except for gross negligence and acts conducted in bad faith or with malicious
intent.
H.B. 1058 also requires cities to post a sign at each facility with the following specific
language: Texas Law (Chapter 75, Civil Practices and Remedies Code) limits the liability
of a municipality that owns, operates or maintains a facility in which hockey, in-line
hockey, skating, in-line skating, roller-skating, skateboarding or roller-blading are
conducted for damages arising directly from such recreational activities. Additional
signage is recommended from the Texas Municipal League Intergovernmental Risk Pool
management perspective to warn and inform participants of rules and conditions of using
the facility.
Staff recommends approval on first reading. Some of the highlights of the ordinance are
as follows:
• The Skate Park will be closed every day from 10:00 p.m. to 8:00 a.m. and any
time when signage is posted closing the Skate Park for cleaning and
maintenance.
• Warning that skating and biking can be hazardous activities.
• Motorized vehicles are prohibited

• This facility is used by both experienced and inexperienced skaters and bikers.
Serious injury may result from falling, colliding or being hit by a skateboard,
skate, bicycle or any wheeled apparatus authorized in the Skate Park. The City
assumes no responsibility for injuries. SKATE AND/OR CYCLE AT YOUR
OWN RISK!
• Every child under the age of ten years on the Skate Park surface must be
accompanied by an adult over seventeen years of age who is directly
supervising the activities of that child.
Staff recommends adoption of the Ordinance.
Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro
Tem King moved to adopt Ordinance No. 15-3621 on first reading. The motion was duly
seconded by Councilmember Blackerby and carried by unanimous vote.
The Council and staff reviewed the agenda for the City Council meeting of July 14, 2015.
The Council and staff reviewed the proposed 2015-2016 budget.
There being no further business, Mayor Dunlap adjourned the meeting at 8:30 p.m.
